Cofresi Hills Residence Terms & Conditions

The vacation rentals we represent are typically apartments owned by individuals who also use them as vacation apartments. These apartment owners have made them available to share with responsible groups that will treat the apartments and neighborhood with respect. In order to maintain the top quality of our apartments and the peace and quiet of our neighborhoods, all travelers, visitors should adhere to the following terms and conditions.  
Purview:

  1. The following General Terms and Conditions apply to vacation rentals accommodation as well as to further services and deliveries provided by Cofresi Hills Residence. 
  2. Subletting and re-letting of the rooms as well as the use for any other purpose than accommodation is forbidden or in special circumstances requires the consent of the hotel in writing.
  3. Contrary Conditions of the Guest shall only apply prior to a written agreement.

Please do not proceed with a booking if you are not comfortable with these policies.
Guest agrees to read and abide by the Terms of this agreement and ensure all other occupants abide by these terms. As consideration for the booking and use of Cofresi Hills Residence during the lease term, Guest agrees to pay for all items specified.
General Terms & Conditions apply as follows:
  1. Identification and use: 
The names and ages of all occupants must be provided. A government-issued identification and the credit card used at booking must be presented at check-in prior to check-in. All adult groups must be 21 years of age or older for rentals less than 30 days.
  1. Maximum Occupancy: 
1 Bed  - Guests shall not exceed the number of 2 adults and 2 kids until 6 years old.

Includes breakfast only for 2 persons, any extra has an extra charge of US$20 per person.

  1. Noise: 
Guests must keep the volume of voices and music to a reasonable level and bring conversations indoors after 10:00 p.m. and close windows and doors to keep any noise inside.

  1. Payment information:
    Payments can be made by: American Express, Visa, MasterCard or Discover (a valid ID and Photo will be required).  When paying via Credit Card, all credit card payments will be verified with a government-issued photo ID.

We will then meet you on the day of check-in to verify your government-issued photo id with the credit card and name on file for the reservation.

  1. Cancellation Policies:
    For guests making new reservations for any future arrival date, including reservations with pre-paid rates, we will allow the reservation to be changed or canceled at no charge up to 48 hours before your scheduled arrival date. * Please note that changes to the reservation will be subject to availability and any rate differences.
    The following policies are implemented with respect to individual rooms booked into travel agencies, websites.

    There are no refunds for early departures, delayed arrivals, construction activity, inclement weather or reduction in the number of nights reserved for any reason. Trip cancellation insurance is highly recommended. If the Property becomes unavailable or unsuitable for rent for any reason whatsoever, including but not limited to, casualty loss, construction, noise, physical deterioration, or loss of utility services, the Cofresi Hills Residence liability will be limited to the return of all funds paid on account at the time of cancellation by Cofresi Hills Residence. In the event Cofresi Hills Residence cancels the reservation; All funds received will be refunded to Guest within 15 business days of confirmation of notice of cancellation.

  2. Reservation prices do not include:
    Expenses and items not mentioned, including, but not limited to: transportation, tips for personal services, meals, insurance, telephone calls and other items of a personal nature.

  3. Termination:
    Cofresi Hills Residence owners or its employees have the right to inspect and  photograph the condition of the premises without prior notice at any time to enforce the terms of these terms and conditions. Should Guest or any occupants violate the terms of these terms and conditions, Cofresi Hills Residence may impose fines up to three (3) times the rental amount and may terminate Guest’s occupancy with no refunds of rents or security deposits, and Guest shall waive all rights to due process for failure to vacate the premises upon termination. Guests are notified that all individuals occupying the Unit will be subject to immediate eviction procedures. Cofresi Hills Residence or its employees may enter the premises and remove Guest, the members of Guest’s party, and their belongings. Noise disturbances or use of the unit for any unlawful purpose including, but not limited to the possession, serving, or consumption of alcoholic beverages by persons less than 18 years of age, use of drugs, house parties, or use of common areas in a manner contrary to the provisions of this agreement are prohibited.
IF NOISE COMPLAINTS, OVER OCCUPANCY OR CONTRACT VIOLATIONS OCCUR, OR IF LAW ENFORCEMENT IS DISPATCHED TO PROPERTY DUE TO DISTURBANCES OR ILLEGAL ACTIVITY, GUEST AND ALL OCCUPANTS ARE SUBJECT TO IMMEDIATE EVICTION WITH NO REFUNDS GIVEN.
  1. Rentals and payment terms:
If guests cancel their reservation upon arrival, a 50% penalty will be applied.

Accepted forms of payment are major credit cards, wire transfer or PayPal. Guest agrees to provide Cofresi Hills Residence with a valid credit card during the entirety of the reservation. Should Cofresi Hills Residence not receive final payment in full by the due date, Cofresi Hills Residence may in its sole discretion deem the reservation null and void or charge the final payment to Guests credit card. Rates are subject to change and no refunds are given in the event advertised rental rates are reduced. If a discrepancy arises between information or rates quoted verbally, on the website, email or otherwise, the rate on the reservation will prevail. In the event incorrect information or rates are quoted due to a typographical or any other error, Cofresi Hills Residence shall have the right to refuse, cancel or limit any reservations listed incorrectly, whether or not a reservation confirmation has been sent.

  1. Security Deposit:
    If, during the dates of occupancy, Guest causes any damage to real or personal property of the unit or premises as a result of inadvertent acts, guest must notify Cofresi Hills Residence of any damages prior to check out. Any repairs or replacement costs will be deducted from the Security Deposit or be charged to Guest. Cofresi Hills Residence may impose a refundable Security Deposit at any time prior to or during the dates of stay. If a Security Deposit is imposed, it must be paid to Cofresi Hills Residence upon demand or Guest will not be allowed to enter or remain in the Unit. The Security Deposit may also be withheld or surrendered should Guest violate any terms of the agreement, including noise disturbances. The Security Deposit less any deductions will be returned within 15 days of the departure date. If damaged real or personal property is deemed by Cofresi Hills Residence to be intentional or because of negligence, reimbursement will be deducted from the Security Deposit or charged to Guest.

  2. CHECK IN:
    Check-in time is 3:00 PM. Early check-in is allowed only with prior approval. Keys or entry code will be provided once all fees and charges have been collected.

  3.  CHECK OUT:
    Check out time is 11:00 AM. You will be charged an additional fee of 30% of your room rate if you wish to extend the check-out time. Until 6:00 p.m., extensions are 50% off. If you check out after 6:00 p.m., you will be charged an additional fee equal to the full room rate.

  4. Guest’s notification responsibilities:
    Guest shall call or email Cofresi Hills Residence upon arrival to the property to confirm arrival. Upon arrival, Guest agrees to examine the Unit, all furniture, furnishings, appliances, fixtures and landscaping, if any, and shall immediately report to Cofresi Hills Residence if any are not in operating condition or in disrepair. Guest also agrees to immediately notify Cofresi Hills Residence of any occurrences that may cause damage to Property or adjacent units and to take reasonable measures to mitigate damage and be responsible for damages for failure to do so. Guest acknowledges that unless Cofresi Hills Residence is notified on the day of check-in of any damage or cleaning concerns, Guest will be liable. Any and all damages, breakage, lost or missing items on the Property during the occupancy will be Guest’s responsibility and must be reported to Cofresi Hills Residence and paid prior to departure.

  5. Smoking:
    Smoking is allowed outside of any house. If smoking does occur on the premises, Guest is financially responsible for smoke remediation and all damage caused by the smoking including, but not limited to, stains, burns and removal and/or replacement of damaged property.

  6. Pets:
    Pets are NOT allowed.

  7. Fire extinguisher:
    The property is equipped with a minimum of one (1) fire extinguisher. It is the duty of the Guest to locate fire extinguishers, notify all other occupants and guests of the location, and inform management immediately should the fire extinguisher be missing, or be less or become less than fully charged.

  8. Smoke detectors/Carbon monoxide detector:
    There are no smoke/carbon detectors on the property. In suspicious smell Cofresi Hills Residence concierge should be informed immediately to prevent fire or any other disaster.

  9. Lost Items:
    Cofresi Hills Residence shall bear no responsibility for lost, stolen or abandoned items. Every reasonable effort will be made to contact the Guest for return. Cofresi Hills Residence shall not be held liable for the condition of said items. Any items not claimed for longer than 30 days.

  10. Air Conditioning/Heating:
    All rental apartments are equipped with air conditioning. Doors and windows shall be closed when air conditioning is in operation. Due to the huge energy consumption we as guests turn the air conditioner off when not in the room.

  11. Pool (SPA, GYM in near future):
    Guest understands that the area surrounding the pools and spa are not fenced or secure and Guest will be responsible to ensure supervision of any occupants that may be endangered (see section Waiver of Liability). Guest also understands and agrees to be responsible and liable and will pay Cofresi Hills Residence upon request for any damages that occur to the pool and spa and its support equipment through misuse and/or negligence.

  12. System(s)/Furnishing/Amenity Failures:
    In the event the rental unit sustains a failure in maintenance, Cofresi Hills Residence will make every reasonable effort to repair or replace the failed system or equipment, and in such event, Guest agrees to permit Cofresi Hills Residence or its service provider to have reasonable access to the property to inspect and make such repairs.

  13. Other Occurrences:
    Cofresi Hills Residence does not accept liability for any loss or damage caused by but not limited to the following: weather conditions, natural disasters, pests, construction disturbances, acts of God, or other reasons beyond its control. shall be no refunds of rents because of shortened stays, ruined expectations, or departures due to work and family emergencies, unavailability of any or all parts of the Unit, or any other reasons. It is highly recommended that Guest consider the purchase of travel insurance.

  14. Additional Terms & Conditions
    The one confirming these terms and conditions, for himself/herself, his/her heirs, assignors, executors, and administrators, fully releases and discharges Cofresi Hills Residence and Owner from any and all claims, demands and causes of action by reason of any injury or whatever nature which may have occurred to the undersigned, or any of his/her occupants or guests as a result of, or in connection with the occupancy of the premises and agrees to hold Cofresi Hills Residence and Owner free and harmless of any claim or suit arising therefrom. In any action concerning the rights, duties or liabilities of the parties to this agreement, their principals, agents, successors or assignees the prevailing party shall be entitled to recover reasonable attorney fees and costs.

  15. Written Exceptions:
    Any exceptions to the above-mentioned policies must be approved in writing by Cofresi Hills Residence in advance.

  16. Disputes:
    Any disputes under these Terms & Conditions shall be governed by and interpreted in accordance with the laws of the Dominican Republic. Any action relating to these Terms & Conditions shall be filed only in the Dominican Republic. Both parties’ consent to the exclusive venue and jurisdiction of such a court. Guest agrees to pay all reasonable costs, attorney’s fees and expenses that shall be made or incurred by Cofresi Hills Residence enforcing this agreement.

  17. Acceptance of Terms and Conditions:
    Facsimile signatures are deemed original signatures and approving online terms and conditions constitute approval of these terms and conditions.
