ARTICLE 1. REGISTRATION AND IDENTIFICATION OF THE GUEST.
It is an unavoidable obligation of the guest to register by personally filling out the
check-in record or card used by the hotel or by signing the guest book. If the
guest comes with a group, the person in charge will fill out the cards or hand over
lists that meet the requirements. The hotel will deny lodging to any guest who
does not comply with these requirements, and has the right to ask for the applicant's
identification as well of those in his party.
ARTICLE 2. LODGING TIME. The guest, in agreement with the hotel, will specify on the registration card the number of days he or she will stay at the hotel. As far as the lodging contract, a day is a unit of time, counted from check-in at 15:00 h until the time of check out, which is set at noon of each day. There will be a 30-minute allowance and if guests stay longer, half rent will be charged until 18:00 h, time after which full rent will be charged. The first day of lodging is understood as complete if check-in takes place before 6:00 a.m.
ARTICLE 3. GUEST OBLIGATIONS It is the guest’s obligation to promptly pay the bill as per the hotel’s request. Advance payment can be required, to the hotel’s convenience. Guests can guarantee payment by means of a cash deposit, a coupon or a credit card voucher accepted by the establishment. The rate for the service is established on the cards, which rule the hotel and have been previously authorized by the Tourism Ministry. Failure to pay when required is considered breach of contract, and management may call on the public force to demand the room to be vacated and may retain the guest’s luggage as guarantee.
ARTICLE 4. OTHER OBLIGATIONS OF THE GUEST: GUESTS ARE STRICTLY FORBIDDEN TO: • Make annoying noise, start a fight, bring musicians or pets to the hotel, and in general, any action that may disturb or make other guests uncomfortable. • Use rooms for gambling or any other illegal actions that might alter the public order or break the law or current regulations. • Use electrical power or appliances for different purposes than those for which they are in the room. • Damage the furniture, ornaments or any other property of the hotel by giving them an improper use. • Carry out any activity that may result in damage to the hotel or to other guests, or be contrary to social rules and good behavior. • No persons other than registered can stay in the room; and in any case, they will give notice to the administration of any change in the number or identification of persons originally registered. • At no given time the number of people staying in the room is to exceed the capacity set by the establishment (maximum 4 people). • Smoking is strictly prohibited in the rooms in accordance with standard NOM-028-SSA2-1999.
ARTICLE 5. ACTS OF GOD If an unforeseeable event occurs that prevents the guest from traveling or arriving as established in the reservation, it is up to the hotel to take the reservation deposit as payment. The hotel will be not held liable for damages arising from natural events, acts of god, or accidents such as car crashes, hurricanes, earthquakes, etc., or for damage or loss of cars parked in the hotel’s parking lots. For all legal matters, guests agree to submit to the jurisdiction of the proper courts in the State of Baja California Sur.
ARTICLE 6. OTHER DISPOSITIONS. • The hotel does not allow the entrance to occupied rooms to any person who has not been previously authorized by the guest. The guest is not allowed to have visitors in the rooms (visiting hours 9 to 20 h). • No cash back. •Any forgotten objects will be stored for 30 days. • The company is not responsible for forgotten items in rooms or common areas, computers, cell phones, sunglasses, passports, wallets, etc. • If any federal authority requires to carry out an inspection of the room and the company is unable to contact the guest, it will be up to the hotel to decide whether to allow the inspection to take place.
ARTICLE 7. LUGGAGE AS GUARANTEE. Luggage and other goods that the guests bring into the hotel are considered as its property and can be used as a guarantee for any debt for lodging and other services given to the registered person (except if the real value of the luggage does not cover the total amount of the debt) if accepted by the hotel.
ARTICLE 8. BASIS. The regulations in this document are drawn in accordance with federal law for tourism in effect and as provided for in the "Rules of Accommodation Establishments" being mandatory for both the company and the guests.
