ELEMENTAL SURF LODGE TERMS & CONDITIONS

This document sets out the terms upon which Elemental Surf Lodge (ESL) will provide serviced accommodation to you as set out on the Booking Form.  This contract is between the person who is the main signatory of the Booking form and ESL.  It is deemed that by the signing of the Booking Form, you accept full responsibility to ensure that you and your entire party adhere to the terms and conditions set out below.

BOOKING CONFIRMATION

To reserve ‘Accommodation’ with ESL, we require a deposit which shall be determined by your method of booking and with whom your reservation was made.  The balance due for the accommodation must be paid no later than 14 days prior to your arrival date unless otherwise agreed in writing by ESL.  For bookings made within 14 days of arrival date, full payment, by cleared funds is required at the time of booking. If booking by telephone, ESL have confirmed acceptance of your booking; if via email, your booking will only be confirmed once you have received confirmation by email from ESL. Deposits are non refundable if bookings are cancelled within 14days of the arrival date.  Should the balance of the Accommodation amount not be received within the time stated, ESL reserve the right to cancel the booking made and any deposit paid will be forfeit.

BOOKING EXTENSION Whilst

Every effort will be made to accommodate an extension of stay, extension requests are subject to availability and rate change.  Where requests for extension of stay has been made, payment for the additional period of stay is due in full, at point ofrequest being agreed. 

ACCOMODATION

Although Accommodation is confirmed in advance, the exact rooms cannot be guaranteed prior to your arrival. You will only have the right to occupy the accommodation for the time specified on the booking form.  You are granted the right to occupy the accommodation and this contract gives you no other rights either express or implied to the accommodation.  You agree that the purpose of the letting is for holiday purposes and that you are not entitled to any rights under any statutory provision including, without prejudice, the Rent Act 1977, any assured tenancy or assured shorthold tenancy under the Housing Act 1988,including in each case any amendment or re-enactment of any such statute for the time being in force. Only the number of people mentioned on the booking form are permitted to occupy the room(s) allocated to you.  Any additional guests not declared on the booking form will be chargeable at the full occupancy rate or will be asked to vacate immediately. 

Prices and Taxes
The prices displayed on our website or quoted by our staff are in British pounds and include VAT. The prices are subject to change without notice, unless you have already made a booking and received a confirmation email from us. The prices do not include any additional fees or charges that may apply, such as city tax, tourist tax, or service charge. You are responsible for paying any such fees or charges at the hotel. 

Payment and Terms at Check-in/Check-out
You can pay for your booking online using a credit card or debit card. We may pre-authorize your card before your arrival to ensure that there are sufficient funds to cover your stay. If your card is declined, we may cancel your booking and inform you by email. You must check-in at the hotel between 4 pm and 6:30 pm on the day of your arrival. You must present a valid photo ID and the card used forepayment at check-in. If you arrive after 6:30 pm, you must contact us in advance to arrange a late check-in. We may charge you a late check-in fee of £10.You must check-out at the hotel by 10 am on the day of your departure. You must settle any outstanding balance and return your room key at check-out. If you check-out after 10 am, we may charge you a late check-out fee of £10 per hour or part thereof. 

DURATION OF STAY
No booking can be for a period more than 28 days and therefore any contract formed because of a booking will expire on the date of departure shown on the booking form or 28 days from check in whichever is the sooner. 

DUTY OF CARE/RESPONSIBILTY
It is the responsibility of the guests to ensure they are respectful to other guests within the Lodge. Guests must ensure noise levels are restricted, most particularly after10pm Sunday to Thursday and 11pm Friday and Saturdays.  Should any guest be found in breach of these conditions, one warning will be issued. Should this warning be ignored, the ESL Management reserve the right to terminate your booking with immediate effect.  Should your booking be terminated, you will forfeit any right to any refund of payments made. Guests have a responsibility and duty of care to ensure damages not deliberately inflicted on the property of its contents.  Such damages will be chargeable at the full replacement/repair cost, without exception. Smoking or vaping is prohibited on the premises and will result in immediate termination of your stay. Should your booking be terminated, you will forfeit any right to any refund of payments made. Guests to ensure that all lights and electrical appliances are switched off, all windows are closed and door are lock when you go out. ESL is not responsible for the loss or damage to any personal belongings or valuable. 

ARRIVALS AND DEPARTURES
Guests can check into the rooms from …………. On day of arrival.  Check out is on or before ……….. on day of departure. All keys to be handed in to Lodge staff or left in room on your day of departure.  If any keys are lost, you will be required to cover the cost of replacement.  You are not permitted to have duplicate keys cut without prior written permission from ESL Management.  If such permission is granted, any additional keys must be returned to ESL Management on departure.  

CANCELLATION
All cancellations must be confirmed in writing.  Notice of cancellation required is 14 days prior to arrival date for all reservations. Inside of the 14 days, no refund of payment can be made. Refunds are made back into the debit/credit card used to make the original booking.  Any other method of refund is expressly at the discretion of ESL Management.  Refunds will take between 3 and 5 working days to reach your account. 

EARLY DEPARTURES
Please note that should a guest need to check out prior to the agreed departure date, no refund will be given for the remainder of the booking. 

CHANGES OF YOUR BOOKING BY US
In the unlikely event that we have to cancel or make a change toa booking, we will use all reasonable efforts to contact you as soon as possible.  Where possible, we will offer alternative dates but should these be unacceptable to you, the booking will be treated as cancelled and we will refund any monies you have paid to us within14 days of any cancellation. 

REFUSAL OF BOOKINGS
ESL Management reserve the right to refuse and/or terminate a booking with reason or explanation. Bookings cannot be accepted from persons under 18 years of age.  If under-age is suspected, proof of age/identification will be required. Any booking received from an under-age person who is unable to provide proof of age will result in refusal or termination of booking and all monies paid to us will be forfeit. 

HEALTH & SAFETY
Any accidents or injuries should be reported to the Lodge Host as soon as possible.  Details of on-site. First Aiders are available on the Lodge notice board in the main foyer along with the Lodge Host contact details. 

COMPLAINTS
If guests experience any problems or have a complaint, please report immediately to the Lodge Host/Management at the time of the issue so that appropriate action can be taken. Any such problems/complaints notified to us after your stay will not be considered by ESL Management. 

PETS
Pets are at the discretion of ESL Management and any request for accompanying pets must be made in advance of your arrival.   

MISUSE OF ALCOHOL OR DRUGS
Anyone found using or under the influence of illegal drugs or substances classified under the Misuse of Drugs Act (1971) will be reported to the Police and asked to leave the premises immediately.  Any evidence or suspicion of drugs or drug use will also be reported to the Police.
