Terms and Conditions
Hereinafter, the party renting a room or booking services directly or through this website shall be called "you" or "the guest(s)" (inclusive of any other individuals staying in your room, invitees to your room or onto the premises located at 33 Winter Hill Street, Kingfield, ME, or any such parties using services provided Tadasana and/or its employees or contractors). The party renting the room(s), offering services and selling products is Tadasana Ventures, LLC d/b/a Santosha at Hillholm Estate ("Tadasana", "we", and "our", inclusive of our subsidiaries, affiliates, directors, officers, agents, partners, investors, lenders, employees, contractors, third-party service providers, recommended parties, successors and assigns, etc.) We reserve the right at any time, at our sole discretion, to change or otherwise modify these terms and conditions without prior notice, and such changes will be effective immediately upon posting. Unless otherwise indicated, any new material added to these terms and conditions will also be subject to these terms and conditions. Be sure to return to this page periodically to review the most current version of same.
Prices and Taxes
Our room rates and applicable taxes are always subject to change. All rooms rates are subject to the Maine State Sales Tax applicable at the time of your arrival. Amounts paid in connection with your reservation are nonrefundable.
Payment and Terms at Check-In/Check-Out
All requests to reserve a room must include the first and last name of all adults occupying the room and a valid credit card for a guarantee of arrival. A valid photo ID is required at check-in. You must be 21 years old and present to book a room. Your reservation is guaranteed until the scheduled day of arrival. After that time, it will no longer be guaranteed and the room may be reassigned. We may not charge your credit card until the date of arrival. Submitting credit card information with your reservation does not mean that we necessarily charge your credit card with any Pre-Payment Deposit upon making the reservation. We retain the right to cancel your reservation if we attempt to charge your credit card with any Pre-Payment Deposit and are unsuccessful. We will send you a cancellation confirmation via email after cancelling your booking.
Check-in: 3:00 p.m. - 9:00 p.m.
You can check-in any time from 3PM local time. Arrangements for checking out will be made at the same time. The balance of the reservation amount is payable on arrival at check-in. Please note that check-in cannot be completed until full payment for the room(s) has been received and processed. A key is provided at check-in after the full reservation amount has been settled. The cost of any keys needing replacement is $10, charged to the credit card used to book your reservation. During the check-in process, our receptionist will provide you with any information which may be required during your stay such as the location of nearby shops, dining establishments, sights you may like to see, etc. Always ask our receptionist for anything that would make your stay more enjoyable and convenient. Check-in closes at 9:00 p.m. If you anticipate arriving later than 9:00 p.m., you must contact us (reservations@santosha.org) at least 24 hours in advance to make alternative arrangements or we reserve the right to cancel your booking.
Check-out at 11:00 a.m.
You can check-out any time until 11AM local time. Later check-out times may be requested and may be granted, subject to availability. At check-out, please return your key to the reservation desk and leave it in the key drop box. Please note that a more detailed inspection of the room(s) is made after check-out. We reserve the right to make charges to the credit card used for your booking for any damage found before the room is occupied again. Please be aware that bed linens, towels, robes, books, decor, hangers, etc. should remain in the room upon your departure. These items are not gifts and we reserve the right to charge you for their replacement in the event they are missing after your checkout.
Cancellation
Please carefully read our cancellation policy. Our staff members are instructed to follow this policy. For the avoidance of doubt:
- If the guest cancels more than 14 days in advance, the total amount of the reservation will be refunded.
- If the guest cancels less than 14 days (inclusive) in advance, 100% of the total reservation amount is non-refundable and will be charged to the credit card used to make your reservation, including any "Add-Ons".
- If the guest arrives and decides to leave early, any remaining nights on the reservation are non-refundable.
- In case of a “no-show”, the total price of the reservation will be charged to the credit card on file and is non-refundable.
- There is only one way in which we can acknowledge cancellation of the guest’s reservation; the guest MUST send a cancellation request in writing, stating the reservation number, via email to the following address: reservations@santosha.org.
- Cancellations take effect upon receipt of, and response to, any such request, by Tadasana. For the avoidance of doubt, cancellations do not take effect when a guest sends a cancellation email.
- We do not offer refunds for changes in weather predictions; actual weather events; illness or death in your family; changed plans; delayed travel; or otherwise. We do not offer an option to reschedule to alternative dates if you are trying to cancel or change your booking within 14 days of arrival.
Smoking
Smoking is prohibited inside all buildings on premises and is prohibited within 100 feet of any structures. At check-in, you will be asked to sign a document indicating that you agree to a $1,000 fine if ANY evidence of smoking is found on the premises, including but not limited to window ledges, stairs, curtains, or the entrance areas. Failure to receive or sign such document does not invalidate the Inn on Winter's Hill's right to charge any particular fee or to cancel your reservation without refund. Please note that we comply with the local health and safety guidelines and recommendations on smoking in public places.
Immediate Termination
Immediate unilateral termination by Tadasana of the rental agreement without refund is possible in the event of:
(1) Any evidence of smoking is detected as described above;
(2) More guests stay in your room(s) than permitted;
(3) Guests creating excessive noise or disturbance at any time, in the sole discretion of staff members of Tadasana;
(4) You subletting your room(s) to any other person; or
(5) For any other reason at the sole discretion of the staff of the Inn on Winter's Hill to enable the peaceful, safe, quiet, respectful enjoyment of the premises by all staff and guests.
Pet Fee
A charge of $50 per pet, per stay, will be charged to any applicable reservation. The only pets permitted to be in guest rooms are dogs. Dogs must be crated in your room when you are absent from the room. Dogs must be leashed at all times on the property, even if you see other dogs unleashed. Dogs are not permitted in the Dining Room or Kitchen. You will be expected to sign a Pet Agreement upon check-in. Tadasana reserves the right (a) to require you to return to your room if your dog makes noise and you are outside the room or off-premises; (b) to charge the credit card used to make your booking to repair any damage caused by your dog, including noise complaints or excess cleaning; and (c) to terminate the rental agreement with you in the event that your dog causes disruption to the general peace and enjoyment of the property by other guests and staff members. You are required to bring your dog's own crate; Tadasana cannot guarantee crate availability for your dog. The Inn on Winter's Hill can recommend a local dog daycare for your pet in the event you plan to be off-site for the entirety of the day.
Lost and Stolen Items
We are not responsible for lost, forgotten, or stolen personal items on premises.
Maximum Capacity; Traveling with Minors
When booking, keep maximum occupancy rules in mind. A maximum of (a) two adults and one child under the age of 10 may occupy a room with a King or Queen bed (with the benefit of a rollaway cot for the child, if available); and (b) a maximum of four adults/children may occupy a room with two double beds (rollaway cots are not available for such rooms). In rooms with two double beds, the first two adults are included in the booking price; the third and fourth people, if any, are charged $50 per person per night if they are older than 10 years of age.
Tadasana is compliant with the Americans With Disabilities Act (ADA). We offer accessible rooms within the hotel. Please ensure requests reach us by calling us directly at 207-340-1020 after the reservation has been made; we cannot guarantee availability without prior notice. Please note that all rooms in the Historic Mansion (king beds) are accessible only by stairs and not by elevator, so guests with limited range of mobility should not book rooms in the Historic Mansion.
Alcohol
The Lounge serves many varieties. By law, we can’t allow any alcohol to be brought onto the property. To uphold this law, we require all beverages on the property be purchased through the Lounge, with the exception of transparent, see-through water bottles. Guests may purchase alcoholic beverages from the Lounge, then enjoy such beverages in your rooms.
Parking
On-site parking is included in your stay. Please be aware that, due to size constraints, we cannot accept RVs or vehicles larger than an SUV in our parking lot. This property does not offer any services for RVs (water, dumping, electrical hookup, etc.)

You agree to use our website and any affiliated third-party site in strict compliance with all applicable laws, rules, rulings and regulations and in a fashion that does not, in the sole judgment of Tadasana, negatively reflect on the goodwill or reputation of Tadasana and shall take no actions that would cause Tadasana to be in violation of any laws, rules, rulings or regulations applicable to Tadasana. It is your responsibility to understand and obey all applicable local, state, federal and foreign laws (including minimum age requirements) regarding the possession, use and sale of any product for sale on this website or any affiliated third-party site. Tadasana and its websites are based in the United States. Tadasana controls and operates its websites through its headquarters in Kingfield, Maine, and makes no representation that these materials are appropriate or available for use in other locations. If you use such websites from other locations, you are responsible for compliance with applicable local laws. Such websites may describe products that are not available worldwide. If any provision of these terms or conditions is held to be unenforceable, the unenforceable portion shall be construed in accordance with applicable law to the greatest extent possible and the remainder of the provisions shall remain in full force and effect. Tadasana reserves the right to investigate any suspected breaches of such websites' security or these terms and conditions and involve law enforcement authorities in investigating any such matters and prosecute violators to the full extent of the law.
Dispute Resolution/Issues
These terms and conditions shall be subject to any other agreements you have with Tadasana. The rental agreement is governed by the laws of the State of Maine without respect to principles of conflicts of law. You hereby irrevocably and unconditionally consent to the jurisdiction of the state court in Franklin County and the federal court in Cumberland County, Maine. In the event any of the terms or provisions of these terms and conditions shall be held to be unenforceable, the remaining terms and provisions shall be replaced by such enforceable term or provision as comes closest to the intention underlying the unenforceable term or provision. Any dispute relating in any way to this rental agreement shall be submitted to arbitration in Franklin County, Maine, except that, to the extent you have in any manner violated or threatened to violate Tadasana’s intellectual property rights, Tadasana may seek injunctive, equitable or other appropriate relief in any state or federal court and you consent to exclusive jurisdiction and venue in the state court in Franklin County and the federal court in Cumberland County, Maine. To the fullest extent permitted by law, no arbitration under these terms and conditions shall be joined to an arbitration involving any other party, whether through class arbitration proceedings or otherwise.
Force Majeure
In no event shall Tadasana be responsible or liable for any failure or delay in the performance of its obligations hereunder arising out of or caused by, directly or indirectly, forces beyond its control, including, without limitation, strikes, work stoppages, accidents, acts of war or terrorism, civil or military disturbances, nuclear or natural catastrophes or acts of God, local, national, or global pandemic or spread of disease, and interruptions, loss or malfunctions of utilities, communications or computer (software and hardware) services; it being understood that Tadasana shall use reasonable efforts to resume performance as soon as practicable under the circumstances.
For the avoidance of doubt, the foregoing provision applies only to Tadasana and does not, under any circumstances, relieve you of your obligation to perform under this rental agreement.
Third Party Rights
Links to third-party websites and/or services are provided solely as resources that may be of interest to you, and Tadasana has no control over the content on such websites or the products or services provided by such parties. If you choose to link to a website not controlled by Tadasana, Tadasana makes no warranties, either express or implied, concerning the content of such site, including the accuracy, completeness, reliability or suitability of the site, nor does Tadasana warrant that such site or content is free from any claims of copyright, trademark or other infringement of third-party rights or that such site or content is free of viruses or other contamination. Tadasana makes no warranties, either express or implied, concerning the quality or performance of any such third party. Tadasana does not guarantee the authenticity of documents on the Internet. Links to third-party websites do not imply any endorsement of or responsibility for the opinions, ideas, products, information or services offered at such sites, or any representation regarding the content at such sites.
Waiver
TO THE EXTENT PERMITTED BY APPLICABLE LAWS, IN NO EVENT SHALL TADASANA BE LIABLE FOR ANY INCIDENTAL, DIRECT, INDIRECT, EXEMPLARY, SPECIAL, PUNITIVE AND CONSEQUENTIAL DAMAGES, LOST PROFITS, OR ANY KIND OF DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, ATTORNEYS’ FEES AND LOST PROFITS OR SAVINGS) RESULTING FROM LOST DATA, BUSINESS INTERRUPTION RESULTING FROM THE USE OF OR INABILITY TO USE THIS SITE OR ANY AFFILIATED SITE, INTERACTIVE AREAS, SERVICES PROVIDED ON OR OFF-SITE AT 33 WINTER HILL STREET, KINGFIELD, ME, OR RELATED PRODUCTS OR SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT TADASANA IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. You agree to defend and indemnify Tadasana and each of its subsidiaries, affiliates, directors, officers, agents, partners, investors, employees, successors and assigns from and against any claims, causes of action, demands, recoveries, losses, damages, fines, penalties or other costs or expenses of any kind or nature, including but not limited to reasonable legal and accounting fees, arising from (1) your breach of these terms and conditions; (2) your violation of any law or the rights of a third party; or (3) your use of our website(s) or any applicable third-party website.You and each of your successors, assigns, subsidiaries and affiliates, hereby unconditionally release and forever discharge Tadasana harmless from any and all complaints, claims, charges, damages, demands, suits, actions and causes of action, whether at law or in equity (including attorneys’ fees, costs and expenses), known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with your use of this website, any applicable third-party website, and any services or products produced by Tadasana.
These terms and conditions constitute the entire agreement between you and Tadasana regarding your use of our websites, any affiliated websites, and your receipt of services or products from Tadasana. The failure of Tadasana to exercise or enforce any right or provision of these terms and conditions shall not constitute a waiver of such right or provision. If any provision of these terms and conditions is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these terms and conditions, which shall remain in full force and effect.

These terms and conditions do not, and shall not be construed to, create any partnership, joint venture, employer-employee, agency or franchisor-franchisee relationship between you and Tadasana. You may not assign, transfer or sublicense any of your rights or obligations under these terms and conditions without our express prior written consent. We may assign, transfer or sublicense any or all of our rights or obligations under these terms and conditions without restriction. No waiver by us of any breach of these terms and conditions will be deemed to be a waiver of other breach. Any heading, caption or section title contained herein is for convenience only. All terms defined in the singular shall have the same meanings when used in the plural, where appropriate and unless otherwise specified. Any use of the term “including” or variations thereof in this agreement shall be construed as if followed by the phrase “without limitation.” A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to these terms and conditions to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. Tadasana will not be responsible for any failure to fulfill any obligation due to any cause beyond its control.
