Property and Cancelation Policies :
Guests can receive a full refund if cancellation is made within 48 hours of booking, and if the cancellation occurs at least 14 days prior to check-in. Guests may also receive a full refund if cancellation is made at least 30 days before check-in. For cancellations made between 7 and 30 days prior to check-in during low season (1/2-3/15) and between 10-30 days prior to check-in during high season (3/16-12/31), guests will receive 50% for all nights plus housekeeping. If guests cancel less than 7 days prior to check-in, housekeeping fees only will be refunded. Cancellations due to covid are also subject to the stated policy. Reservation cancellations are subject to $25 cancellation fee and any paypal processing fees. Owner reserves the right to cancel reservation without further obligation if completed Rental Agreement and security deposit are not submitted prior to reservation.

The Opal and Sapphire Loft Rules

We ask guests to please treat and enjoy The Lofts like it was their own home. The Opal and The Sapphire, are the birthstones of our heroes (my grandmother and my husband’s father). Their homes were always warm and welcoming, we hope your stay is the same.
Please let us know at the beginning of your stay if there are any issues with the loft, so that we can remedy the situation (management contact, Sheryl @ 330.412.3642).  We want to take care of your needs and enjoy doing so. It's our job and pleasure to take care of guests that have traveled to visit us.

Parking: Parking is available next to our building for free. It is shared with other building patrons and therefore, dedicated parking is not guaranteed. However, there is no need to drive if traveling in downtown Avl, as it is very walkable. There is also a paid lot just across the street and covered parking garage two blocks north on Lexington Ave.

Restrictions: This is strictly a “NO SMOKING” rental. No smoking or vaping is allowed inside the loft or on the property. No pets are allowed. No parties other than registered guests shall occur.
AC/Heat: The ACs are new and very efficient and set for not only temperature but also for humidity. We ask you to keep the setting between 60-70 (winter) and 67-70 (summer) unless you request otherwise. Please close all doors and windows when the AC/Heat are in use.
Plumbing: Please do not flush anything besides toilet paper down toilets. That means no sanitary napkins, dental floss, paper towels, baby wipes, condoms, diapers, etc. are to be flushed or put down the drains.
Safety & Security: For your own security, please always lock the doors when coming or going, and double check the door especially when leaving the loft. Do not share security code with anyone other than guests staying at the loft. Do not leave valuables in your vehicle. Take normal precautions for protection of your personal belongings. The Wanderlust Lofts management is not liable for any loss or theft.
Exterior Lights and Cameras: Please keep outside sconce lights on at all times. There are security cameras located an exterior entry doors and corners of the building. Close and lock all windows and doors when leaving the loft.
Laundry: Should you require laundry during your stay, we can provide this service for a fee.
Supplies: The Opal/Sapphire are stocked with necessities (e.g. hand soap, dishwasher soap, and toilet paper) and with amenities (robes, shampoo, conditioner, body wash, cotton pads, qtips, make-up wipes, and toothbrushes). Extra supplies are guests’ responsibility and may be obtained in town.
Kitchen Sink Disposal: The disposal is not a dispose-all. Therefore, it is not suitable for larger food items, potato skins, coffee, grease, pasta, bones, or pits/seeds. If misuse leads to damage/clogging and/or require a plumber’s attention, guest security deposit will apply to maintenance.
Damages: Please notify us if anything is broken or you notice something is not working properly so we may repair or replace the problem promptly. Please call the property manager immediately (330.412.3642). You may also email us in non-emergent situations at info@wanderlustlofts.com
Grocery & ABC Stores: There is French Broad Food Co-op a few blocks north, located at 90 Biltmore Ave. For more selection, there is a Whole Foods at the north end of downtown, at  70 Merrimon Ave. There is an ABC Store a block away, across the intersection in front of the building at 179 S Charlotte St.
TVs- they are SMART: The house has 1 flatscreen with Smart TV (via internet) so guests can watch instant view TV shows and movies through Netflix, Amazon, etc.
Quiet Hours: The lofts are located on the South Slope in the Central Business District of downtown Asheville. The City of Asheville’s noise ordinance has restrictions from 11:00 pm to 7:00 am, during which time the noise from the short-term rental home shall not unreasonably disturb adjacent neighbors. Sound that is audible beyond the property boundaries during non-quiet hours shall not be more excessive than would be otherwise associated with a residential area. Please respect your loft neighbors. Check Out Procedure
Keys: You will likely not have keys, as there will be a key code for the door lock. Upon final departure please ensure windows are closed, lights are off and if a change in AC/Heat setting was approved, please set to original temp.
CHECK OUT CLEANING ~ It is not necessary to wash linens or towels, but please wash dishes, put dirty towels in a pile on the bathroom floors and dirty linens in a pile in the bedrooms. Visits of 2 weeks are required to have a cleaning midway into the visit.  Cleaning Charges: Your purchased stay includes a cleaning fee. Any extraordinary cleaning or laundry resulting from Guest’s visit will be charged to the guest. Ladies, please note the BLACK face towel and disposable cleaning clothes are provided for makeup removal. Guest agrees to keep the premises in a clean and sanitary condition, to exercise care regarding all furnishings and household items and to make no alterations to existing furniture or appliances.
CHECK IN is at 4 pm or later and CHECK OUT is promptly at 11 am unless a plan with the management was prearranged. House cleaners and maintenance crew will arrive at 11 am to prepare for the next guests. Any delays in check out cost the owners time and money. If guests plan on staying beyond check out then another days rent is required.

Rental agreement

By proceeding with booking and payment, you agree to the below terms.

Short Term Rental Agreement and Conditions
Premises: The premises which are subject to this agreement are located at 11 Southside Ave, Asheville NC, and are owned by Wanderlust Holdings LLC (“Owner”).
Guests: Use of the property is for the occupants listed above. Occasional, quiet guests are permitted, however, it is not intended that the home be used as a “meeting place” for extra friends/family. Please remember to observe quiet time hours. We ask that you respect the neighbors’ privacy, peace and quiet.
Check-in / Check-out Upon arrival date check in is 4 pm or later, and check-out on departure date is 11 am or earlier. Before checking in you will be given a key code for keyless entry box on the door. At check-out, please put all perishables and food items in the refrigerator, AC set to original temp, lights are off and windows are closed. Please put soiled dishes in the dishwasher and place linens and towels in a pile in the bathroom. Early check-ins and Late check-outs will be charged a fee of $100/hour, because house cleaners and maintenance crews are scheduled to begin work at 11 am.
To Book a Reservation: At the time the reservation is made, full payment shall be made by credit card. As there is no prepaid security/damage deposit, guest agrees to pay for any damages, up to $500, and/or excessive cleaning fees, up to $100.
Cancellation by Guest: 
Guests can receive a full refund if cancellation is made within 48 hours of booking, and if the cancellation occurs at least 14 days prior to check-in. Guests may also receive a full refund if cancellation is made at least 30 days before check-in. Cancellation by Owner: If Owner does not receive this completed Rental Agreement and the security deposit info according to the above requirements, Owner reserves the right to cancel reservation without further obligation or notice.
Shortened Stays: Since a privately owned property has been reserved for Guest’s use, no refunds will be made for early departures.
Nature of Neighborhood: This home is in the Central Business District of Asheville, NC in Buncombe County. Specifically, it is in the heart of the South Slope, a lively area with breweries, bars, and food establishments. The Owner is not held responsible for town noise, car alarms, foot traffic, or possible downtown festivities.
Our loft is regularly treated for bugs/pests. Basic rule: the cleaner you keep the loft, the kitchen in particular, the fewer “visitors” you’ll have.
Use of Property: This lofts are considered ‘residences’ by the city of Asheville. Parties or group entertaining are NOT permitted, and may be grounds for eviction. No commercial use of the property is permitted.
Terms of Occupancy: Guest understands that the rented property is a private residence and that it will be inspected as soon as reasonably possible after Guest’s departure. It is Guest’s responsibility to call the Owner or management upon arrival to report any existing damage. Owner reserves the right to inspect The Opal and The Sapphire during Guest’s stay. Maximum occupancy is two persons per bedroom. A limited number of outside guests may visit the property for controlled, finite gatherings (not overnight stays). This is due to considerations regarding size/location of structure, noise, parking, and safety issues. Violation of occupancy limit will result in forfeiture of all monies and termination of occupancy. Guest must be 25 years or older to rent The Opal or The Sapphire. Appliances, television and AC will be regularly maintenanced; refunds will not be given due to breakdown but all efforts will be made on behalf of Owner to immediately address any related operational issues. Owner reserve the right to enter the unit to inspect or make repairs. Repairs shall be made as quickly as possible, and with as little inconvenience to the Guest as possible.
Hazardous Conditions:  USE CAUTION, CHILDREN MUST BE SUPERVISED - Guest acknowledges that caution must be exercised at all times as the hand railing and wire cable protect the open stair well. In addition, stairs can be inherently dangerous and running up or down stairs is prohibited. There are operational windows, which open 15 inches per code and do not have screens. While construction, windows, stairs, and railing meet building code requirements, these conditions create a hazard for adults, and particularly for children. By signing this agreement, Guest accepts total responsibility with respect to any accident or injury involving the stairs, windows, otherwise.
Restrictions: This is strictly a “NO SMOKING” rental. No smoking or vaping is allowed inside the loft or on the property. No pets are allowed. No parties other than registered guests shall occur.
Loss/Theft: Guest acknowledges that The Opal or The Sapphire will be locked whenever Guest is away and that all windows and doors will be locked at night. The Owner is not responsible for any loss of Guest’s property as a result of theft or other damage no matter what the cause.
Mediation/Arbitration: All controversies or claims (except any claim that the Owner may have against Guest for nonpayment of rent or damages to The Opal or The Sappphire which Owner specifically reserves the option to proceed to court to collect) arising out of or relating to this Agreement or its breach shall be initially submitted to mediation. Any party to this Agreement desiring to submit an issue to mediation shall notify the other parties of such desire in writing. The parties shall then agree within 21 days of the request to a single mediator who will mediate all issues submitted to the mediator pursuant to this paragraph. If the parties are unable to agree on a mediator within the above time frame, then any party may submit a request to a Judge in Buncombe Country, state of North Carolina, for appointment of a mediator under this paragraph. The cost of the mediation shall be equally divided between the parties. If mediation is unsuccessful, then the parties agree to arbitrate the issues (except any claim that the Owner may have against Guest for nonpayment of rent or damages to The Opal or The Sapphire, which Owner specifically reserves the option to proceed to court to collect) through binding arbitration in accordance with North Carolina law and judgment on the award rendered may be entered in any court having jurisdiction. Any party desiring to submit an issue to arbitration shall notify the other parties of such desire in writing. The parties shall then agree within twenty-one (21) days of said request to a single arbitrator within the above said time frame, then any party may submit a request to a Judge of Buncombe County, state of North Carolina, for the appointment of an Arbitrator under this paragraph. As part of any judgment to be awarded by the Arbitrator, in the Arbitrator’s sole discretion, award attorney’s fees and costs to the prevailing party. The cost of the Arbitrator shall be equally divided between the parties unless the Arbitrator has come to a reasonable belief that the position taken by either of the parties was frivolous and whereupon the Arbitrator may assess the Arbitrator’s fees and costs against the party whose positions the Arbitrator deems frivolous.
Attorneys’ Fees: In the event any party hereto shall bring suit, commence an arbitration, or hire an attorney to compel performance of or to recover for breach of any covenant, agreement or condition contained in this Agreement, the prevailing party shall be entitled to recover from the other party his/her/ its costs and reasonable attorneys’ fees.
Place of Suit: Any action at law, suit in equity, or other judicial proceeding, which may be filed to enforce the arbitration agreement as set forth in this Agreement or which may be instituted to enforce this Agreement or any portion thereof which is not subject to the arbitration requirement, if any, shall only be instituted in the courts of Buncombe County, State of North Carolina.
Indemnity Assumption of Risk: Guest, as a material part of the consideration to Owner for this rental, will and does hereby assume all risk of bodily injury, wrongful death and/or property damage occasioned by an accident or nuisance made or suffered in The Opal or The Sapphire or resulting from any failure on the part of Guest to operate The Opal and The Sapphire in a safe conditions. Guest hereby waives all claims in respect thereof against Owner and its employees, agents, licensees, contractors and invitees (herein collectively called “Associates”), and Guest hereby agrees to indemnify and save harmless Owner and the Associates from and against any and all claims, loss, cost and liability for bodily injury, wrongful death and/or property damage suffered by any persons (including, without limitation, Guest’s and those persons at The Opal or The Sapphire with or without Guest’s permissions) arising out of, caused or occasioned by, or resulting from any accident, fire or nuisance at The Opal or The Sapphire, or failure to maintain connection with any such claim or any action or proceeding brought thereon. Guest further agrees to cooperate with Owner in defense of any such claim, including, but not limited to, the providing of affidavits and testimony upon request of Owner. Guest, will and hereby does assume all risk of loss or damage to personal property, by whomsoever, and does hereby agree that Owner will not be responsible for loss or damage to any such property, and waives all claims in respect thereof against Owner and Associates arising from any cause whatsoever.
Assignability: This agreement is not assignable by the Guest, nor may the Guest sublease The Opal or the The Sapphire Lofts.
