Terms and Conditions
Guests HEREBY CERTIFY, COVENANT AND WARRANT that they understand and agree to Gap Creek Cabin policies. Guests understand that Gap Creek Cabins reserves the exclusive right to ask guests to leave the property and permanently suspend future privileges for violation of any published or posted rule or regulation or for any reason whatsoever.
Payment and Refund:
- The full amount of guest stay will be collected at the time of booking.
- A full refund will be granted if the reservation is canceled > 3 days before check-in.
- Guests will charged 50% of their total if the reservation is canceled within 3 days of check-in.
- Guests will be charged 100% of their total if the reservation is canceled within 24 hours of check-in.
- Prices are subject to change and guests will be notified beforehand.
Policies:
- Access to our cabins is limited to registered guests only.
- Guests understand that Gap Creek Cabins is a family-centered establishment and maintains a courtesy quiet time curfew after 11 pm.
- Guests understand that consuming alcohol while operating any off-road machine on the property of Gap Creek Cabins is not permitted.
- Guests will follow all rules and safety standards applicable to recreational activities.
- Guests will park in designated parking areas and ride only in graveled areas - stay off the grassy areas.
- Guests will not commit any act which shall interfere with the operation of Gap Creek Cabins.
- Guests will not commit any act that will damage or harm Gap Creek Cabins, its operations or its reputation
Fees:
- Guests understand that pets are not permitted on the grounds. Guests found violating the rule will be charged a $100 fee.
- Guests understand that smoking within the cabins is not permitted and will result in a penalty of $100.
- Guests will be charged a fee of at least $50 for any damage caused during their stay
Waiver of Liability:
In consideration of being permitted to operate an off-road vehicle or travel on the property of Gap Creek Cabins or being permitted to enter for any purpose any RESTRICTED AREA (defined as any area which requires special authorization, credentials or permission to enter, any area to which admission by the general public is restricted or prohibited, including but not limited to the cabin areas or any private property owned by Blake Lowe, their family, and or associates). Guests staying at Gap Creek Cabings, for himself/herself, his/her personal representatives, heirs, and next of kin:
1. HEREBY RELEASES, WAIVES, DISCHARGES, AND COVENANTS NOT TO SUE the property owners, employees, relatives or associates. administrative organizations or any affiliated entities thereof lessors and lessees of premises used to conduct everyday business including underwriters, brokers, consultants, and others who give recommendations, directions, or instructions, or engage in risk evaluation or loss control activities regarding the premises and for each of them, their directors, officers, agents, and employees, all for the purposes herein referred to as “Releasees”, FROM ALL LIABILITY TO THE UNDERSIGNED, his personal representatives, assigns, heirs, and next of kin, FOR ANY AND ALL LOSSOR DAMAGE, AND ANY CLAIM OR DEMANDS THEREFORE ON THE ACCOUNT OF INJURY TOTHE PERSON OR PROPERTY OR RESULTING IN THE DEATH OF THE UNDERSIGNED ARISING OUT OF OR RELATED TO THE OPERATION OF A MOTORIZED VEHICLE, OR WHILE TRAVELING BY HIS OR HER OWN MEANS OF TRANSPORTATION i.e walking, running, on the Gap Creek Cabins Property owned by Blake Lowe. WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE
2. HEREBY AGREES TO INDEMNIFY AND SAVE AND HOLD HARMLESS the RELEASEES and
3. HEREBY ASSUMES FULL RESPONSIBILITY FOR ANY RISK OF BODILY INJURY, DEATH OR PROPERTY DAMAGE arising out of or related to the EVENT(S) whether caused by the NEGLIGENCE OF THE RELEASEES or otherwise
4. HEREBY acknowledges that THE ACTIVITIES OF THE EVENT(S) ARE VERY DANGEROUS and involve the risk of serious injury and/or death and/or property damage. Each of the UNDERSIGNED also expressly acknowledges that INJURIES RECEIVED MAY BE COMPOUNDED OR INCREASED BY NEGLIGENT RESCUE OPERATIONS OR PROCEDURES OF THE RELEASEES.
5. HEREBY agrees that this Release and Waiver of Liability, Assumption of Risk and IndemnityAgreements extends to all acts of negligence by the RELEASEES, INCLUDING NEGLIGENT RESCUE OPERATIONS and it intended to be as broad and inclusive as is permitted by the laws of the Province or state in which the cabins is/are located and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.
I HAVE READ THIS RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND HAVE SIGNED IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT, ASSURANCE OR GUARANTEE BEING MADE TOME AND INTEND MY SIGNATURE TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST ALLOWED BY LAW.
