1. scopeof application/terms of business of the customer1.1 TheseTerms and Conditions apply to all contracts for the rental of guest rooms ofthe Hostel for accommodation purposes as well as to all other goods andservices provided to the Guests by Guest House Bruc Barcelona .1.2 Generalterms and conditions of the guests do not apply, unless this has been confirmedin writing by Hostel . 
2.conclusion of contract/transfer to third parties2.1 Thecontractual partners are the guest and the Guest House Bruc Barcelona.2.2 TheAgreement shall only come into effect upon oral or written confirmation by theHostel to the Guest.2.3 Thesubletting or other transfer of the rented rooms to third parties requires theprior written consent of the Hostel.2.4 If athird party has concluded the contract for the Guest, the Guest shall be liableto Hostel Guest House Bruc Barcelona  asjoint and several debtor for all obligations arising from the Hostel Agreement.
 3.prices, payments, offsetting3.1 TheHostel Guest House Bruc Barcelona  isobliged to keep the rooms booked by the guest ready and to provide the agreedservices.3.2 Theguest is obligated to pay the valid or agreed prices of Guest House Bruc Barcelonafor the room rental and the other services used by him/her. This also appliesto services and expenses of Hostel Guest House Bruc Barcelona to third partiesinitiated by the guest.3.3 Theagreed prices include the respective statutory value added tax, unless this isshown separately.3.4 If theperiod between the conclusion of the contract and the event exceeds 4 monthsand if the price generally charged by Hostel for such services increases, thenHostel can increase the contractually agreed price accordingly.3.5 Changesin bookings (changes in the number of beds/rooms booked, the length of stay ofguests or other essential services provided by the hostel) entitle Hostel tocharge different prices.3.6 Hostelis entitled at any time to demand either a reasonable advance payment of thetotal invoice or the provision of security. The amount of the advance paymentis 20 % of the agreed total price for individual travellers and 15 % of theagreed total price for groups of 8 or more persons. The payment dates can beagreed in writing in the contract. The transfer of the outstanding invoiceamount is to be paid in cash or by Debit/Credit card at the latest uponarrival.3.7 TheGuest may only offset or reduce claims against claims of the Hostel withundisputed and legally binding claims.3.8 Wecharge 5,00 Euro for returned direct debits, for payment by credit card (VISA,Mastercard) we charge a fee of 3 % of the total amount.
 4. roomprovision, handover and return4.1 Theguest does not acquire the right to the provision of certain beds/rooms.4.2 In the WINTER,CHECK-IN:  From 13:00 Hours Until 15:00 HoursCHECK OUT:11:00 Hours.NOTE: Incase if you would like to do the check in after 15:30 it will have extra chargefee.Between 15:30PM Until  18:00 PM the extra fee is 15,00€Between18:00 PM Until 21:00 PM the extra fee is 20,00 €Between21:00 PM Until 23:59 PM the extra fee is 30,00 € 4.3  In the SUMMER, CHECK-IN: From 15:00 Hours Until 20:00 HoursCHECK OUT:11:00 Hours.NOTE: Incase if you would like to do the check in after 20:00 it will have extra chargefee.Between20:00 PM Until 23:59 PM the extra fee is 30.00€Between00:00 PM Until 02:00 PM the extra fee is 40,00 € 
6.withdrawal of the customer (cancellation, cancellation)6.1 Unlessotherwise agreed in the contract or otherwise separately, we reserve the rightto claim the following cancellation periods: - until 28 daysbefore arrival free of charge
- until 4 days before arrival 20% of the agreed total price
- from the 3th before arrival - day arrival 100 % of the agreed total price
- in case of no-show 100 % of the agreed total price
- If discounts, specials or special offers have been booked via online bookingportals, they cannot be cancelled.6.2 Awithdrawal of the guest from a contract concluded with Guest House Bruc Barcelonarequires the written form and the written consent of Hostel Guest House Bruc Barcelona.If this is not done, the agreed price from the contract is to be paid even ifthe customer does not make use of contractual services.6.3Services provided by third parties or special services that become useless as aresult of the cancellation must be paid for at 100% in any case.6.4 Thepayment obligation of the guest according to paragraph 6. does not arise if thewithdrawal of the guest is due to a reason for which Hostel is responsible. 
7.withdrawal of the hostel7.1 If afinal confirmation of the contract on the part of the guest is not yetavailable, i.e. the reservations were only optional, Hostel Guest House Bruc Barcelonais entitled to withdraw from the contract.7.2 If areasonable advance payment or security demanded by Hostel is not providedwithin the agreed or reasonable period, Hostel is entitled to withdraw from thecontract.7.3Furthermore, Hostel is entitled to cancel the contract for good cause, forexample in the event of force majeure or other circumstances beyond the controlof Hostel which make it unreasonable to expect the Hostel to fulfil thecontract (e.g. insolvency, etc.) and if rooms are booked for purposes otherthan accommodation, with false information provided by the Guest or without theconsent of the Hostel. 
8.technical equipment and connections8.1 Insofaras Hostel procures technical or other equipment from third parties at theinstigation of the Guest, this is done in the name and on behalf of the Guest.The guest is liable for the careful treatment and proper return. He exempts theHostel from all claims of third parties arising from the provision of thisequipment.8.2 The useof the Guest's own electrical equipment using the Hostel's electricity networkrequires the written consent of the Hostel. Any malfunctions or damage to theHostel's technical equipment resulting from the use of such equipment shall beborne by the Guest, insofar as Hostel is not responsible for such malfunctionsor damage. The electricity costs arising from the use of this equipment may berecorded and charged to Hostel as a lump sum.8.3 TheGuest is only entitled to use his/her own telephone, fax and data transmissionfacilities with the Hostel's consent. Hostel may charge a connection fee forthis purpose. 
9. lossof or damage to items brought with you; liability of the hostel9.1Personal and other items brought into the house are at the guest's risk. TheHostel does not assume any obligation to guard or store them. The Hostelassumes no liability for loss, destruction or damage except in the case ofgross negligence or intent on the part of the Hostel. The customer isresponsible for insuring the objects brought along by the guest.9.2Otherwise Hostel is liable - except in cases of intent and gross negligence - onlyfor breach of material contractual obligations and limited to the respectivecoverage of the business liability insurance.9.3 Anyonewho causes damage to the building or inventory is liable for this within theframework of the legal provisions (in particular accompanying persons andorganisers). Theft and deliberate damage to property will be reportedimmediately. For groups, the reception team will inspect the rooms. Repair orreplacement due to possible damage will be invoiced. A fee of 15 euros per lostkey must be paid in cash at the latest upon departure.  
10.obligation to cooperate10.1 TheGuest is obliged to immediately notify the Hostel staff of his/her complaint.They are instructed to take remedial action, if this is possible. If the TravelParticipant culpably fails to report a defect, the claim for a reduction inprice shall not arise.10.2 Theineffectiveness of individual provisions shall not result in theineffectiveness of the entire contract. 
11.house rules11.1 Thehouse rules are part of the general terms and conditions. In the event ofbreaches of the house rules, Hostel Guest House Bruc Barcelona is entitled toterminate the accommodation contract without notice. Cancellation fees shall bedue for any rooms/beds that are not used as a result of this in accordance withthe cancellation regulations.11.2.Furthermore, the Hostel Guest House Bruc Barcelona is entitled to charge thefinancial loss to the guest/group in case of violation of the house rules withthe consequence of the loss of other guests (early departure, etc.). 
12.final provisions12.1Changes or amendments to the Agreement, the application or these Terms and Conditionsfor the hostel accommodation should be made in writing. Changes or additions bythe Guest are invalid.12.2 Theplace of performance and payment is the registered office of Hostel Guest HouseBruc Barcelona12.3 Theexclusive place of jurisdiction - for cheque and bill of exchange disputes - incommercial transactions is the registered office of Hostel Guest House Bruc Barcelona.12.4 Spanishlaw shall apply. The application of UN sales law and the conflict of laws isexcluded.12.5 Shouldindividual provisions of these General Terms and Conditions for the hostelaccommodation be or become invalid or void, the validity of the remainingprovisions shall not be affected. In all other respects the statutoryprovisions shall apply.
