Terms and Conditions TAGUSMARINA
1. Use of our websitea. This website is available to all customers(hereinafter referred to as "USER", or "CUSTOMER", or as"PASSENGER" in case of purchase of services on this website), subjectto these general terms and conditions (hereinafter referred to as "Conditions").When the USER makes a purchase on the TAGUS MARINA website, or uses the websitein any way, is accepting these Conditions.
b. TAGUS MARINA’s website is property ofMeridian Season, Lda, located at Rua Comandante Cousteau, 11, 1º Esq. 1990-067Lisboa, hereinafter referred to as TAGUS MARINA.
c. The USER declares to be over 18 years ofage and have the legal capacity to comply with the terms of this agreement anduse the TAGUS MARINA website in accordance with these Terms and Conditions,which the USER declares to understand and accept in its entirety.
d. The TAGUS MARINA’s website is only forpersonal use by the USER. Modification, reproduction, duplication, copying,distribution, sale, resale or exploitation of TAGUS MARINA’s website for anycommercial or equivalent purpose is strictly prohibited.
e. The USER agrees not to use the TAGUSMARINA website for illegal or improper purposes. The USER agrees, inparticular, that the products or services purchased through this website areintended for use or own consumption, or the use and consumption of people inwhose name is legally authorized to act. USER may not resell the products orservices purchased through this website to third parties, unless dulycontractually authorized by TAGUS MARINA. TAGUS MARINA reserves the right todeny access to this website at any time without prior notice.
2. Services provided by TAGUSMARINAa. TAGUS MARINA offers the CUSTOMER orPASSENGER the possibility to enjoy services of stay in the Tagus estuary in fullyequipped barges for 2 or 4 people, or to make boat tours in the Tagus estuary,including to the natural reserve areas.
2.1. In the boat toursa. Boat tour tickets are sold by TAGUS MARINAor agents for a specific date and time. Promotional vouchers for boat toursthat are sold by agents without a specific date and time, require the PASSENGERto book a specific date and time by telephone or through email@example.com be used. If the PASSENGER does not show up to embark on the date and time ofthe ticket purchased or agreed with TAGUS MARINA for the use of the promotionalvoucher, TAGUS MARINA reserves the right to cancel the purchase made withoutrefund. For this reason, all PASSENGERS must show up at the place ofembarkation at least 15 minutes before the departure time.
b. TAGUS MARINA strongly recommends its boattours PASSENGERS to adapt their clothes and footwear to the atmosphericconditions and to the ground where the tour will take place.
c. For safety reasons, all instructions andcommands given by TAGUS MARINA crew members, both at the time of embarking anddisembarking and on board the boat, must be complied with and respected.
d. The presentation of the ticket or the promotionalvoucher by the CUSTOMER (in digital or paper format) is mandatory at the timeof embarkation on the boat, if requested by the crew of TAGUS MARINA.
e. PASSENGERS will embark on a first-come,first-served basis, and there will be no marked places at the time of booking.
f. Children under 2 years old are not allowed to embark on boat tours. Achild or teenager between the ages of 2 and 17 years cannot take part on theboat tour without being accompanied by an adult. To enforce this requirement,each adult can accompany a maximum of four children between the ages of 2 and12.
g. Child discount tickets or vouchers arevalid for children between the ages of 2 and 12. TAGUS MARINA reserves theright to request proof of age from any PASSENGER to confirm that the ticketpurchased is in accordance with PASSENGER’s age. If the legitimacy of theticket purchased cannot be confirmed, TAGUS MARINA reserves the right to refuseaccess on board the boat, and there will be no refund of the ticket’s value tothe PASSENGER.
h. TAGUS MARINA reserves the right to refuseaccess on board the boat to people appearing to be drunk or psychically alteredin the opinion of TAGUS MARINA’s crew members, and there will be no refund of theticket’s value to the PASSENGER.
i. TAGUS MARINA reserves the right to refuse access on board the boat toany PASSENGER who, at the time of embarkation, is not able to access the boat'sinterior by his own means under conditions that the TAGUS MARINA’s crew membersconsider of total security, and there will be no refund of the ticket’s valueto the PASSENGER.
j. The boat has no capacity for carrying luggage or other large objects.These items can be stored at the TAGUS MARINA reception for the duration of thetour, but TAGUS MARINA is not responsible for any damage or theft of thoseitems.
k. TAGUS MARINA is not responsible for anyobject left or stolen on the boat, on the facilities of TAGUS MARINA or in theplaces visited during the tours. However, TAGUS MARINA will take the measureswithin its reach so that any object found is stored at the reception for amaximum period of 30 days after the usufruct of the service.
l. TAGUS MARINA will take all measures within its reach so that the boat toursfinish at the scheduled time. However, TAGUS MARINA assumes no responsibilityfor any inconvenience or direct/indirect damage caused to the PASSENGER due to potentialdelays.
2.2. In the services ofstay in fully equipped fluvial bargesa. TAGUS MARINA will provide the CUSTOMER with an anchored fluvial barge ofthe typology booked from the date of arrival or, in case the CUSTOMER has notmade a booking and contracts the accommodation at the TAGUS MARINA reception,depending on the typology and according to availability, from 2 p.m. on the dayof arrival.
b. Upon arrival at TAGUS MARINA, the CUSTOMER must proceed immediately tothe payment of the price due by the barge, number of nights of stay and additionalservices intended, in the case CUSTOMER has not made the full payment to abooking agent.
c. Against full payment, TAGUS MARINA will provide the CUSTOMER with a keyto access the barge that will remain with the CUSTOMER during the contractedstay period.
d. On the date of departure, the CUSTOMER will have to leave the bargevacated of people and goods and without any damage until 12 p.m..
e. If the barge is not vacated until 12 p.m. on the day of departure, itwill be possible to accept a late check-out at no additional cost if thecapacity of TAGUS MARINA allows it and as long as it does not exceed 2 p.m.. Ifso is not possible, the late check-out will cost 50% of the cost of the staybetween 12 p.m. and 6 p.m. In case TAGUS MARINA loses a booking because the customerof the following day is unable to check in because the previous CUSTOMER didnot vacated the barge on time or the check-out lasts after 6 p.m., the CUSTOMERwill have to pay the extra night plus 50% (1.5 nights) as a penalty for damagescaused to the image of TAGUS MARINA, having only the right to use the barge inthat period if TAGUS MARINA has available barges. Otherwise, the CUSTOMER willhave to pay the compensation and leave the barge as soon as possible.
f. Pets are allowed in the barges at no additional charge. The CUSTOMERwill be responsible for any damage caused by animals without value limits.
g. Only the people indicated by the CUSTOMER who made the booking at the accommodationcheck-in will be entitled to use the barge. In case of external visits, theprior communication to TAGUS MARINA is mandatory, and the access to the bargemay be refused.
h. The CUSTOMER must use the barge carefully and with consideration.
i. The CUSTOMER should treat the other TAGUS MARINA’s CUSTOMERS withconsideration and respect the rules of the Marina posted in the place if any, whichare also part of the accommodation agreement.
j. Children and youths under 14 years of age must be supervised by an adultCUSTOMER at all times during their stay on the barge.
k. The CUSTOMER is strongly recommended not to leave money, jewelry orother valuable items on the barge or in parked vehicles in the surroundings ofTAGUS MARINA in his absence.
l. TAGUS MARINA provides the CUSTOMER with a central safe box in which canbe stored valuable objects, as long as they are properly identified in adocument for this purpose.
m. TAGUS MARINA assumes no responsibility for the theft, loss ordeterioration of valuable objects such as money, jewelry or other objects ofconsiderable value if such events occur in the barge or in the interior ofvehicles parked in the surroundings of TAGUS MARINA.
n. TAGUS MARINA will only be responsible for CUSTOMER damages or losses whensuch facts result from the guilty conduct of TAGUS MARINA.
o. TAGUS MARINA does not assume any responsibility for loss of dataprovided by the CUSTOMER in case of electronic transmission of payment data,being only responsible in this case if there is guilty action.
p. TAGUS MARINA assumes no liability for damages or accidents occurringinside the vessels or any part of the Marina unless such accidents are causedby the negligence of TAGUS MARINA.
q. TAGUS MARINA will not be held responsible to the CUSTOMER in case ofdelay in the availability of a barge, while there is valid reason for notmaking it available in a timely manner.
r. For the purposes of the previous paragraph, will be considered validreasons to make it impossible or more difficult to make the barge availableevents such as strikes, blockades, natural disasters, accidents on the bargeitself or in the Marina.
s. In case of delay in the availability of the barge beyond 6 p.m. on theday of the booking, the CUSTOMER can freely terminate the contract withouthaving the right to demand any compensation from TAGUS MARINA in any waywhatsoever.
t. TAGUS MARINA assumes no responsibility for acts committed by any of its employees,unless they are in their normal working hours, duly identified and uniformed asemployees of the company.
u. TAGUS MARINA assumes no responsibility and cannot be liable in any casefor non-fulfillment of ancillary obligations.
v. TAGUS MARINA shall not be liable in any case for any act or omission ofany other CUSTOMER, even if it is liable to cause loss or damage to another CUSTOMER.Any damages caused to third parties by barges’ CUSTOMERS shall be the soleresponsibility of these and completely alien and unrelated to TAGUS MARINA.
w. TAGUS MARINA assumes no liability to the CUSTOMER for any loss ofprofits or indirect damages even if resulting from failure to comply with mainobligations.
3. Services provided on our websitea. TAGUS MARINA, through its website,provides the USER with the possibility of booking services for full use ofanchored barges and boat tours, as well as other specially designed programs inthe field of nature tourism in the Tagus estuary.
b. In this website, we also publish eventsand festivities that take place in Lisbon throughout the year. In this case, weonly disclose its contents and dates, and cannot be associated in any way withthe way they take place or with its organization. We are not, for any purpose,representatives of these events.
4. Insurancesa. Thetours and services offered by TAGUS MARINA are duly covered by insurancepolicies applicable to Maritime-Touristic activities.
b. TAGUSMARINA does not offer the travel insurance service, but encourages the CUSTOMERto carry out such insurance policies directly with an insurance company, beingthat insurance subject to the conditions of the contracted policy.
5. Acquisitiona. Theacquisition of the different services on TAGUS MARINA’s website is subject topayment of the value indicated on the website, without adding undeclaredamounts. The total value of the service will be clearly stated before CUSTOMER clicksthe "book" option.
b. Whenpurchasing services on TAGUS MARINA’s website we will ask you for the immediatepayment in full. When CUSTOMER rents a fully equipped river barge by clickingon the "non-refundable booking" option, CUSTOMER benefits from a discounton the applicable rate, but will not be entitled to a refund of the bookingamount under any pretext. In bookings for boat tours, there is no refund incancellations by the CUSTOMER. Only the immediate payment of the requestedamounts will guarantee the booking of any service.
c. In case the CUSTOMER opts for the “Standard Rate - Free Cancellation upto 7 days before check-in date” option in the rental of fully equipped riverbarges, you can cancel your booking up to 7 days before the date of arrivalwith full reimbursement of the booking amount. The amount will be creditedimmediately. If canceled later than 7 days from check-in date, the total pricewill be charged.
d. In case the CUSTOMER opts for the"10% discount rate - not refundable" option, CUSTOMER will not beentitled to a refund of the amount paid under any circumstances, regardless ofthe reason that may be given for a possible cancellation.
e. TAGUS MARINA reserves the right at anytime and without prior notice to change the prices of the services, as well as tosuspend or to cancel their sale temporarily or definitively, except for therights resulting from the purchases already made by the USER.
f. All services provided by TAGUS MARINA originate the issuance of aninvoice that will be delivered to the USER, CUSTOMER or PASSENGER, according tothe requested and in accordance to the method of acquisition of the service. Inthis way, the invoice can be send by email or delivered personally at the timeof purchase of the service or at the time of closure of accounts. If for anyreason, the USER does not receive the invoice, the USER should contact TAGUSMARINA through firstname.lastname@example.org.
g. The PASSENGER of boat tours is fullyresponsible for the destination of the ticket(s) or voucher(s), namely for itsnon-use, loss, theft or destruction, and cannot by virtue of such facts requireany compensation or indemnification to TAGUS MARINA.
6. Payment methodsa. By purchasing services on our website, theUSER can make their payments by credit card. These payments are made in acompletely safe manner between the USER and the respective payments platform,and TAGUS MARINA does not have access to details such as card number or others.b. By purchasing the services at our direct pointsof sales, the USER can make payments through debit card, credit card or incash. The following currencies are accepted with conversion at the day rate:EUR, USD, GBP, CAD, AUD, BRL and CHF.
7. Fraud in paymentsa. TAGUS MARINA keeps a careful attitude inorder to avoid the improper use of forms of payment, common frauds. In thisway, TAGUS MARINA may require in some circumstances additional informationregarding the form of payment used, namely, among other things, proof ofaddress and copies of identification elements.
8. Cancellations and refundsa. After purchasing a tour or accommodationservice, any cancellation that the CUSTOMER wishes to make is subject to therules expressed at the time of purchase, as well as the general rules describedin these conditions. Any cancellation charges are always dependent on the timeCUSTOMER cancels the tour or accommodation service and the specific productwished to cancel. The best prices always correspond to the strictestcancellation rules, which in many cases can go up to 100% of the amounts paid.
b. In the specific case of boat tours, incase of cancellation of the tour by TAGUS MARINA for reasons of force majeure,namely those related to weather, atmospheric conditions or sea waves, the CUSTOMERwill be contacted by telephone or by e-mail as soon as TAGUS MARINA decides thecancellation of the tour so CUSTOMER can reschedule the tour. In case theCUSTOMER intends to get the refund of the ticket amount, CUSTOMER should informTAGUS MARINA during the telephone call or by e-mail email@example.com.
c. TAGUS MARINA will expedite the refund withthe online booking agent contracted by the CUSTOMER or will return it by banktransfer in case the ticket was purchased directly on the TAGUS MARINA websiteor in person at TAGUS MARINA’s facilities or at one of its agents’ facilities.The CUSTOMER is responsible for providing an IBAN by e-mail to firstname.lastname@example.org TAGUS MARINA to make refunds that may apply.
d. In the event that TAGUS MARINA is requiredto adjust the route initially planned, also due to force majeure issues relatedto weather, atmospheric conditions, sea waves or others, the ticket value willbe refunded in the 50% portion. TAGUS MARINA will proceed to these returns bybank transfer, being the CUSTOMER responsible for providing an IBAN by emailthrough email@example.com.
e. In all cases where after a cancellationthe USER is entitled to receive part or all of the amounts paid, TAGUS MARINAwill proceed to this refund by bank transfer, being the CUSTOMER responsiblefor providing an IBAN by email to firstname.lastname@example.org.
9. Complaints and CUSTOMER supporta. TAGUS MARINA can only consider claims forrendered services related to bookings made on its website if presented inwriting within a period not exceeding 20 days after the end of the service.
b. The USER can send the complaint to TAGUSMARINA electronically via email through email@example.com.
