GUEST ACCOMMODATION AGREEMENT
Guest Accommodation Agreement
This Agreement is noted as “Language Re: Lodging” in our Venue Agreements, so it is understood and
that this has been read and agreed upon when signing Venue Agreement.
Please be aware that Elker Inn & Suites LLC/JARG Holdings LLC has taken reasonable steps and
precautions to assure your safety while staying with us. In using our property, however, you do so at your
own risk. Please review and sign this Release & Waiver of Liability, thereby indicating that you agree to
release and hold harmless Elker Inn & Suites LLC/JARG Holdings LLC, its owners, agents, and other
guests from any liability. This Release and Waiver of Liability shall not apply to any claims arising from the
negligence of Elker Inn & Suites LLC/JARG Holdings, its owners or agents.
Payment Agreement
I, the undersigned (hereinafter the Guest), agree to make payment via Credit/Debit card. Cash, cashier’s
check, Traveler’s check are unacceptable forms of payment. I understand and accept that any damage
to the room or property of Elker Inn & Suites LLC/JARG Holdings LLC will be assessed to the credit/debit
card accordingly. Any stolen or missing items associated to the room or property of Elker Inn & Suites
LLC/JARG Holding LLC will be assessed to the credit/debit card accordingly.
Release & Waiver of Liability
I, the undersigned (hereinafter the Guest), hereby irrevocably & unconditionally waive and release & hold
harmless from liability Elker Inn & Suites LLC/JARG Holdings LLC (hereinafter known as Elker Inn &
Suites LLC) its owners, agents, and other guests (all four hereinafter known as Releasees) from any & all
liabilities, claims, actions, damages, costs, or expenses of any nature whatsoever whether in law or
equity, known or unknown, occurring during, caused by, relating to, or arising in any way from
participation at Elker Inn & Suites LLC.
Guest also understands that attending our facility may involve voluntary participation in physical activities
both indoors and outdoors, and certain exposure to walks, steps, paths, and roads that are uneven. With
these, and all related activities, there is a certain element of risk. By accepting this waiver, Guest hereby
acknowledges that participation and use of facilities and grounds are at Guest’s own risk, and that Guest
assumes all responsibilities for any and all aspects of participation by both Guest and any children who
might accompany Guest. This waiver applies to any and all activities, named and unnamed herein, which
are voluntarily participated in by guests and family members & visitors of guests at Elker Inn & Suites
LLC.
Guest also understands and agrees that this Release & Waiver of Liability irrevocably and
unconditionally releases and holds Elker Inn & Suites LLC/JARG Holdings LLC harmless from any
financial or other liability for any injury, bodily harm, sickness, illness, or loss of life that I as a Guest or my
family member or friend may suffer and from any economic harm or loss of property occurring during,
caused by, relating to, or arising in any way out of staying at Elker Inn & Suites LLC.
I HEREBY EXPRESSLY WAIVE AND RELEASE ANY AND ALL CLAIMS, NOW KNOWN OR
HEREAFTER KNOWN, AGAINST THE VENUE, AND ITS OFFICERS, DIRECTORS, EMPLOYEES,
AGENTS, AFFILIATES, MEMBERS, SUCCESSORS, AND ASSIGNS (COLLECTIVELY,
“RELEASEES”), ON ACCOUNT OF INJURY, DEATH, OR PROPERTY DAMAGE ARISING OUT OF
OR ATTRIBUTABLE TO MY USE OF THE VENUE, WHETHER ARISING OUT OF THE NEGLIGENCE

OF THE VENUE OR ANY RELEASEES OR OTHERWISE. I COVENANT NOT TO MAKE OR BRING
ANY SUCH CLAIM AGAINST THE VENUE OR ANY OTHER RELEASEE, AND FOREVER RELEASE
AND DISCHARGE THE COMPANY AND ALL OTHER RELEASEES FROM LIABILITY UNDER SUCH
CLAIMS.
INDEMNIFICATION. WE SHALL DEFEND, INDEMNIFY, AND HOLD HARMLESS THE VENUE AND
ALL OTHER RELEASEES AGAINST ANY AND ALL LOSSES, DAMAGES, LIABILITIES,
DEFICIENCIES, CLAIMS, ACTIONS, JUDGMENTS, SETTLEMENTS, INTEREST, AWARDS,
PENALTIES, FINES, COSTS, OR EXPENSES OF WHATEVER KIND, INCLUDING REASONABLE
ATTORNEY FEES, FEES AND THE COSTS OF ENFORCING ANY RIGHT TO INDEMNIFICATION
UNDER THIS AGREEMENT, AND THE COST OF PURSUING ANY INSURANCE PROVIDERS,
INCURRED BY/AWARDED AGAINST INDEMNIFIED PARTY IN A FINAL NON-APPEALABLE
JUDGMENT, ARISING OUT OR RESULTING FROM ANY CLAIM OF A THIRD PARTY RELATED TO
OR ARISING OUT OF RENTERS’ USE OF THE VENUE FOR THE WEDDING.
Amendments; Waivers. This Agreement may be amended, modified, superseded, or cancelled, and the
terms or covenants waived, only by written instrument executed by all the parties hereto. The failure to
require performance of any provision hereof shall in no manner affect the right at a later time to enforce
the same. No waiver of any term, whether by conduct or otherwise, shall be deemed to be a further or
continuing waiver of any such breach or a waiver of the breach of any other term contained in this
Agreement.
Choice of Law and Venue. The validity, interpretation, and performance of this agreement shall be
controlled by and construed under the laws of the State of Pennsylvania. Both parties agree that any
objections to Venue shall be waived, and that Venue shall exclusively be in the State of Pennsylvania.
Attorneys’ Fees. If an attorney shall be retained to interpret or enforce the provisions of this Agreement,
the prevailing party shall be entitled to reasonable attorneys’ fees, including any such fees set by the trial
or appellate court upon trial or appeal. Furthermore, the prevailing party shall also be entitled to
attorneys’ fees incurred in determining the amount of attorneys’ fees the prevailing party is entitled to.
I, the undersigned, having read this Release & Waiver of Liability and understand all of its terms; I have
executed it voluntarily, with full knowledge of its significance, and intend to be legally bound by it. I
understand that each child here with me who is under 18 years of age is my responsibility while here at
Elker Inn & Suites LLC. My signature includes them in coverage of this release form.
