Marina Flamingo

Important: Rates are based in U.S.dollars, excluding all taxes, and are for accommodation, including use of utilities, appliances, furnishings, and linens as described above. 
There is a strict NO-Pet policy.
Check in is at 3:00 pm, early check in must be preapproved by the Marina in advanced and it is subject to availability an additional charge.  Check out is at 11:00 am, any extension must be preapproved, and it is subject to an additional charge. 
The reservation is only confirmed once the Marina has received the signed agreement and confirmation of 50% deposit.  
The Marina is a smoke free area, smoking nonauthorized areas will be penalized.  
Terms and Conditions
Access to restricted areas: Marina informs you the Marina docks, service areas and administrative offices of Marina Flamingo are of restricted use and access., You or any member of your party may enter these restricted areas only if properly cleared by Marina and must at all times, follow the safety precautions and instructions contained on the posted signs or provided by Marina personnel., Not following the instructions may result in serious injuries or death. You and all members of your party are hereby notified and understand and agree the Marina will not be responsible for any injury resulting from access to restricted areas. If you or any person in your group inclusive of guests and children, enters these areas without clearance or refuses to follow instructions, Marina can ask you and/or the non-compliant person to leave premises or to vacate the leased Unit and Marina premises immediately at Marina’s sole discretion. 
Notice of Construction in Progress: Marina is on its way to becoming one of the most enjoyable Marina in Costa Rica. As a growing property, we have new projects underway that will continue to add amenities, activities options to our guests and future renters. We make great efforts to minimize any possible disturbances due to construction, but we cannot, however, guarantee that no activity will be visible or audible due to the variable nature of construction. While we are hopeful that this will have little impact on your stay with us, unfortunately, we will not be able to provide room changes, discounts, or refunds due to construction at this time. 
Reservation deposits and processing fees are completely non-refundable. I understand there will be no refunds for arriving late, leaving early or "no shows". I also understand that the requested rental is on a first deposit first held basis and that my payment will be returned should the Unit time be reserved by another party prior. I will receive reservation confirmation via email. If, by any reason attributable to Marina, the Unit is not available or not in leasable conditions, Marina at its sole discretion may decide to either change the Unit to one of a similar size and/or view or return the reservation deposits.   
Cancellation policy Booking cancelation is fully refundable when notified at least 30 days prior to arrival, less than 30 days for the arrival will make the cancelation nonrefundable. 
Sleeping Capacity and Disturbances: Tenants and all other occupants will be required to vacate the premises and forfeit the rental fee and security deposit for any of the following:
A.) Occupancy exceeding the sleeping capacity stated on this agreement.
B.) Using the Unit or Marina premises for any illegal activity.
C.) Causing damage to the Unit or Marina premises or to any of the neighboring properties.
D.) Occupancy and use of the Unit and Marina premises in such a fashion that disturbs or offends other guests or residents.
E.) Smoking inside the Unit or Marina premises. You will be assessed a $500 fine should anyone in your group be found smoking on the premises.
F.) Any other acts which interferes with neighbors' right to quiet enjoyment of their property. We wish you to have an enjoyable vacation, but you must respect the rights of other guests.
G) Using fowl language, aggressive behavior, threats, or aggression against anyone within the Marina, including the Marina personnel.
H) Use of illegal substances or abuse of legal substances such as alcohol if this causes misbehavior from you or any one in your group. 
Appliance Malfunctions: Within the range of Costa Rican legislation, there are no rebates or refunds issued for any malfunctions or service requests for air conditioning, televisions, hot tubs, pools, appliances, elevators etc. as every good faith effort is made to insure the property is maintained to highest standards. Every effort will be made to affect repairs as quickly as possible, and we often are able to do so the same day. Additionally, no refunds will be given due to power blackouts, water shortage, flooding, or construction at adjacent properties. 
Care of the Unit and Marina Premises: You are expected to care for the Unit and Marina Premises as if it were your own. In addition, you acknowledge that unless Marina is notified within 24 hours of check-in of any damage or cleaning concerns, all damages, or concerns to the property during your stay will be your responsibility. Each property will be inspected and cleaned after your departure. The rental fee you have paid will provide for normal cleaning so that you can enjoy your vacation up to the last moment. If the property is left in abnormally dirty condition, a $200 fee will be charged to the credit card on file. Fireworks of all types are entirely prohibited, and a fee of $500 will be charged to your card on file if you do not comply. We ask that you leave the property in a clean condition to include the following: All trash removed, all doors and windows closed and locked, All air conditioners off. All keys returned to the office by check out time, all breakage reported to the office, Failure to comply will give us the right to deduct this amount from the security deposit. 
Lessee’s Liability: You agree to accept liability for any damages caused to the property (other than normal wear and tear) by you or your guests, including, but not limited to, landscaping, misuse of appliances, and/or equipment furnished. If damages are more than the security deposit being held, you agree to reimburse Marina for costs incurred to repair or replace damaged items. 
Force Majeure: In the unlikely event that we are unable to deliver the Unit to you under this lease agreement prior to occupancy because of fire, eminent domain, or act of nature, you agree that our sole liability because of these conditions is a full refund of all monies previously paid. Pursuant to the terms of this lease, you expressly acknowledge that in no event shall Marina be held liable for any consequential or secondary damages. 
Hold Harmless: Marina assumes no liability for loss, damage or injury to persons or their personal property. Neither do we accept liability for any inconvenience arising from any temporary defects or stoppage in supply of water, gas, electricity, or plumbing. Nor do we accept liability for any loss or damage caused by weather conditions, natural disasters, acts of God, theft, or other reasons beyond our control. We are not responsible for injuries caused on or off the properties. Use of common areas (restricted or not) is at the sole risk of the lessee and guests.
