This agreement governsand controls the temporary rental of the property known as Blue Parrot #7 & #8,located at 1235 West Beach Blvd Gulf Shores, AL 36542 (the “Property”) and isentered into by guests on behalf of themselvesand each of their occupants, invitees, guests, family members or friendsvisiting or entering on the Property (hereafter collectively “Guest”) on theone hand and Manager on behalf of itself and on behalf of the owner of recordof the Property set forth in the public records of Baldwin county (the“Owner”).Guest and Manager hereby agree as follows:

Terms and Conditions

INITIAL RESERVATION PAYMENT:  Aninitial reservation payment in the amount of 60% of the entire trip costincluding base rent and all fees is due at the time this rental is booked andwill be applied towards the balance of the rent. 

FINAL PAYMENT: Your final reservationpayment of 40% is due 60 days before your arrival based on total reservationamount. CANCELLATION POLICY:  Please note the cancellation policy does not provide forcancellations or refunds for matters beyond Manager’s control or unforeseendevelopments such as illnesses, acts of God, strikes, environmental hazards,mandatory hurricane evacuations, travel restrictions and similar events thatcan affect your trip and NO REFUNDS are issued for cancellations or earlydeparture due to same or inclement weather or personal circumstances after thecancellation date range. Guests purchasing travel insurance should consulttheir insurance provider directly to see if they qualify for a refund.

TRIP INSURANCE:  It isIMPERATIVE that you purchase TRIP INSURANCE to protect the investment that youhave made in your family vacation.

ACCIDENTAL RENTAL DAMAGE WAIVER:Accidental damage protection is not provided during your rental period. Anydamage or accident will be the sole responsibility of the Guest. The Guestagrees to pay for any damages and any costs related to an accident.

CHECK-IN· Your access instructions will beemailed to you prior to your stay.· Check-in begins at 3:00 p.m. CST.· We make every effort for the Propertyto be ready for your arrival at that time; however, much of that depends on thecourtesy of our guests and the condition in which the Property is left. Ourhousekeeping standards may require extra cleaning time which may delaycheck-in. We ask for your patience in the unfortunate event this happens onyour check-in date. And we ask for your help in making sure it does not happento the guests who arrive after you!Guest agrees to immediately notifyManager or the house cleaning service upon check-in of any problem with theProperty that Guest reasonably believes to be unacceptable. Upon such notice,Manager shall have a reasonable amount of time, which shall not be less than 24hours, to inspect and remedy the noticed situation to Guest’s reasonable satisfaction. In no event may Guest simply departearly and request a refund, without giving the Manager the opportunity to cureany reasonable objections.· Early Check-In is not availableduring busy or peak seasons (e.g. spring and summer) or any “back to back”check-ins.

CHECK-OUT· Check-out time is before 10:00 AMCST! An additional fee may be assessed if the Property is not completelyvacated by check-out time.· Late check-out is never available ona “back to back” check-out. If the Property is not booked the night you aredeparting you may contact the Manager to request a late check-out. This must bescheduled at least 25 hours in advance to allow our cleaners time to modifytheir schedule.

MAINTENANCE: It is important to usthat the Property be maintained in good condition and repair. Maintenanceproviders may access the Property for purposes of repairing previously reportedissues, or for routine items such as lawn, AC filter, and appliance or poolmaintenance. We strive to be as unobtrusive as possible while performing thesetasks and appreciate your patience—it is important to you and to us that the Propertybe well maintained.·Please let us know as soon aspossible if a maintenance issue arises. Just as might occur at your own well-maintainedhome, mechanical failures and other breakdowns could occur and you agree tonotify us as soon as possible.Guest acknowledges that unforeseenrepairs and necessary maintenance to the grounds and buildings may benecessary.  Croxton Properties LLC mayhave no control over schedules, the duration or extent of work being done on Propertyor adjacent/adjoining properties, including new construction. Work is rarelydone after-hours or weekends, however when necessary there may be limited orrestricted access to certain areas of the grounds or Property. In cases whereCroxton Properties LLC is notified in advance, we will do our best to informguests of any projects that could be in progress during your visit. Nocancellations or monetary refunds will be made for noise or restricted accessto elements at Property or adjacent properties.

NO GUARANTEES: Working condition ofequipment, amenities, pools, pool heaters, air conditioners, heaters, cable,phones, internet service, grills, TVs, DVDs, Wifi, appliances, beds, elevators,and the like, are NOT guaranteed. These amenities are extras provided inaddition to the beach house. We will make every effort to correct reportedbreakdowns ASAP, but condition of amenities cannot be guaranteed 100% of the timeand shall not serve the basis for any refunds. No refunds will be given for anyequipment or amenities failure. Although all attempts will be made to correctthe situation, some breakdowns cannot be prevented or repaired during youroccupancy.Under no circumstances will guest(s)be entitled to any refund after the departure date of their contract, unlessagreed to by the parties in writing prior to departure. Once you have completedyour stay (departure date/ standard check-out time) you waive all rights to anyrefunds.

RISK: GUEST ACKNOWLEDGES THAT BEACHES,LAGOONS, DOCKS, PIERS, SWIMMING AREAS AND POOLS AND AREAS SURROUNDING THE SAMEARE INHERENTLY DANGEROUS AND CAN RESULT IN SERIOUS INJURY, DROWNING, OR DEATH.GUEST EXPRESSLY ASSUMES ALL RISKS ASSOCIATED WITH ANY DANGEROUS CONDITION,KNOWN OR UNKNOWN, and covenants to exercise great caution in and around theseareas and when using any pool, outdoor spa/hot tub, pool area, beach area,lagoon or waterfront area, dock, pier, stairs, deck or balcony. CHILDREN MUSTBE SUPERVISED AT ALL TIMES AND GUEST EXPRESSLY COVENANTS AND AGREES TO SAME.OWNER AND MANAGER ASSUME NO AND EXPRESSLY DISCLAIM ALL RESPONSIBILITY ORLIABILITY FOR ANY ACCIDENT OR INJURY INCURRED IN, ON OR AROUND THE PROPERTY.For and in consideration of the amenities and the right to access and use theProperty, Guest and all persons using the Property and the amenities represent,covenant and agree with the Owner and Manager, to make no claim against Owneror Manager for or on account of any loss of life, personal injury, or damage toor loss of personal property and to hold Owner and Manager harmless from same.Guest acknowledges and agrees that, but for Guest’s express assumption of risksset forth in this paragraph and the covenant not to sue and hold harmlessprovisions, Guest would not be allowed to access or use the Property.POOL HEATER: This Property does nothave a pool heater.SMOKING: No smoking is allowed insidethe Property. Evidence of smoking inside the home premises will incur a chargeof $300, plus the costs to remedy any additional damages caused by smoke orburns. Please be sure all doors are closed if you smoke outside. DO NOT USE OURBEACH, LAGOONS, DECKS, DOCKS, PORCHES, YARDS, PLANTING BEDS, DECORATIVE ITEMSOR DRIVEWAYS AS ASHTRAYS.

PETS: Pets are not allowed in the Property.  Any indication of pets will be subject to a$300 fee plus any additional cleaning fees to make the home available to guestthat may have pet allergies which lead them to rent a non-pet home.REAL ESTATE LISTINGSYour unit may be shown by a licensedreal estate agent during your stay. If so, you will be contacted and given atleast 24 hours notice and the showing will be scheduled at your convenience. Ifthe unit is sold the rental will most likely be transferred to the new owner.If not, you will have the option to switch to a comparable unit if available orbe refunded any payments made.

DEPARTURE RESPONSIBILITIES·Please leave Property reasonablyclean and in reasonable order. Please remember that this is an individuallyowned property. Please treat our home as you would like us to treat yours. Allfurniture, decorative items, bedding, dishes, etc. should be left where it wasupon your arrival.- Lock all doors and windows.- Please leave kitchen items (dishes,cookware, etc.) cleaned and returned to their proper place. (A small number ofitems may be left running in the dishwasher if they were needed for yourdeparting breakfast. Please be respectful to our cleaners and keep this to aminimum.)- Dispose of all trash in properoutside containers.  Take full trashcontainers to the street.- Please leave all used beds unmade,but remove sheets from sleeper sofas before closing the sofa.The departure cleaning fee includesthe remaking of the beds with fresh clean linens, laundering all linens,dusting, vacuuming and mopping floors, and cleaning and sanitizing bathroomsafter your departure. If additional cleaning is needed after you check out, anyitems are damaged or missing (including linens), or furniture repositioned, youwill be charged for the additional cleaning service and/or missing items.

HURRICANE AND WEATHER POLICYWe do not offer any refunds forHurricanes or other weather events. We strongly recommend securing TRAVELINSURANCE for your trip. It is up to the Guest to purchase this coverage fortheir trip. Travel insurance is the sole responsibility of the Guest. We do notrefund rents or deposits lost due to canceled or shortened stays because ofweather. Departures due to inclement weather do no warrant refund of rent ordeposit.

RENTAL OCCUPANCY AND PARKINGBlue Parrot #7 & #8 each has an occupancy limitof 14 people including children.  Guestwill abide by the parking restrictions as indicated by Croxton Properties LLCat the Property and shall not park any cars or vehicles on or around publicroadways.  The listed "LIMIT"number indicates the maximum number of occupants allowed in the Property at anyone time. (Exceptions for infants under age 2 only.) Atmosphere conducive toquiet enjoyment of guests in surrounding accommodations must be maintained atall times. No loud noise or music is allowed. All rules and regulations at theProperty must be strictly observed. Only responsible adults of legalcontractual age may contract for rental. Legal Guest named on the rentalagreement must occupy Property at all times during dates listed on theAgreement.

ABSOLUTELY NO HOUSE PARTIES ALLOWED.Minimum rental of age is 25.Guest expressly acknowledges andagrees that the Guest is legally responsible for compliance by all occupants ofthe Property and any guests, persons or invitees on the Property with the termsand conditions of the Croxton Properties LLC, The City of Gulf Shores, and thisagreement.*Please Note: Violations of CroxtonProperties LLC Policies, The City of Gulf Shores Ordinances, and this Agreementare grounds for IMMEDIATE EVICTION AND FORFEITURE OF RENT.CAUSES OF EJECTION OF UNDESIRABLE GUESTLAWS OF GULF SHORESYou are reserving your unit under theauthority of the Causes of Ejection of Undesirable Guest laws of Gulf Shoresand Orange Beach. Some of the causes of ejection are listed for you below:-If you, the named party ofreservation, are found to be under the age of 25 years old.-If the named party of reservation isnot present at the unit, in direct supervision of the guests or invitees at theunit, or cannot become present and maintain direct supervision of the guests orinvitees at the unit within an immediate and appropriate time.-If the capacity of the unit isexceeded by daytime visiting guests or night-time occupants of the unit.-If damage to the unit is visible orotherwise evident.-If the guests or invitees of the unitare in any way disrupting the peaceful occupation of the neighboring homes.-Ejection of the guest, theirpossessions, and their invited guests will be completed pursuant to the law ifthe guest is deemed in violation of any of these listed items.CROXTON PROPERTIES LLC RESERVES THERIGHT TO EJECT ANYONE THAT IS DEEMED AS ABUSIVE TO THE PROPERTY, AMENITIES,NEIGHBORING HOMES, GUESTS OF OTHER MANAGEMENT COMPANIES, OR CROXTON PROPERTIESLLC, OR ENGAGES IN RECKLESS CONDUCT THAT COULD LEAD TO INJURY OR DEATH.VERIFICATION OF GUEST IDENTITYFALSIFIED RESERVATIONS: Anyreservation obtained under false pretense will be subject to forfeiture ofadvance initial reservation payment and/or rental money and the party will notbe permitted to check in. We reserve the right to not rent to parties that wedeem could present a threat or nuisance to the home, guest, or neighboringowners.Waiver and Release of Liability1. Owner and Manager are not liable inany way for loss, damage of property, death or injury to Guest or invitees,occupants, guests, family members, friends or persons during Guest’s stay onthe Property.2. Guest, on behalf of himself orherself and all of Guest’s invitees, guests, family members, friends andoccupants or users of the Property (collectively “Guest”) hereby release,waive, discharge, and covenant not to sue the Owner and Manager, for any liability,claim, and/or cause of action arising out of or related to any loss, damage, orinjury, including death (the “Claim”), that may be sustained by Guest arisingout of or in any way related to the use or occupancy of the home or Property.3. This waiver and release ofliability is unconditional and shall be construed as broadly as possible in favorof Owner and Manager and shall be fully effective whether the Claim arises fromor is caused by, in whole or in part, the negligence of any Guest, the negligenceof the Owner or Manager, or the negligence of any third party. In no event willOwner or Manager ever be liable to Guest for any Claim.We have made every effort to ensurethat all information printed here is accurate, but cannot be held responsible forerrors in printing or changes made in furnishings and appliances. Theappearance and amenities of the Property may have changed from the photographsas we consistently update the Property. Until confirmed, prices are subject tochange and special rates may differ. Any exception to the above mentionedpolicies must be approved in writing and in advance by Croxton Properties LLC.We appreciate you choosing CroxtonProperties LLC for your next beach vacation!
