Villa Punta SamBooking Terms & Conditions General: The following are the terms and conditions applicable to the rental agreement you make with Villa Punta Sam. No amendments or deletions to these terms shall be valid unless expressly accepted and confirmed in writing. The Parties:Hereinafter, the “Guest” refers to the person signing the Booking Agreement. His/Her signature shall constitute acceptance of the following booking conditions on behalf of the guest and every guest on whose behalf he has the authority to sign. The “Owner” refers to Villa Punta Sam Owner´s, Management and Staff. The Agreement: The Booking Agreement shall not become binding until the Owner has received therental deposit along with the signed Booking Agreement. The Owner reserves theright to cancel the reservation with no refunds if the signed booking agreement is not returned prior to the Guest’s arrival date. Credit Card On File: The Guest is required to provide the Owner with a valid credit card number as additional collateral to any loss, damages or unpaid services during the time or occupancy of the Guest.At the end of the rental period the Owner reserves the right to charge the subsequent amounts to the Guest’s credit card should there be any damages or lost items not deducted from the Security Deposit. The Guest will be notified before any charges are applied to his/her credit card Use of Villa: The Guest may not use the Villa for any purpose other than that of a private holidayresidence for the accommodation of the Guest and his guests unless otherwise agreed upon in writing by the Owner. The Guest shall not engage in any activity or practice that may be or become a nuisance or annoyance to the Owner, or the occupants of adjoining land, or that might invalidate any insurance policies affected on the Villa, and shall not bring any animals to the property (unless otherwise agreed upon in writing by the Owner). This agreement can be terminated by the Owner immediately following any breach of the terms by the Guest. Any change or amendment to this agreement, including, without limitation, an increase or decrease in the number of both day-time guests and night-time guests, or an increase, decrease or other change to the rental period, must be made in conformity with the provisions of this agreement and, in all cases, is subject to the prior written approval of the Owner, which approval may be withheld at its sole discretion. The Owner reserves the right to charge the Guest if the number of people residing at the Villa exceeds the number of people in the contract. The Owner’s Responsibilities: You hereby release and agree to hold the Owner, their management, employees, representatives, agents and volunteers harmless from and against all liability and responsibility whatsoever, for any damage to property, personal injury or loss of lifewhich may occur to you or your guests as a result of your use of the villa and its amenities, and you do hereby agree to indemnify the Owner from and against any costs, judgements, claims or demands, including reasonable legal fees as a result of any third-party actions arising from you and your guests use of the villa and its amenities including the swimming pool and roof terrace. The Owner does not accept anyresponsibility for the actions of the Guest any other third parties or their respective agreements, or for any consequences due to their actions.You and your guests are responsible for securing your own personal property including jewelry and other valuables. Safety boxes are available in each room. Complaints:The Owner is not responsible for issues out of their control such as the failure of the water supply, gas, electricity, telephone and WIFI service, pool filtration system, hot tub, air conditioning, television and cable service, appliances, etc., though they will endeavor to arrange for these problems to be solved upon notification. If you or your guests have any problem during your stay, you or your guests must notify the Owner or property manager immediately. The Owner will not attend any claim for compensation after you have returned from vacation if you have not recorded the problem with the Owner during the stay. Complaints files only after vacating the property cannot be taken into consideration. Your Responsibilities:You are solely responsible for all damages, injuries and losses in connection withthe occupancy or use of the property by you or your guests. You must ensure that the Property and all furniture fixtures and effects remain in the same condition and location as when you checked-in. No furniture or artwork may be moved at any timewithout the owner’s permission. Passport requirements: Entry requirements vary. It is your responsibility to verify you have the correct documents and /or entry VISA Smoking Policy: Smoking is NOT allowed. Kindly note that, for the comfort of all guests, Villa Punta Sam is a non-smoking property and a cleaning fee of $500USD will incur upon breach of this policy for EACH room that smells of smoke. Tidiness & Damage: The Guest shall respect and ensure that the Villa and all furniture, fixtures and effects are in good order and condition (fair wear and tear expected) and shall promptly inform the Owner or the staff of any damage caused to the property or its contents during the period of occupation by the Guest. The Guest shall incur all charges for such damage and for any missing items.
