Dogfish INN Terms and Conditions

BYMAKING A BOOKING ON THE DOGFISH INN WEBSITE OR STAYING AT THE DOGFISH INN YOUAGREE TO BE BOUND BY THE FOLLOWING TERMS AND CONDITIONS. PLEASE READ THEMCAREFULLY.
GENERAL

This contract is between you and American Craft Brewery LLC d/b/a Dogfish Inn, a Massachusetts limited liability company (“Dogfish”). These general terms and conditions ("Terms and Conditions") and the booking confirmation issued by Dogfish confirming your booking ("Booking Confirmation")constitute your contract with Dogfish. In these Terms and Conditions, the words "we" or "us" means Dogfish and its employees, parents, subsidiaries, affiliates, officers, agents, suppliers and vendors, and use of the words "you" or "guest(s)/Guest(s)" means any persons for whom a room is booked.

CHANGES AND CANCELLATIONS        
Booking cancellations MUST be made at least one week before the scheduled check-in date and a service charge of $25.00 will charged for any such cancellation. If a cancellation is made less than one week before the scheduled check-in date, your credit card will be charged an amount equal to one night’s stay at the Inn at the then-prevailing room rate. Any no-show will result in the total payment under that Booking Confirmation being charged to your credit card  irrespective of the number of stay dates remaining. A change of Guest name on your booking is allowed if made three (3) days or more before check-in date. Any changes regarding stay dates, room category, duration of stay may be made subject to (i) availability and (ii) the terms of cancellation herein.

RESERVATIONS       
Bookings may be made online at www.dogfishinn.com or by calling the Dogfish Inn at 302-644-8292. Reservations may be secured by using a major credit card. Your credit card will be authorized upon booking. Full payment must be made at the time of check-out . We accept payment by Visa, Mastercard, or American Express or debit cards. If you opt to use a debit card, a hold will be placed on your funds to ensure payment. A payment processing fee may apply. For walk-in bookings, we also accept cash payments. Once your booking has been successfully completed, either online or via telephone, a Booking Confirmation will be issued for each room booked and sent to the email address provided by you. You MUST produce your Booking Confirmation(s) upon check-in at the Inn, together with your original, valid photo identification document (driver’s license, passport, or other government-issued identification). If you do not receive your Booking Confirmation(s) within twenty-four (24) hours from the time of booking, please contact the Dogfish Inn via telephone. The 'Guest' named in the Booking Confirmation must be the person staying at the Inn; otherwise, we reserve the right to cancel the booking. At all times during the booking process, you will be advised to ensure accuracy of your booking details (stay dates, room types, room rates, number of guest(s)).Dogfish will not be responsible or liable for errors in bookings. Bookings are accepted subject to room availability.

ROOM RATES  
Room rates shown on the Dogfish website are charged on a per room per night basis. Meals are not included. Rates are subject to change and an 8% tourism tax. Room rates are based on double occupancy. No more than four guests may stay in any one room at any time. The following amenities are provided in our rooms:   
Mini-bar with items to be charged as incidentals
Television, air-conditioning, hair dryer, soap, towels, radio
Rollaway beds and pack-n-plays are available at an additional $25.00 each per night (2 total at facility)
Dog Friendly with advanced notice and a non-refundable $75 flat pet fee per stay.
The following amenities ARE NOT provided in our rooms: ·

NON-SMOKING PROPERTY: In accordance with state law and the Delaware Clean Air Act, Dogfish Inn is a NON-SMOKING property. Smoking in any of our rooms will result in a $500.00 charge and a cleaning fee. These charges will NOT be waived, and failure to comply will entitle us to terminate your booking and you must leave the Inn immediately. COMPLIANCEWITH LAWS
You shall comply with all applicable federal and local laws, rules and regulations, including but not limited to local noise ordinances, and Dogfish health and safety procedures during your stay at the Inn.

RESTRICTIONS
Dogfish reserves the right to ask you to leave the Inn and remove your belongings from the room immediately if we, in our sole discretion, believe that you have used the room in an irresponsible manner or in a manner that will compromise the safety of, or cause damage and/or harm to the room, the Inn premises, the other Inn guests, staff or any other persons or the reputation of Dogfish without any compensation and/or any reimbursement to you.  In the event of such request your Booking Confirmation will be charged to your credit card.

CHECK-IN AND CHECK-OUT· 
Check in is at 4:00 pm; Check out is at 10:00am.·  
Booked rooms will be held for check-in until 2:00 am the following day of the scheduled check-in date, after which the booking will be deemed cancelled and Dogfish shall be entitled to release the booked room(s)for the remaining stay dates to other guests, unless you give Dogfish notice before 2:00am of a late arrival. No refunds will be provided for the cancelled booking. If you check-out beyond the stipulated time Dogfish reserves the right, without further notice to you, to charge you an additional one (1)night's stay at the then prevailing room rate or remove your belongings into the luggage storage facility (luggage storage charges may apply) and deny you further access into the room. Dogfish shall not be liable for any loss or damage to your belongings as a result of the action(s) taken.

DAMAGE
You are liable for any damage whatsoever caused to booked rooms or any other Dogfish property caused by your or your guests, agents, or invitees (whether or not they are staying at the Inn) during your stay. Dogfish reserves the right to retain your credit card and/or debit card details and charge or debit such amounts as it shall in its sole discretion deem fit on the said card(s) to compensate or make Dogfish whole for the loss, damage, costs or expenses incurred or suffered as a result thereof. Dogfish further reserves the right to commence legal proceedings against you without prior notice.

RIGHT TO REFUSE ACCOMMODATION
Dogfish reserves the right to refuse accommodation to any person(s) without any notice and terminate any booking without being liable for any refund or compensation for the following reasons: (1) the booking has been paid through fraudulent means; (2) the booking has been altered by anyone other than Dogfish or a Dogfish-authorized agent or has been tampered with or defaced (in which case Dogfish reserves the right to retain such booking documentation); (3) the person checking in is not or cannot prove that he/she is the person named in the Booking Confirmation; or (4) as permitted under the provisions of these Terms and Conditions.

RELEASE
Dogfish makes no warranty or representation to you with respect to the suitability of the Inn for any purposes. You expressly assume all risks associated with you ruse of the Inn, including but not limited to use by your guests or invitees. You hereby release and forever discharge Dogfish on behalf of yourself and your heirs, successors and assigns from any and all claims, causes of action, and liabilities which may arise out of or relate to the use of the Inn, except those caused by gross negligence or willful misconduct of Dogfish.

LIMITATIONOF LIABILITY
Dogfish shall provide to you the room(s) stated in the Booking Confirmation(s)in accordance with these Terms and Conditions. We do not accept any liability for failure to provide the services contracted or any of them due to circumstances beyond our control. Dogfish does not guarantee Guests safety against events including but not limited to accidents, negligence, death, acts of God, flood, riot, or theft. All activities have inherent risks to health and safety and Dogfish shall not be liable for any claims, actions, damages, costs or expenses of any nature whatsoever, whether in law or in equity, contractual or in tort, occurring during, caused by relating, to or arising in any way from your stay or participation in events at the Dogfish Inn. Dogfish will not be responsible for loss or damage of property left in your room and/or the Dogfish property during your stay. You are advised to obtain insurance to cover loss of luggage, personal effects, damages, personal injuries and money/valuable belongings. By staying with Dogfish, you acknowledge that (1) you understand that while at the Inn, you may participate in outdoor physical activities and may have exposure to wildlife and that your participation is at your own risk; and (2) you assume all responsibilities of participation both for yourself and any children who accompany you. This waiver applies to all activities at Dogfish, including non-motorized cycling and other outdoor sport rentals (“Sport Rentals”). By using any Sport Rentals provided by Dogfish, you represent and warrant that (1) you understand the nature of bicycling, paddle boarding, surfing, swimming and other outdoor activities; (2) you are qualified, in good health, and in proper physical condition to safely participate in such activities; (3) you understand that such activities are hazardous and entail known and unanticipated risks which could result in serious bodily injury including permanent disability, paralysis, death, or damage to yourself, to property, or to third parties; and (4) you understand that such risks cannot be eliminated by Dogfish without jeopardizing the essential qualities of this activity. By using a Sport Rentals provided by Dogfish, you knowingly, intelligently and voluntarily agree to (1) accept and assume all risk, responsibility, and liability for losses, costs, and damages that you may cause or incur as a result of your use of the Sports Rentals; and (2) to defend, protect, indemnify and hold harmless Dogfish from all claims, actions, proceedings, costs, damages and liabilities, including attorney's fees, arising out of, in any way connected with, or resulting from your use of the Sport Rentals, including the possession, use, operation or return of the Sport Rentals, and including any such claims which allege negligent acts or omissions on the part of Dogfish.  The parties agree this section shall not apply to any equipment rented to Guest by Dogfish under a separate written agreement.

PRIVACY & DATA PROTECTION
Dogfish may retain all personal information you provide during booking. By making a booking with us or using the Dogfish website, you consent to our use and/or disclosure of your personal details to our related corporations, associates, subsidiaries, affiliates, assignees, proposed assignees, agents, commercial partners, service providers and/or any other parties engaged by us to enable or assist us in the provision of services or to exercise or enforce our rights hereunder and/or any other party as Dogfish may, in our sole and absolute discretion, deem necessary for the following purposes: (1) to process your booking and for other administrative purposes; (2) to provide you customer support and services; or (3) to send you information on products and services, and special or promotional offers, newsletters or customer survey forms and questionnaires. You may unsubscribe from these at any time by clicking on the “unsubscribe link” on the relevant email communications. We may also be legally obliged to disclose, and you irrevocably consent to our disclosing, your personal information to government and enforcement agencies, regulatory bodies and public authorities or as may be required by law. This may involve sending your personal information between different countries. We will use our best efforts to use your personal information in the manner stated herein and will not otherwise disclose your personal information without your prior written consent.

COPYRIGHT& TRADE MARKS
The Dogfish Inn website, including the booking and other applications, text, graphics, designs, audio and video clips, hotel and destination information and all other content are the property of Dogfish and/or its content suppliers.
You may use this website and its content solely for personal, non-commercial and private use subject to applicable copyright laws. All trademarks, tradenames, service marks and all other marks, whether registered or unregistered, on the Dogfish website are owned by or licensed to Dogfish and its respective owners and may not be used, reproduced or modified without the prior written approval of Dogfish.

DISCLAIMERS
The Dogfish website, the services provided and all content thereon are supplied "as is" and "as available." Dogfish provides no guarantee regarding the website and content. You are solely responsible for your use thereof.
DOGFISH SHALL NOT BE HELD LIABLE FOR ANY IMPROPER OR INCORRECT USE OF THEMATERIALS OR INFORMATION DESCRIBED AND/OR CONTAINED IN THIS SITE AND ASSUMES NORESPONSIBILITY FOR USER'S USE OF THEM. IN NO EVENT SHALL DOGFISH BE LIABLE FORANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY OR CONSEQUENTIAL DAMAGES(INCLUDING, BUT NOT LIMITED TO, PROCUREMENT OR SUBSTITUTE GOODS OR SERVICES;LOSS OF USE, DATA, OR PROFITS; OR BUSINESS INTERRUPTION) HOWEVER CAUSED AND ONANY THEORY OF LIABILITY, WHETHER IN CONTRACT, STRICT LIABILITY OR TORT(INCLUDING NEGLIGENCE OR OTHERWISE) ARISING IN ANY WAY OUT OF THE USE OF THISSITE OR MATERIALS AND INFORMATION HEREIN, EVEN IF ADVISED OF THE POSSIBILITY OFSUCH DAMAGE. THIS DISCLAIMER OF LIABILITY APPLIES TO ANY DAMAGES OR INJURY,INCLUDING BUT NOT LIMITED TO THOSE CAUSED BY ANY FAILURE OF PERFORMANCE, ERROR,OMISSION, INTERRUPTION, DELETION, DEFECT, DELAY IN OPERATION OR TRANSMISSION,COMPUTER VIRUS, COMMUNICATION LINE FAILURE, THEFT OR DESTRUCTION ORUNAUTHORIZED ACCESS TO, ALTERATION OF, OR USE OF RECORD, WHETHER FOR BREACH OFCONTRACT, TORTIOUS BEHAVIOR, NEGLIGENCE OR UNDER ANY OTHER CAUSE OF ACTION.
The various linked sites on our Dogfish site are provided on an information basis only, and the inclusion of all website links on our website does not imply endorsement of such linked sites, or any association with their operations. These sites are outside the control of Dogfish. We are not responsible for the content on the linked sites or your use thereof.

GOVERNINGLAWS
This Agreement shall be governed and construed in accordance with the laws of the State of Delaware, without giving effect to the choice of law principles therefore, and any dispute shall be brought in the courts located in Sussex County, Delaware. FORCEMAJEURE Except as otherwise set forth herein, neither party shall be responsible for any delay or failure in performance of any part of this Agreement to the extent that such delay or failure is caused by acts of God (such as, but not limited to fires, hurricanes, explosions, earthquakes and floods), acts of the government, pandemic, health crisis, a material interruption in supply chain, war, or terrorist activities.

CHANGESTO THE THESE TERMS & CONDITIONS
Dogfish reserves the right to cancel, amend or vary the arrangements and content featured on the Dogfish website and/or change or add to these Terms and Conditions at any time without prior notice.

CONFLICTBETWEEN ENGLISH TEXT AND OTHER LANGUAGE TEXT
If there is any conflict or discrepancy between the English text of these Terms and Conditions and any translation thereof, the English text shall prevail.
