Whiskey Row Penthouse is located at 116 S Montezuma St. On the famous "Whiskey Row", right above all the fun! Stay in this classy penthouse and get the full good ol' 1800's Prescott experience.

The Penthouse has a spacious living room area with a pull out sofa sleeper, adjacent to a dining area with large dining table. A long open countertop separates the living area from the full size kitchen with appliances. Down a short hall is the full bathroom with jetted tub. Continue down the hallway and enter the Master Suite. A king size bed is surrounded by a small couch, nightstands and dresser. 

Enjoy everything downtown Prescott has to offer all within a few blocks; festivities at the square, boutique & antique shops, restaurants and bars. Then end your night at Jersey Lilly Saloon just down the hall and out the door you can be back to your room for the night at the penthouse enjoying your view of the historic Thumb Butte.

Cancellation Policy (Standard Rates)
*If you cancel within 24 hours of booking your reservation you will not be charged.
             *Exceptions - bookings made within 72 hours or less of the arrival date will not be refunded at any time.
*Bookings canceled more than 14 days prior to your arrival will be charged 50% of the reservation total with the exception of the above 24 hour polilcy.
*if you decide to cancel within 14 days of your arrival date you will be charged in full for your reservation.
*If you no show on day of arrival, you will be charged in full for your stay and the remainder of your reservation will be canceled.
*Any changes made to your reservation dates within 14 days of arrival will also be considered a cancellation in which you are subject to be charged in full for your reservation.

- Please keep in mind you will be staying at a property that does not have a front desk and there is no staff on-site associated with the Penthouse. However, there is staff on-call for emergency situations.
- Minimum check-in age: 21

Pet Fee/Policy:
             *NO PETS, except for service animals with approval.
            
Payment Policy (Standard Rates):
            *50% Non-refundable Deposit will be collected at the time of booking (if not collected within 24 hours the reservation is subject to cancelation)
            *Remaining 50% will automatically be collected 14 days prior to your arrival date

Parking:
           *The parking will be located in the Public Parking Garage directly behind the unit.

Smoking: All Units are Non-Smoking inside, smoking is okay outdoors with the Penthouse windows and doors shut to avoid smoke getting inside.

The registered guest ("the Guest, Guest(s) or You"), in consideration for the accommodation provided by Whiskey Row Penthouse ("the Company"), agrees to abide by and be bound by the following rules, regulations, and policies of the Company.

Information for AirBnB guest: In cases where policies or agreements in the Airbnb rental contract conflict with the statements made in the Whiskey Row Penthouse Agreement, the policies in the Airbnb agreement will supersede the statements made below (ex: clause II). The Guest agrees to settle all disputes and fees for violations to the rental contract promptly through Airbnb.

Dear Whiskey Row Penthouse Guest!

Thank you so much for making a reservation with Whiskey Row Penthouse. We can't wait to be the host for your fantastic stay! We at Whiskey Row Penthouse are ecstatic to provide a wonderful Penthouse location right in the heart of Downtown Prescott. Enclosed in this document is our rental contract for your stay.

We have split this into 3 sections for your ease of reading and reference. Enclosed you will find:

Please carefully review this contract and contact Whiskey Row Penthouse immediately with any questions or concerns concerning your reservation.

The registered guest ("the Guest, Guest(s) or You"), in consideration for the accommodation provided by Whiskey Row Penthouse ("the Company"), agrees to abide by and be bound by the following rules, regulations, and policies of the Company.

The Rules
Our Guests are guests of both Whiskey Row Penthouse and the Community they are staying in! Please respect the local community and our company by abiding by the following rules to ensure a comfortable and carefree stay with Whiskey Row Penthouse!

1. Our Guest(s) agrees to respect property's permanent residents, rules and staff*
2. Our Guest(s) agree to NO SMOKING of any substance in the unit.*
3. Our Guest(s) are responsible for actions of ALL GUESTS and Authorized Visitors occupying the property at all times.
4. Our Guest(s) agree to abide by occupancy requirements for their specific Vacation Rental and seek authorization for additional Visitors.
5. Our Guest(s) understand that onsite building staff is not affiliated with Whiskey Row Penthouse Vacation Rental and may not be willing to assist the guest. Please call Whiskey Row Penthouse at (928)237-5131 for assistance and we will do our best to help!
6. Our Guest(s) agree to leave pets (and service animals) at home, without prior written authorization from Whiskey Row Penthouse, No Cats will ever be approved.*
7. Our Guest(s) agree to only attempt to enter their Vacation Rental during the time period reserved and only after this contract has been signed.
8. Our Guest(s) agree that Whiskey Row Penthouse is authorized to pursue compensation for negligent or willful violations of the Rental Contract.*
9. Our Guest(s) understand they are responsible for all contents in the unit from check-in until check out. Guests will be responsible for any damage to any contents that occurs during their stay.
10. Our Guest(s) understand that the parking is located within the Public Parking Garage

Vacation Rental Reservation Policies
This section details rules and what to expect as part of a Whiskey Row Penthouse Reservation.

VACATION RENTAL - Whiskey Row Penthouse groups vacation homes by comparable room type. Furnishings and Floor plans may differ from pictures on advertisements however Whiskey Row Penthouse will provide a vacation rental in the purchased property with comparable floor plan, square footage and features. Specific views and unit numbers are not guaranteed unless specified in advertisement.

WHAT WE SUPPLY - The property is, unless otherwise noted on our website, equipped and set up as a fully furnished property that will include bedspreads, linens, blankets, pillows, towels, a standard equipped kitchen, TV(s), furnishings. We may not have all the items you may be accustomed to having in your home. If there is a special type of item you are accustomed to using please provide for those items by bringing them with you. Occupancy is based on sleeping capacity; each property may not have ample dining/living room seating to match bed capacity. You should bring personal items such as bath soap, shampoo, and toiletries. We are not a hotel, and are unable to supply additional items like a hotel may be able to.

PARTY/NOISE COMPLAINTS - Please respect the people that call this building home. Parties and noise complaints are taken VERY seriously. If a noise complaint occurs, guest will be notified via email or phone. Whiskey Row Penthouse may send a staff member to unit to verify complaint, warn guests of complaint and make a report on activities and number of occupants in unit. Guests in violation of occupancy limit or party rules may be removed from unit. If a second noise complaint is received after the initial warning, guest will/may be immediately removed from the property. Guests evicted from property will have their reservation considered as cancelled by the guest and additional penalties may apply* If the police are called to a property for any reason relating to any disturbance, occupancy issues, noise, or lewd behavior, the Guest will be charged a fine of $2,000 in addition to the normal costs of rental and any damage to the property.*

MAINTENANCE - Please report any maintenance issues to Whiskey Row Penthouse at (928)237-5131 as soon as they are identified.If a maintenance issue occurs that cannot be fixed in a reasonable amount of time, and significantly affects the Guests stay, TheCompany reserves the right to refund at its discretion or relocate Guests to another property. Guest will be responsible for all willful ornegligent damages to vacation rental furnishings, features and property. Housekeeping issues are to be addressed immediately uponarrival, but in no way void this contract. Whiskey Row Penthouse must be contacted immediately and the situation will be assessed atthat time.

PEACE OF MIND DAMAGE WAIVER - Purchase of the Non-refundable accidental damage waiver on a Whiskey Row PenthouseReservation provides up to $400 of accidental damage coverage to unit features, furniture, unit amenities and unit provisions.Accidental Damage waiver does not limit guest liability to the amount of coverage and guest is liable for full replacement costs due todamage or loss that occurs to the premises and it's contents during their reservation dates.

The credit card provided for the Guest's reservation will be charged for all damage or loss in excess of $400 waiver or for damage andpenalties not covered by the damage waiver, including but not limited to, for any act of intentional or negligent destruction, pet damage,re-keying, damage to property outside of unit or penalties resulting from noise complaints, parties in unit, excessive dirtiness uponcheckout, unauthorized pets, smoking or occupancy violations.

The damage waiver does not cover damage or loss that is not disclosed. To avoid erroneous blame or if an accident occurs, pleasereport the details and leave the rest to Whiskey Row Penthouse. Guests must immediately report an incident causing damage or loss tothe unit by contacting Whiskey Row Penthouse via phone or email for the incident to be covered.

INTERNET/CABLE - The Company provides complimentary wireless internet and cable TV with all properties as a convenience forThe Guest. If The Guest has any problems accessing the internet, please notify Whiskey Row Penthouse immediately. Please notethat internet connectivity issues are often outside of The Company's control. While we will do our best to work with the Internet ServiceProviders to resolve connectivity issues as quickly as possible, we are at the mercy of the service providers to resolve issues. As this isa complimentary service, no refunds will be assessed for internet connectivity issues.

WEATHER - The Company does not provide refunds due to issues beyond The Company's control such as weather. Please notethat in some cities, not all properties have air conditioning. Please be sure to inquire whether or not your unit has A/C and the specificconfiguration (central vs wall) prior to your arrival. We also suggest consulting the local weather authorities prior to arrival.

Payment and Legal Policies
This section details rules and requirements for making and maintaining a reservation with Whiskey Row Penthouse.

PURCHASE AGREEMENT - By Providing Payment information, the Guest(s) has agreed to purchase a reservation from Whiskey RowPenthouse. The Cancellation Policy and Rental Agreement signing period begins at the time of this purchase agreement. If WhiskeyRow Penthouse is unable to provide available dates in purchased rental property, Whiskey Row Penthouse is obligated to provide acomparable alternative. If Whiskey Row Penthouse is unable to provide a comparable alternative, Whiskey Row Penthouse will refundthe purchase to the Guest(s).

AIRBNB, BOOKING.COM, EXPEDIA (& AFFILIATED EXPEDIA SITES, HEREIN AFTER REFERRED TO AS EXPEDIA) GUESTS -Guest who book through Airbnb, Booking.com or Expedia make their purchasing agreement through Airbnb, Booking.com, or Expediarespectively and Whiskey Row Penthouse will adhere to rules governing their purchase. Rules in the Airbnb, Booking.com or ExpediaTerms of Service pertaining to a Whiskey Row Penthouse which contradicts this Rental Agreement will supersede the WhiskeyRow Penthouse Rental Agreement including but not limited to Cancellation, Purchase Agreement, Fee Arbitration and Changes toReservation.

CANCELLATION POLICY - At the time of booking, a 50% deposit of total rental charges is made. The Guest has 24 hours from makingthe reservation to cancel the booking for a full refund. After 24 hours, the 50% becomes nonrefundable. 14 days prior to arrival, weautomatically collect the remaining balance, and the total is nonrefundable if cancelled. If reservation is cancelled within 14 days ofarrival, Whiskey Row Penthouse will seek to rebook the property and will reimburse the Guest for what we were able to re-book the unitfor. Reimbursement will be assessed the day after the check-out of the cancelled reservation.

CHANGES TO RESERVATION - Changes to Reservation dates without penalty more than 30 days prior to arrival are allowed at thediscretion of Whiskey Row Penthouse. A 50% cancellation fee for cancelled nights may be applied. Changes to Reservations dateswithin 30 days of arrival are considered cancelled and are subject to the above cancellation policy.

NO SHOWS - Any guest who does not show up on the first day of the reservation will have the remaining night's of the reservationcanceled. The cancelation will be considered to have been made by the guest and no funds will be returned. For certain situation's if theguest has contacted the Company via email to notify the Company that the Guest will not be making the first night of the reservation atthe Company's discretion the Company will either cancel or not cancel the remaining nights of the reservation. This decision will be sentback to the guest via email.

RENTAL AGREEMENT SIGNING PERIOD - Whiskey Row Penthouse may consider a reservation as cancelled by the Guest(s) if theRental Agreement is not signed within 4 days of the Purchase Agreement being made or before the arrival date, whichever range ofdates is the shortest. Cancellation of Purchase Agreement due to Guest(s) declining to agree to this Rental Agreement must occurwithin the 24 hour Cancellation period to avoid penalties.

PUBLIC RECORDS CHECK- At the time of booking guest's name and birthdate may be submitted to a basic public records searchby request of the building owners. Only the results of the search, Guest(s) names, assigned unit number and reservation dates will besubmitted to the building owners. No other information will be shared. Whiskey Row Penthouse reserves the right to cancel a purchaseagreement at the request of building owners. In the event of this cancellation, Whiskey Row Penthouse will refund the stay in full.Whiskey Row Penthouse may separately provide name(s) of Guest(s) authorized on premises to property staff.

COLLECTION OF PAYMENT - Whiskey Row Penthouse may consider the purchase agreement as cancelled if initial deposit cannot becollected within 24 hours. Whiskey Row Penthouse may consider the reservation as Cancelled by the Guest if payment in full cannot becollected on the payment due date. Whiskey Row Penthouse will make a good faith effort to contact guests and collect payment prior tocancellation. Reservations cancelled in this way will forfeit their deposit.

LIABILITY - The Company is not responsible for any personal effects of The Guest that may disappear from the suite. The Companymaintains insurance on the structure and those items belonging to The Company. The Guest is responsible for insurance on all ofGuest's personal items. The Guest will be fully responsible for all damage to the suite or contents during their stay. In the event that thesuite becomes un-rentable through any action of The Guest, then The Guest agrees to pay the nightly rate as specified in the "Rates"section until the suite may be put back into a rentable condition, in addition to being responsible for any damage caused by Guest, theirinvites, or other persons. The Guest agrees to indemnify The Company and hold it harmless from any injury or damage resulting to TheGuest, their invites, or other persons, their personal property, the suite, its contents, or the property, occurring in the suite itself or inany common areas including, but not limited to, stairways, parking lots, recreational areas, and swimming pools that may be used byThe Guest, their invites, or other persons. The total liability to The Company from any loss to The Guest due to interruption of essentialservices, fire, or other occurrences that renders the suite unusable will be only those days of rental that The Guest has prepaid and notused.

USE OF PREMISES - The suite and associated common areas shall not be used for ANY unlawful or illegal purpose. The Guestagrees to keep the suite in a neat and orderly condition. No nails, screws, or other items are to be driven into any portion of the suite.Only the number of persons indicated on the front side of the "Check-In Statement" are allowed to occupy the suite. The suite is to beused for residential purposes only. No commercial, industrial, or retail activity can be conducted in the suite. Whiskey Row Penthouseis not responsible for any amenities or services that are closed, out of service, or cannot be used for any reason, and monies will not berefunded for such events.

MISCELLANEOUS - No tenancy is created by this agreement. All property rights remain with The Company. The Guest agrees that TheCompany or other lawful authority may evict The Guest, without notice, for any reasons such as, but not limited to (1) failure to leavethe unit at the designated check-in or check-out (unless extended according to the terms of this agreement and authorized in advanceby The Company), (2) nonpayment of rental or other charges, (3) violation of any rule in this agreement, (4) violation of any rules of thehousing development, condominium association, or apartment complex in which the suite is located, (5) any unlawful act of The Guest.The Guest agrees to hold The Company harmless for any eviction. The liability of The Company is limited to unused rental paid by TheGuest. The Company has 10 working days in which to mail or credit charge card for this unused rental to The Guest.

FEE SCHEDULE
Unauthorized Late Check Out - $125/hour after 10.a.m local time
Smoking - $1000 + all repair costs to restore property, as a result of any cigarette, e-cigarette, marijuana, cigar, or any smoking of anykind on the property or inside the unit.
Excessive Cleaning - $125/Hour for cleaning over and above 2 hours
Unauthorized Pets - $1000 + all repair costs to restore property
Broken/Missing Items - Varies from item to item to include repair or replacement, as appropriate
Removal from Unit: up to $2,000 fine plus any damages to Whiskey Row Penthouse

No breach of any term of any of the rules contained in this agreement or the rules of the housing development, condominiumassociation, or apartment complex will be deemed and taken to be a waiver of any other breach of this agreement. The Companymakes no warranties, expressed or implied. If any provision of this agreement is determined to not be valid or enforceable, theremainder of this agreement will not be affected and each provision will be valid and enforced to the fullest extent of the law. TheCompany reserves the right to move The Guest to a comparable suite at any time during this agreement should circumstances beyondthe control of The Company arise.

For the mutual convenience of the parties, it is understood and agreed that by making payment as requested, I (the Guest) shall haveacknowledged and consented to all terms and conditions of this agreement, on behalf of myself and those in my party. The date of thisagreement is the date the reservation is made.
