Terms and Conditions
1) GUESTS must be 21 or older to rent a room. Renter confirms that at least one guest, who will be at he cabin throughout the rental period, is at least 21 years of age or older.
2)ROOM RATES are subject to change and are subject to a 13% Tax collected by the City of Tom Bean.3 MAXIMUM OCCUPANCY rules need to be kept in mind- Guest agrees that the premises shall be occupied by no more than the number of people paid for and stated herein. Occupancy is limited to registered guests only. Absolutely no overnight guests are allowed. Going over the max occupancy as the stated number of guests will result in the termination of the rental or extra charge to extra guest fees. Please notify us at least 24 hours prior to arrival if your cabin guest count changes.
4)CHECK-IN/CHECK-OUT TIME: Guest acknowledges and understands that check-in time is no earlier than 1:00PM.You are welcome to check with us the night before to see if arriving any earlier on the arrival date is possible. Once full amount for stay is paid, an email will be sent to guest for a seamless check-in experience. Check-out time is no later than 11:00am on the date stated in the rental period. Housekeeping needs adequate time to prepare the property for the next guest. Guests not leaving by stated check-out time, without permission, will be assessed a rate of $50.00 per hour.
5)LASTMINUTE BOOKINGS can not ALWAYS be accommodated. Please help us make a memorable experience and book ahead of time. PROPERTY DAMAGE & ROOM POLICY: Please Note that guest acknowledges and understands that he/she is financially responsible for all property damage that may occur during the stated rental period which can be reasonably attributed to the rental party’s negligence or abuse. Linens and towels are not gifts and should always remain in your rental. We want you to have a great time when you are here. But ifthings get too crazy, we go by the old-school rule of ‘you break it, you buy it’ and property damages or missing items will be charged to your credit card at market value. Pre-existingdamages or room issues must be reported to the front desk immediately afterregistration to avoid responsibility and potential charges. The hotel allowsguests, with permission, to receive occasional packages and special deliveriesat the property.Weare not responsible for the packages or their contents or the storage of them.Sing your heart out and have passionate conversation all day long, but from11:00 p.m. to 7:00 a.m. the whole property goes into hush mode for what we liketo call quiet time (or sleep time).Please practice safe cooking habits do not leave burners onunattended in kitchens indoors or outdoors. Please do not cook with strongsmelling ingredients. Lingering smells that require room closure and deepcleans will be charged a cleaning fee of up to $150.6)DISPUTES: ThisAgreement shall be governed by and interpreted in accordance with the laws ofthe State of Texas and shall be treated as though it were executed in theCounty of Grayson, State of Texas. Any action relating to this Agreement shallbe instituted and prosecuted only in the Grayson County Superior Court, Texas.Guest(s) specifically consents to such jurisdiction and to extraterritorialservice of process
7)NO FIREARMS – NOFIREWORKS – NO ATVs: The occupancy and use of the premises shall not besuch as to place the property in danger of damage or to disturb and/or offendarea neighbors or residents. We reserve the right to terminate thisagreement and request loud or unruly guests to vacate the premises immediately. Said discharge shall not result in the refund of any rental fees.
8)EARLY DEPARTURE/LATEARRIVAL POLICY: No refunds will be made for early departures or delayedarrivals. No refunds or schedule changes will be made due to inclement weatheror acts of God.
9)NO SMOKING: All Cabins arenon-smoking cabin. If it is found that any member of the rental party, orguest of the rental party, has smoked inside the cabin you will be chargeda $150 cleaning fee. The entire cabin is designated as a No Smoking Area
10)PET POLICY: We have a 25USDfee for pets in our cabin to help us clean up any hair or shedding from pet. Weask no more than 2 pets per cabin. We do have pet free homes. Guest is fullyresponsible to pick up after pet, never leave pet unattended, and to be kept ona leash and outside of pool areas (that’s the health department’s call and wehave got to heed their rule! They are more than welcome to take a dip in DreamLake) Guest is responsible for any fees due to potty accidents, propertydamage, or incidents.
11)WILDLIFE: The cabinis in the hills of North Texas. As such, you are likely to encounterwildlife (deer, raccoons, snakes, and bugs of various types, including waspsand/or hornets, etc.…). Best Day Ever Ranch, LLC, will not acceptresponsibility for any injury caused by said wildlife.
12)HOLD HARMLESS: Cabin guest acknowledges andunderstands that every guest, or guardian, is solely responsible for anyaccident or injury to any person while in-residence, and that the Owner accepts NO legalor financial responsibility. Cabin guests and guardians assume allrisk of injury or other loss resulting from any recreational activity and willhold the Owner harmless with respect thereto. Cabin guest(s) herebyagrees to indemnify and hold cabin referred to as The Best Day Ranch Cabin orits property management harmless from any and all claims, including those ofthird parties, arising out of or in any way a result of the cabin guests use ofthe premises or items therein.
13) PARKING POLICY: Vacations should bestress-free and for that reason, you get to park right in front of your room(or super close). By parking a vehicle at our facility, you (and your guests)are doing so on your own accord. The hotel does not take responsibility or acceptliability for damage, accident or loss to your vehicle or personal property. DONOT park in the grass next to your cabins, there is a parking space. We ask ifyou have an extra vehicle, park in the designated event or overflow parking.
14)Best Day Ever Ranch is compliant with theAmericans With Disabilities Act (ADA). We offer accessible rooms. Please ensurerequests reach us by placing it in the comments section of the onlinereservation form, or by calling us directly at 903.546.6424 after thereservation has been made.
15) LOSS OF PERSONAL ITEMS: Cabinguest acknowledges and understands that each guest, or guardian, is solelyresponsible for any loss by any person while in residence including the loss ofmoney, jewelry or any other personal item. We will do our very best to returnany lost or forgotten items at guest(s) expense.
16)Ownerswill not be held responsible for the failing of any other company service dueto said company’s error or service interruption (i.e. electricity, satellite,water, gas, etc..). However, we guarantee that we will do all that is humanlypossible to remedy any issue in the shortest time possible.
17)HOMEFURNISHINGS, EQUIPMENT, ETC. – Moving of any furniture or decor is notallowed. Furniture, bedding, linens, towels, utensils, or any other propertybelonging to the owner will not be removed from the premises for ANY reason.Please do not bring any inside furniture or chairs outside or onto the porches.Loss of these items, as well as damage to any property or furnishings in excessof normal wear and tear, will be charged to the guest(s).
18) KEYS: All keys must be returned to Management upon your final departure. Please be surethat all doors are locked. Cabin guest(s) are responsible for cost ofre-keying if locksmith is required to come out due to lost or non-returnedkeys.
19) FIRES: NO ASH PRODUCING FIRES are permitted outside of designated fire pits and camp grills. For Camping, Cabin, and Home guests, you may use containerized fuel stoves that can be turned off for cooking. No hammocks allowed in primitive camping areas. Designated Fire pits are rented (not to be moved) or at the Recreation Hall at the communal Fire Pit.
20)CANCELLATION POLICY: Cancellations made 14 or more days prior to arrival will result in a full refund of the rental deposit. Cancellations made lessthan 14 days’ notice, prior to arrival date will result in the forfeiture ofone-half of the rental deposit.
