Boots Off Hostel & Campground

On-Site and Off-Site Activity Participation Acknowledgement:
I/We, the customer(s), hereby acknowledge that I/we are staying onsite at Boots Off Hostel & Campground or participating in an "Activity" for which Boots Off Hostel & Campground, a Tennessee company, or one of its subsidiaries (individually and collectively) is furnishing services or equipment which requires physical exercise like walking up and down stairs, ramps, and paths and climbing up and down the slope of the property including walking down to the campground on trails with roots and other natural or unnatural trip hazards.  Also including, but not limited to, other "Activities" like rafting, kayaking, swimming, stand-up paddle boarding, rock climbing, hiking, rappelling, zip-lining, and ropes course navigating, or cycling (the “Activity”).  By booking a reservation, I certify that I, and everyone in my group, are in good health and physical condition and do not suffer from any disability which would prevent my/our participation in the "Activity".  I/We agree to abide by any decision of any Boots Off Hostel & Campground employee(s), organizers, volunteers, directors, representatives, agents, and officers regarding my ability to safely participate in the "Activity".  I/We fully understand that I/we may injure myself/ourselves as a result of my/our participation in the "Activity" and that certain injuries may result in death or permanent physical disability.  I/We acknowledge and agree that my/our participating in any "Activity" may be terminated immediately if Boots Off Hostel & Campground believes, in their sole discretion, that I/we are unable to complete the "Activity" for any reason, or that I/we are under the influence of alcohol or drugs.

Damage, Lost, or Stolen Property and Equipment Liability Acknowledgement:
I agree that if I, or anyone in my group, damage, lose, or misplace any property, equipment, or item(s) I use or rent from Boots Off Hostel & Campground that I will pay for these losses or damages.  I agree that if Boots Off Hostel & Campground incurs any costs associated with recovery of payment for damages or losses (such as court costs) that I will reimburse or pay Boots Off Hostel & Campground for these costs as well as the cost of the damaged or lost property, equipment, or item(s).  Damage to property and item(s) onsite or to equipment like broken fishing rods, bent or broken paddles, ripped or damaged life vest (PFDs), folded(wrapped) canoes, damaged stand-up paddle boards (SUPs) or kayaks along with any other miscellaneous rented equipment (dry bags, leashes, etc.) will be charged for replacement.  If I do not replace or return the damaged, missing, or lost property, equipment, or item(s) within three (3) working days of the due date, I authorize Boots Off Hostel & Campground to charge the full retail purchase price of item(s) in question (see below) to my credit card, minus the deposit.  I understand and agree that I am fully responsible for any damage or loss to the property, equipment, or item(s) while onsite and during the time it is rented or checked out to me. 

*If damage or loss occurs, I authorize Boots Off Hostel & Campground to charge the cost of replacement or repair to my credit card, minus deposit. It is solely the discretion of Boots Off Hostel & Campground to determine if damaged property, equipment, or item(s) will be repaired or replaced at the renter’s expense.

Risk Acknowledgement, Indemnity and Release:
In consideration of staying overnight onsite and my/our participation in the "Activity", I/we hereby assume all risks, known and unknown, associated with participation in the "Activity" including, but not limited to, any injuries resulting from falling trees and limbs, trips and falls, contact with other participants, the conditions of "Activity" sites, bodily injuries, and death.  To the fullest extent permitted by law, I/we hereby agree to indemnify, hold harmless and defend Boots Off Hostel & Campground, as well as, where applicable, the Tennessee Valley Authority, the State of Tennessee, the U.S.Forest Service, the United States of America, and other any federal or state governmental agencies or other entities who may have an interest in any real property, river,lake, or waterway on which the "Activity" takes place (individually and collectively, the “Indemnified Parties”) from and against any and all claims, losses, damages, expenses and other liabilities (including, but not limited to), court costs and a arising out of or resulting in whole or in part from my participation in the "Activity". I for myself and anyone entitled to act on my behalf, including, but not limited to my heirs and successors, hereby RELEASE, WAIVE, AND FOREVER DISCHARGE the "Indemnified Parties" from any and all claims, losses, damages, expenses and other liabilities of any kind arising out of my participation in the "Activity" even if such claims, losses, damages, expenses, and other liabilities arise out of negligence or carelessness on the part of any or all of the of the "Indemnified Parties".

Media Release:
I/We hereby grant and convey to Boots Off Hostel & Campground all rights, title, and interest I/we may have in any and all photographs, motion pictures, video recordings, and any other recordings made while onsite or engaged in the "Activity".  Further, Boots Off Hostel & Campground shall have the right to exploit such recordings throughout the universe, an unlimited number of times, in perpetuity by any and all means and media, now known or hereafter invented.

Medical Emergencies and Indemnity and Release:
I/We hereby give permission to Boots Off Hostel & Campground to contact emergency services for help, whether or not Boots Off Hostel & Campground contacted my emergency contact and give permission to a licensed physician or other licensed medical provider to provide proper treatment, including but not limited to hospitalization, injection, anesthesia and/or surgery.  I/We hereby RELEASE, WAIVE, AND FOREVER DISCHARGE Boots Off Hostel & Campground from any and all claims, liabilities, causes of action, damages, demands, judgments, executions, liens and costs whatsoever in law or equity, including, without limitation, liability for death or bodily injuries to any person or damage to any property resulting from any (i) claims made against medical providers of emergency services under this authorization, or (ii) against Boots Off Hostel & Campground for obtaining emergency medical services for me pursuant to this authorization and waiver.

Savings Clause/Severability Clause:
If any provision(s), or portion thereof, of this Agreement be invalidated on any ground by a court of competent jurisdiction, then the invalidity shall not affect other provisions and applications of the Agreement which can be given effect without the invalid provisions or applications. To this end, all parties agree provisions of this Agreement are declared to be severable.

Entire Agreement Clause/Merger Clause:
This Agreement and any Attachments hereto constitute the entire agreement between the contracting parties concerning the subject matter hereof. All prior agreements, discussions, representations, warranties and covenants are merged herein.  There are no warranties, representations, covenants, or agreements, expressed or implied, between the parties except those expressly set forth in this agreement.  Any amendments or modifications of this agreement shall be in writing and executed by the contracting parties.
