Terms and Conditions for Lease Serviced By:Kauai Property Solutions L.L.C
Agreement: The individual who made the booking along with the person(s) occupying the property including members of their family, their invitees, guests and employees; will be referred to as the“Guest”. “Property” refers to the real property, its contents, and related amenities rented to the Guest pursuant to this Agreement.“Owner” refers to the legal owner of the Property, its agents and employees. “Kauai Property Solutions” refers to Kauai PropertySolutions L.L.C, its agents and employees. By agreeing to these terms online, you are entering a binding contract with Kauai PropertySolutions, and authorizing Kauai Property Solutions to charge your credit card amounts due.
Rental and Payment: The balance of all payments, plus applicable taxes, shall be paid ninety 90 days prior to your check-in date and will be charged to the card on file unless otherwise arranged. If your booking is made within ninety 90 days of arrival, full payment will be charged to your credit card upon booking. Payments are held in anon-interest bearing Client Trust Account. Reservations not paid in full by the balance due date shall be subject to cancellation without further notice to guest. The guest agrees to have all balances owing after the due date to be placed on the credit card used for the deposit and agrees to the additional $50 convenience fee to be assessed at that time.
Check-In/Check-Out: Check-in is at 3:00 pm and Check-Out is at10:00am. Unless otherwise arranged with the Owner, Agent, or Kauai Property Solutions, the 10:00am check-out time is crucial for the cleaning contractor to perform housekeeping duties. All unapproved late check-outs will be charged a minimum of $250. Guest shall be responsible to return all keys and gate or garage door openers upon departure. A $25 per item fee will be charged for each lost key and $75 for each remote control that is damaged or not left at the Property upon check-out.
Refundable Security Deposit: The security deposit reimbursement will be processed 14 days after departure unless damages or items are reported missing. Kauai Property Solutions retains the right to deduct from the Security Deposit after Guest’s tenancy for expenses or damages including, but not limited to, missing keys and/or electronic door/gate opener, damage to the Property, missing HDMI/internet cables, excessive laundry, staining of towels, linens, furniture, rugs, rearranging of furniture, incurred phone charges. If expenses and/or damages exceed the amount of the Security Deposit, Guest shall be required to pay additional fees to restore the Property to its pre-rental condition within fourteen 14 days of Guest’s receipt of additional billing.
Cancellation Policy/Reservation Changes: Should Guest wish to cancel their reservation the notice of cancellation must be by email, phone, or fax, and will need acceptance and written confirmation byKauai Property Solutions. Each change that results in the issuance of a revised VRA will incur a $75 service charge. Cancellations made more than 60 days are subject to (100%) refund. Cancellations made less than 60 days prior to your scheduled arrival are subject to a $500cancellation fee, and all rent plus tax payments shall be forfeited. In addition, all administrative fees are non-refundable. There are no refunds for early departures, delayed arrivals, construction activity, inclement weather, or reduction in the number of nights reserved for any reason and will not serve to void or cancel the VRA or any portion thereof. Travel Insurance is recommended and if purchased, and need to cancel with 60 days of arrival, Kauai Property Solutions will refund your security deposit, and out-clean fee. No further refunds will be given by Kauai Property Solutions.
Environmental Disclosure: Guest acknowledges the existence of certain risks and dangers to persons and property located in theState of Hawaii, including, but not limited to, environmental hazards, high surf conditions, tidal waves, dangerous riptides, coral reefs, hurricanes, tropical storms, and floods. If a catastrophe or any situation simply beyond our control impairs the vacation rental, KauaiProperty Solutions is not responsible for finding alternate lodging for the renter or for the renter’s financial losses related to transportation or alternate lodging. There will be no refunds for emergency evacuations. In the event of an emergency, the State of Hawaii utilizes a warning alert system (emergency sirens are tested on the first working day of every month at 11:45). Also, be aware Hawaii is a tropical environment and is common to see various insects and animals around and inside he property. Guest may not leave
Safety/Security: Guest acknowledges that Guest should see to their own and to the Property security by locking doors, windows, garage doors, etc. Hawaii is not immune to theft, and in case of theft, the local Police should be called immediately to file a report. KauaiProperty Solutions or the Owner shall bear no responsibility for lost, stolen, damaged, abandoned items. The Owner nor Kauai PropertySolutions is not responsible to relocate due to these circumstances.The Owner nor Kauai Property Solutions shall not be held responsible for any loss, damaged, or additional expense incurred, including reimbursement of rental funds or loss of personal items.
No Smoking: Smoking is not allowed in any of our homes or grounds. Guests found smoking in the home shall be grounds for immediate termination of this Agreement and eviction from theProperty, a $2500 fee will be assessed in addition to the full damage deposit.
Occupancy: Guests staying at the property shall not exceed the published number of adults and children listen in the agreement.Adding additional Guests shall be grounds for immediate termination of this Agreement and eviction from the Property. House parties, events, weddings, receptions, and/or large gatherings are strictly prohibited unless given written consent from Kauai PropertySolutions. Special terms will apply and Guest shall be required to sign a Special Event Addendum. Guests shall not use the Property for illegal or commercial purposes, subletting, assigning, film making or professional photo shoots. Quiet hours are required from 10 pm to8am for all Guests.
Property Condition/Use: Guest acknowledges that the Property, including the furnishings, is privately owned as opposed to a hotel or resort. As such, hotel-like amenities such as daily cleaning and bell
Noise Ordinance: Kauai has a noise ordinance of 9:30 pm. Any infraction of excessive noise could result with immediate contact about disturbance and if continues will result in loss of security deposit. If it further continues after contact and loss of security deposit, Guests will be asked to leave.
Disputes: Any disputes under this Agreement shall be governed by and interpreted in accordance with the laws of the state of Hawaii.Any action relating to this Agreement shall be filed only in the KauaiCounty court in Hawaii in which county the Unit is located. Both parties consent to the exclusive venue and jurisdiction of such court.Guest agrees to pay all reasonable costs and expenses, including, without limitation, attorney's fees and expenses that shall be made or incurred by Manager enforcing this agreement.
Special Services: Services including but not limited to house deliveries, grocery shopping, concierge services, package and mail delivery, fruit baskets, and airport pickup will be billed at a minimum of $40 per hour.
