I declare that I have read and understood the hosting contract and rules that appear in this registration form, signing in conformity and acceptance of the rules contained therein.
HOSTING CONTRACT ENTERED INTO BY ANDRES MALDONADO, HEREINAFTER REFERRED TO INDISTINCTLY AS THE HOST AND/OR OFF THE GRID GLAMPLING, ON THE ONE HAND, AND THE PARTICIPANT, HEREINAFTER REFERRED TO AS THE GUEST, ON THE OTHER HAND; LEGAL ACT SUBJECT TO THE FOLLOWING DECLARATIONS AND CLAUSES:
DECLARATIONS:
FIRST: DECLARES the HOST that the area where the housing units are located is a protected natural area located in San Isidro in Santiago N.L., of private property where two units called DOMOS are built, which have the following services and equipment:
1) Dome 1 and 2: Equipped kitchen (stove, refrigerator, oven, coffee maker, dishes, cutlery, kitchen utensils, glasses, wine glasses, cups, table singles, table with two chairs, service cart, fireplace, heater, dehumidifier, sofa bed, coffee table, rugs, bed, sheets, comforter, cushions, lamps, full bathroom, towels, mat, fire pit, outdoor chairs.
SECOND: THE GUEST declares that he/she knows the location of the DOMOS, and that it is his/her will to request the DOMO identified as TBD , to use temporarily for tourism and rest purposes, declaring that he/she has carefully read the regulations that are an integral part of this contract, and that he/she assumes to respect and comply with all its contents and scope.
CLAUSES:
FIRST: OFF THE GRID GLAMPING grants the temporary use of the DOMO number TBD to the guest, for the term of TBD days, starting on TBD at 3:00 a.m., and ending on TBD at 11:00 a.m., who declares to receive it in full conformity, together with the equipment described in the final part of this contract and that it complies with the specifications granted. The guest is responsible for bringing his/her own food.
SECOND: OFF THE GRID GLAMPING will provide the water and gas supply service, and the guest must comply with the uses indicated in the regulations that form part of this contract.
THIRD: The GUEST agrees to pay in favor of OFF THE GRID GLAMPING the amount of $ 4,641.00 for the total lodging indicated in the first clause, same amount that must be paid since the subscription of this lodging contract.
FOURTH: The HOSPITALITY STAYER agrees to respect and comply at all times with the rules and regulations that form an integral part of this contract.
FIFTH: The GUEST agrees to vacate the DOMO on time, at the time indicated in the first clause. In case of vacating the DOMO after said time, he/she is obliged to pay in favor of the hotelkeeper, the amount of $250.00 (Two hundred and fifty pesos 00/100 M.N.) for each hour of delay in the delivery of the DOMO as a conventional penalty.
SIXTH: If the GUEST does not vacate the DOMO on the date indicated and extends his stay in the unit, he shall immediately notify the person in charge of OFF THE GRID GLAMPING, and shall pay for each day that he extends his stay the amount of $4,641.00, unless otherwise agreed.
SEVENTH: THE GUEST undertakes:
a) To pay punctually the established rate according to the days of use of the DOMO, which is the amount of $ 4,641.00 per day.
b) To occupy the DOMO only for the number of people authorized, i.e. 4 people.
c) To immediately notify the janitor of any damage to the DOMO, whether attributable to the caretaker or to defects in the DOMO itself, or caused by nature.
d) To bring their own food.
e) To keep and maintain the DOMO in perfect condition.
f) To deliver to the hotelkeeper all the equipment that the DOMO has, such as: towels, lamps, coffee pot, pans, knives and those indicated in this contract.
g) To return the DOMO to the hotelkeeper in the same conditions in which it was received, at the times specified in the first clause.
h) To respect and comply with the regulations that are an integral part of this contract.
EIGHTH: If the HOST decides to leave and vacate the DOMO before the date agreed at the beginning, there will be no refund of the amounts paid, whatever the cause of the early abandonment.
NINTH: THE OWNER is responsible for any damage caused to the DOMO and its equipment, and shall pay for them according to the tabulator specified in ANNEX -1 of this contract (list and cost of each item).
TENTH: THE OWNER, for no reason whatsoever, may light bonfires, roast meats, or others that imply the use of fire. Neither inside the DOMO, nor in the areas surrounding the units. Prohibition contained in the regulations and by decree of the State Government. The HUESPED will be responsible with all its assets for the damages caused in violation of this clause, in addition to the criminal and administrative responsibilities that may arise.
FOURTEENTH: OFF THE GRID GLAMPING may at any time retain in pledge the guest's belongings, in case of breach of this contract or violations of the regulations, in accordance with the provisions of the Civil Code in the State (leave it as established in the Civil Code).
TWELFTH: THE GUEST, in addition to observing and complying with the obligations assumed in this contract, shall act with all diligence in the use of the DOMO and its surrounding areas, as a good citizen, and in accordance with good customs.
THIRTEENTH: The guest releases OFF THE GRID GLAMPING from all civil and/or criminal liability for any accident that may occur during the contracted stay, whether injuries, animal bites or insect or arachnid bites, illnesses, even death from any cause, whether natural or due to the accident itself, or due to consumption of prohibited substances.
FOURTEENTH: The guest may not carry weapons or prohibited substances inside the DOMOS, such as narcotics or synthetic drugs. Once the lodging contract begins, OFF THE GRID GLAMPING, will not have access to the interior of the DOMO, so the GUEST is responsible for any entry of prohibited substances, so that from this moment releases from any responsibility to him, and is obliged to get out in peace and safe to the hotelier.
FIFTEENTH: The parties submit to the jurisdiction and competence of the Courts of the City of Monterrey, N.L., for the interpretation and execution of this contract, waiving at all times any other jurisdiction that, due to their present or future domicile, may correspond to them.
They hereby sign this contract on the days of October 4, 2022.
GENERAL CONSIDERATIONS
OFF THE GRID is a project of temporary lodging units in a private and protected area located in San Isidro, Santiago, Nuevo Leon.
The lodging units are called DOMOS. OFF THE GRID currently has 2 DOMOS within the same private area.
The DOMOS units are provided with natural gas, water and electricity.
The DOMOS units are surrounded by nature and forest, which is why the presence of animals such as snakes, bears among others including dangerous flora and fauna is likely.
BASIC RULES:
1.- The guest must check in with the host, and must sign the lodging contract, as well as these rules and regulations.
OFF THE GRID, will deliver the DOMO unit with the equipment established in the contract, and the guest is responsible for any damage or loss of objects inside the unit.
3.- THE GUEST shall be responsible for his own food and shall only use the gas stove for this purpose, and it is strictly forbidden to start fires or bonfires of any kind. Neither to cook, nor to make roasted meats or bonfires of any kind. Being responsible with all his patrimony of the violation to this precept, and to the penal, civil and administrative sanctions imposed by the Government of the State.
4.- THE HOST may not exceed the number of persons established in the contract. The violation of this precept shall entitle OFF THE GRID to apply a fine to be paid by the guest in the amount of $ 1,500.00.
5.- THE GUEST may use radios or musical reproduction instruments during his/her stay, as long as they do not exceed 50 decibels. And after 11:00 pm must refrain from using them outside the unit, under penalty of paying a fine of $ 1,000.00 pesos that OFF THE GRID will charge at the exit of the unit.
6.- THE GUEST releases OFF THE GRID from any responsibility for accidents that guests may suffer, either by falls, bites or stings of animals or arachnids, being responsible for their own care and attention.
7.- If the GUEST has to anticipate his/her departure from the DOMO unit before the contracted date, he/she shall not be entitled to any economic refund or compensation.
OFF THE GRID, may retain the guest's belongings, in case of non-compliance in the payment of lodging or fines, or damages caused to the DOMO.
