Please read these terms and conditions carefully before your stay. This is a binding legal agreement. By accessing and continuing to stay at the property, you agree to each and every one of these terms and conditions. 
Limitation of Liability
To the maximum extent permitted by law, The Vaquero Motel, and other members of our group of and affiliated companies and third parties connected to us hereby expressly exclude any liability for any direct, indirect or consequential loss or damage incurred by any guest in connection with our property, our site or in connection with the use, inability to use, or results of the use of our site, any websites linked to them and any materials posted on them, including, without limitation any liability for loss of income or revenue; loss of business; loss of profits or contracts; loss of anticipated savings; loss of data; loss of goodwill; wasted management or office time; and for any other loss or damage of any kind, however arising and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable, provided that this condition shall not prevent claims for loss of or damage to your tangible property or any other claims for direct financial loss that are not excluded by any of the categories set out above.  In the event The Vaquero Motel is held liable for any damages related to the property or the site, to the fullest extent permitted by law, your sole and exclusive remedy will be limited to reimbursement of the charges for services or products paid by you.  To the fullest extent permitted by law, you hereby waive any and all rights to bring any claim or action related to the property or this site beyond one (1) year after the first occurrence of the kind of act, event, condition or omission upon which such claim or action is based.  This does not affect our liability for death or personal injury arising from our negligence, nor our liability for fraudulent misrepresentation or misrepresentation as to a fundamental matter, nor any other liability that cannot be excluded or limited under applicable law. You shall defend us against any demands, claims or actions brought against us or arising as a result of any breach or violation of these Terms and Conditions by you (“Claim”) and you shall indemnify and hold us harmless from and against any and all losses, damages, costs and expenses (including attorneys' fees) resulting from any such claim. We have the right, at our expense, to assume exclusive defense against any claim and all negotiations for settlement and you agree to cooperate with us in the defense of any such claim, at our request.
Confidentiality
With respect to all communications you make to us regarding The Vaquero Motel Information including but not limited to feedback, questions, comments, suggestions and the like: (a) you shall have no right of confidentiality in your communications and we shall have no obligation to protect your communications from disclosure; (b) we shall be free to reproduce, use, disclose and distribute your communications to others without limitation; and (c) we shall be free to use any ideas, concepts, know-how, content or techniques contained in your communications for any purpose whatsoever, including but not limited to the development, production and marketing of products and services that incorporate such information.
Inaccuracies and Errors
The Vaquero Motel Information may contain technical inaccuracies and typographical errors, including but not limited to inaccuracies relating to pricing or availability applicable to your transaction. The Vaquero Motel does not assume responsibility or liability for any such inaccuracies, errors or omissions, and shall have no obligation to honor reservations or information affected by such inaccuracies. The Vaquero Motel reserves the right to make changes, corrections, cancellations and/or improvements to The Vaquero Motel Information, and to the products and programs described in such information, at any time without notice, including after confirmation of a transaction.
Mis-Communications/ Lost Transactions
The Vaquero Motel and any other providers of products or services related to the site are not responsible for communication malfunctions, failures, or difficulties, or lost, stolen, or misdirected, transmissions, messages or entries, or the security of any such communications. Further, The Vaquero Motel and any other providers of products or services related to the site are not responsible for incorrect or inaccurate entry information, whether caused by user(s) or by any of the equipment or programming associated with the site, or by any technical or human error that may occur in the processing of any information related to the site. The Vaquero Motel and any other providers of products or services related to the site may cancel or modify reservations where it appears that a user has engaged in fraudulent or inappropriate activity or under other circumstances where it appears that the reservations contain or resulted from a mistake or error. You agree that neither The Vaquero Motel nor any other providers of products or services related to the site are responsible for any damages that may arise as a result of any travel or hotel arrangements or other orders you request or make on the site which are not processed or accepted for any reason.
Travel Agents
Some areas of the site are restricted to travel agents or other authorized representatives. The Vaquero Motel Information contained in such restricted areas is confidential to The Vaquero Motel, and is provided for business use only, which includes reviewing commission status and statements.  We reserve the right to prohibit access to, or use of, these restricted areas where we determine that such use or access interferes with our sites’ operations or that such use or access results in commercial benefits or other entities to our detriment. If you are a travel agent or authorized representative of a travel agent using our site, the following apply.  No Arrangements for Prohibited Persons: The Vaquero Motel is a United States company and is prohibited from providing services to certain “prohibited persons” who are government officials or residents of certain embargoed countries or territories, or terrorists or drug traffickers whose names are published on lists maintained by the United States Department of Treasury. You agree to use all reasonable efforts not to arrange for any of these prohibited persons to stay at, use or tour The Vaquero Motel.
Availability of Products and Services
Our site contains information on The Vaquero Motel products and services, not all of which will always be available.
Third-Party 
Any use of the maps functionality on this site shall be governed by the End User Terms of Use for the applicable maps application. The Vaquero Motel shall have no liability for your use of such third-party maps application for any results, including driving directions, generated by such third-party maps application. If you choose to leave our site via links to other third-party websites, including those of advertisers, our Terms and Conditions and our Privacy Statement will no longer apply. We are not responsible for the terms and conditions or terms of use or privacy policies of those third-party websites, cookies, pixel tags and other similar technologies that they use. In addition, because we have no control over such third-party sites and resources, you acknowledge and agree that The Vaquero Motel is not responsible for the availability of such third-party sites or resources, and that The Vaquero Motel does not endorse or is responsible or liable for any content, advertising, products, or other materials on or available from such third-party sites or resources. The content and information displayed on the site are of The Vaquero Motel property. The downloading, reproduction, or re-transmission of The Vaquero Motel, other than for non-commercial individual use, is strictly prohibited, except to the extent permitted with prior written consent by The Vaquero Motel or by travel agents for business-only purposes in accordance with the Travel Agent section below.  
Use of Site 
The services of the site is available only to individuals who can form legally binding contracts under applicable law, and thus, are not available to minors. By using the site, you represent that you are of sufficient legal age to use the site and to create binding legal obligations for any liability you may incur as a result of the use of the site. You also warrant that you are legally authorized to make the travel reservations and purchases for either yourself or for another person for whom you are authorized to act.The site is to be used by you for your personal use only. You agree that you will not use the site for chain letters, junk mail, "spamming", solicitations (commercial or non-commercial) or bulk communications of any kind including but not limited to distribution lists to any person who has not given specific permission to be included in such a list. In addition, you agree not to create a hypertext link from any website controlled by you or otherwise, to the site without the express written permission of The Vaquero Motel. You agree not to pretend to be any other person or a representative of any entity, whether actual or fictitious, including an employee or agent of The Vaquero Motel or any third party that provides services related to the site. The Vaquero Motel reserves the right, at it's discretion, to change and or modify portions of these Terms and Conditions at any time without notice and, unless otherwise indicated, such changes will become effective immediately upon posting; therefore, please check these Terms and Conditions periodically for changes. We will display the effective date of these Terms and Conditions at the top of this page. The content and information displayed on the site are of The Vaquero Motel property. Governing Law
These Terms and Conditions shall be governed by, construed and enforced in accordance with the laws of the State of Texas, United States, without regard to its conflicts of law rules. The exclusive jurisdiction for any dispute not covered by the terms of the Arbitration provision set forth in these Terms and Conditions may be filed only in the state or federal courts located in the State of Texas, United States. YOU HEREBY WAIVE ANY RIGHT YOU MAY NOW HAVE OR HEREAFTER POSSESS TO A TRIAL BY JURY. The foregoing shall not apply to the extent that applicable law in your country of residence requires application of another law and/or jurisdiction and this cannot be excluded by contract. 
Monitoring
You agree that you will not use any device, software or other instrumentality to interfere or attempt to interfere with the proper working of our site, and that you will not take any action that imposes an unreasonable or disproportionately large load on our infrastructure. In addition, you agree that you will not use any robot, spider, other automatic device, or manual process to monitor, scrape, or copy our site or The Vaquero Motel information contained therein, or any aspect of the site or The Vaquero Motel, without the prior express consent from an authorized The Vaquero Motel representative (such consent is deemed given for standard search engine technology employed by Internet search websites to direct Internet users to our site). Furthermore, you agree that you will not use our site for any purpose that is illegal, unlawful, or prohibited by these Terms and Conditions. You agree that you will not interrupt, disrupt, alter, destroy, impair, restrict tamper, or otherwise affect the proper operation of our site in any way, including, without limitation, through the use of any malicious or unauthorized code, virus, worm, Trojan horse, malware, or program. You agree that The Vaquero Motel has no obligation to but may monitor and review information you transmit over the site. You agree that The Vaquero Motel may censor, edit, remove or prohibit the transmission or receipt of any information that The Vaquero Motel deems inappropriate or in violation of these Terms and Conditions, and use any such information as necessary to provide the site or to protect the rights or properties of The Vaquero Motel. You agree that The Vaquero Motel may also monitor and review stored information without restriction. You hereby acknowledge and consent to such monitoring and reviewing.  You may not use our site in any threatening, libelous, slanderous, defamatory, obscene, inflammatory, pornographic, discriminatory, or otherwise offensive manner. We reserve the right in our sole discretion to revoke or deny your access to our site, including, without limitation, if you violate any of the provisions of these Terms and Conditions.  You agree that you will make only legitimate reservations in good faith for use by you and your invited guests only, and not for other purposes, including without limitation, reselling, impermissibly assigning or posting on third party websites, or making speculative, false or fraudulent reservations, or any reservation in anticipation of demand.
Personal Data
At touch points throughout your guest journey, we collect Personal Data in accordance with the law, and to serve you better. Personal Data is information that may identify you as an individual or relate to you as an identifiable individual. We collect and process the following types of Personal Data about you.

•  Gender
•  Postal address/Telephone number/Email address
•  Financial information (such as credit and debit card number or other payment data)
•  Language preference
•  Date and place of birth
•  Nationality, passport, visa, or other government-issued identification data
•  Important dates: birthdays, anniversaries, and special occasions
•  Employer details (for business-related bookings)
•  Travel itinerary, tour group, or activity data
•  Prior guest stays or interactions, goods and services purchased, special service and amenity requests

The Vaquero Motel may also collect information about your Preferences that it uses to make your current and future stays and experience more enjoyable, including information about your interests and other relevant information that the hotel team learns about you during your stay. This may also include any likes and dislikes about our services that you tell us about so that we can improve our services, and specific dietary, health restrictions or personal needs to ensure your wellbeing. The Vaquero Motel may also collect your “Personal Preferences,” that may include details of your special anniversaries (such as your birthday or wedding anniversary), what type of activities you prefer to take part in when staying and your hobbies. Personal Preferences may also include details about who you usually travel with, their relationship to you, and your marital status. If you submit any Personal Data about other people to us or our Service Providers (e.g., if you make a reservation for another individual), you represent that you have the authority to do so and you permit us to use the data in accordance with this Privacy Statement.
Digital Entry Terms of Use
1. Upon receiving a reservation confirmation, the first night's charges may be applied to your credit card on file.
2. Credit and Debit Card Processing
a. Upon check-in, your card issuing bank will place a hold on your debit or credit card for room & tax charges, any applicable resort fees, plus an amount for incidentals per day for the entire stay.
b. This hold will not be released by the issuing bank for up to five (5) business days after your departure.
c. You authorize the motel to place this hold against your credit or debit card to guarantee any and all charges and, in the event that you do not settle your account subsequent to your departure, you hereby authorize the motel to charge your credit or debit card or apply funds you have on deposit with the motel against what you owe.
3. Every effort will be made to accommodate your requests for specific room type and location, however, the motel is unable to guarantee any requests as rooms are not assigned until check in. Additional fees may apply depending on the specific requests.
4. Nightly Resort Fees may apply.
5. Additional charges per occupant, per night, above 2 occupants per room may apply.
6. Regardless of billing or master account arrangements, you are liable for any and all charges posted to your room(s). You are further liable for all damages to the room(s) caused by you or your guests/invitees during your stay.
7. If there is evidence of smoking in your room you will incur a deep cleaning fee charged to your account.
8. Should your plans require you to adjust your departure date, please check with the Front Desk on room availability, but note that your rate is subject to change. Please notify the Front Desk immediately if there are any errors to name, rate or length of stay.
9. You agree that any guests in your room are authorized by you to charge to the room from anywhere in the Motel or on motel premises, unless you advise the Front Desk otherwise.
10. By providing your e-mail address, you consent to receiving promotional e-mails from The Vaquero Motel and its related and/or affiliated properties.
11. To the maximum extent permitted by law, we, other members of our group of companies and third parties connected to us hereby expressly exclude any liability for any direct, indirect or consequential loss or damage incurred by any user in connection with his/her use, or inability to use, a digital key, including, without limitation any liability for loss of income or revenue; loss of business; loss of profits or contracts; loss of anticipated savings; loss of data; loss of goodwill; and for any other loss or damage of any kind, however arising and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable.
12. In the event required by local law, we may ask you to manually sign a guest registration card, provide identification and/or provide information on any vehicles you may have on the motel premises.
13. For your Security
a. Use Safety Deposit Box for valuables if available.
b. Secure deadbolt and door guard.
c. Use viewport to ID all visitors.
d. Safeguard and keep your key, a small fee could result from lost or non-returned keys.
e. Ensure that all windows and doors are locked.
Motel Accommodations 
Reservations
We reserve the right to cancel or modify reservations where it appears that a customer has engaged in fraudulent or inappropriate activity or under other circumstances where it appears that the reservations contain or resulted from a mistake or error, or from an attempt to circumvent The Vaquero Motel or motel policies, terms or conditions. You understand that overuse or abuse of the reservation facilities of this site may result in your being denied access to such facilities. Reservations made by one or more individuals or by an agency on the site, on behalf of one or more proposed guests, and involving more than five (5) rooms at the same motel for the same period of stay, must be made directly through the motel. If more than five (5) rooms at the same motel for the same period of stay are booked through any other method, we reserve the right to cancel or impose additional requirements on such reservations. Some rates have special eligibility requirements such as Government Rates, AAA or AARP membership. It is your responsibility to verify that you qualify for the rate that you have booked. The Vaquero Motel is not obligated to honor rates if you do not qualify.
Text Messaging
By using the website and booking a reservation, you agree to the terms as well as the following text messaging terms, and agree to receive text messages with updates and information about your reservations, communication with the motel team, as well as texts with offers and promotions, from and on behalf of The Vaquero Motel, including text messages sent using an autodialer, at the telephone number(s) you provided. Consent to receive text messages is not a requirement or a condition of any purchase. You understand and agree that by checking the box to sign up to receive text messages, you are providing your digital signature. By opting in to receive text messages, you represent that you are 18 years of age or older. The Vaquero Motel reserves the right to change, update, or correct any of the Text Terms at any time by posting amended terms to this website. Your continued consent to receive messages will indicate your acceptance of such changes. Message and data rates may apply to each text message sent or received in connection with text messages, in addition to any applicable roaming charges. Not all carriers covered and supported carriers may change from time to time. The Vaquero Motel does not guarantee availability or performance of the text message service and you understand that transmission delays and message failures may occur. You represent that you are the account holder for the telephone number(s) that you provide. You are responsible for notifying The Vaquero Motel immediately if you change your mobile telephone number. You agree to indemnify The Vaquero Motel for any claims, expenses, and/or damages related to or caused in whole or in part by your failure to notify the motel if you change your telephone number, including, but not limited to, all claims, expenses, and damages related to or arising under the Telephone Consumer Protection Act. The Vaquero Motel may suspend or terminate your receipt of The Vaquero Motel text messages at any time. The Vaquero Motel reserves the right to modify or discontinue, temporarily or permanently, all or any part of the motels text message services, with or without notice.
Force Majeure
The Vaquero Motel is not responsible or liable to you, or any person claiming through you, for failure to supply or fulfill a reservation in the event the Motel or its operations are affected by any acts of god, any action, regulation, order or request by any governmental or quasi-governmental entity, equipment failure, actual or threatened terrorist acts, weather, natural phenomenon, war (declared or undeclared), fire, embargo, labor dispute or strike, labor or material shortage, transportation interruption of any kind, civil disturbance, insurrection, riot, pandemic/epidemic (or similar public-health threat or emergency), or any laws, rules, regulations or orders or other action adopted or taken by any national, federal, state, provincial, or local government authority, or any other cause, whether or not specifically mentioned above.
Law Enforcement/Governmental Requests
You agree that nothing contained in these Terms is in derogation of The Vaquero Motel's right to comply with law enforcement or governmental requests or requirements relating to your stay or information provided to or gathered by The Vaquero Motel with respect to such participation.
