Terms and Conditions
1) GUESTS must be 21 or older to rent aroom. Renter confirms that at least one guest, who will be at the cabinthroughout the rental period, is at least 21 years of age or older.2) ROOM RATES are subject to change andare subject to a 13% Tax collected by the City of Tom Bean.3) MAXIMUM OCCUPANCY rules need to be keptin mind- Guest agrees that the premises shall be occupied by no more than thenumber of people paid for and stated herein. Occupancy is limited toregistered guests only. Absolutely no overnight guests are allowed.Going over the max occupancy as the stated number of guests will result in thetermination of the rental or extra charge to extra guest fees. Please notify usat least 24 hours prior to arrival if your cabin guest count changes.
4) CHECK-IN/CHECK-OUT TIME: Guestacknowledges and understands that check-in time is no earlier than1:00PM.You are welcome to check with us the night before to see if arriving anyearlier on the arrival date is possible. Once the full amount for stay ispaid, an email will be sent to guest for a seamless check-in experience.Check-out time is no later than 11:00am on the date stated in the rentalperiod. Housekeeping needs adequate time to prepare the property for the nextguest. Guests not leaving by stated check-out time, without permission, will beassessed a rate of $50.00 per hour.
5) LAST-MINUTE BOOKINGS cannot ALWAYS beaccommodated. Please help us make a memorable experience and book ahead oftime. 6) PROPERTY DAMAGE &ROOM POLICY: Please Note that guest acknowledges and understands that he/she isfinancially responsible for all property damage that may occur during thestated rental period which can be reasonably attributed to the rental party’s negligenceor abuse. Linens and towels are not gifts and should always remain in yourrental. We want you to have a great time when you are here. But if things gettoo crazy, we go by the old-school rule of ‘you break it, you buy it’ andproperty damages or missing items will be charged to your credit card at marketvalue. Pre-existing damage or room issues must be reported to the front deskimmediately after registration to avoid responsibility and potential charges. Weoccasionally allow guests, with permission, to receive occasional packages andspecial deliveries at the property. Weare not responsible for the packages ortheir contents or the storage of them. Sing your heart out and have passionateconversation all day long, but from11:00 p.m. to 7:00 a.m. the whole propertygoes into hush mode for what we like to call quiet time (or sleep time). Pleasepractice safe cooking habits and do not leave burners on unattended in kitchensindoors or outdoors. Please do not cook with strong smelling ingredients.Lingering smells that require room closure and deep cleans will be charged acleaning fee of up to $150.7) DISPUTES: This Agreement shall begoverned by and interpreted in accordance with the laws of the State of Texasand shall be treated as though it were executed in the County of Grayson, Stateof Texas. Any action relating to this Agreement shall be instituted andprosecuted only in the Grayson County Superior Court, Texas. Guest(s)specifically consents to such jurisdiction and to extra territorial service of process. 8) NO FIREARMS – NOFIREWORKS –NO ATVs: The occupancy and use of the premisesshall not be such as to place the property in danger of damage or to disturband/or offend area neighbors or residents. We reserve the right toterminate this agreement and request loud or unruly guests to vacate thepremises immediately. Said discharge shall not result in the refund of anyrental fees.
9) EARLY DEPARTURE/LATEARRIVALPOLICY: No refunds will be made for early departures or delayed arrivals.No refunds or schedule changes will be made due to inclement weather or acts ofGod.
10) NO SMOKING: All Cabins are non-smoking cabins. If it is found that any member of the rental party, or guest of the rentalparty, has smoked inside the cabin you will be charged a $150 cleaningfee. The entire cabin is designated as a No Smoking Area
11) CLEANING: A) all trash is to be the trash cans, no dirty dishes left, and all food isdisposed of or excess mess should be left in our cabins or homes. We askthat our accommodations are kept tidy the way given, and trash is disposedof in the outside cans provided or (if excess) in our dumpster behind theoffice before departure. TRASH, EXCESS MESS, LITTERING, DIRTY DISHES willresult in cleaning fees up to $150.
B) Group stays will have an additional cleaning fee of $50per accommodation. This cleaning fee will be refunded if accommodation is lefttidy.
12) PET POLICY: We have a 25USD fee forpets in our cabin 50USD for homes, to help us clean up any hair or sheddingfrom pet. We ask for no more than 2 pets per cabin. We do have allergen free accommodations,please inform, and ask of us pets coming to the property. Guests are fully responsible to pick upafter pets, never leave pets unattended, and to be kept on a leash and outsideof pool areas (that’s the health department’s call and we have got to heedtheir rule! They are more than welcome to take a dip in Dream Lake) Guest isresponsible for any fees due to potty accidents, property damage, or incidents.
13) WILDLIFE: The cabin is in thehills of North Texas. As such, you are likely to encounterwildlife (deer, raccoons, snakes, and bugs of various types, includingwasps and/or hornets, etc.…). Best Day Ever Ranch, LLC, will not acceptresponsibility for any injury caused by said wildlife.
14) HOLD HARMLESS: Cabin guestacknowledges and understands that every guest, or guardian, is solelyresponsible for any accident or injury to any person while in-residence,and that the Owner accepts NO legal or financialresponsibility. Cabin guests and guardians assume all risk ofinjury or other loss resulting from any recreational activity and will hold theOwner harmless with respect thereto. Cabin guest(s) hereby agrees toindemnify and hold cabin referred to as The Best Day Ranch Cabin or itsproperty management harmless from any and all claims, including those of thirdparties, arising out of or in any way a result of the cabin guests use of thepremises or items therein.
15) PARKING POLICY: Vacations should be stress-free and for that reason, you get to park rightin front of your room (or super close). By parking a vehicle at our facility,you (and your guests) are doing so on your own accord. The hotel does not takeresponsibility or accept liability for damage, accident or loss to your vehicleor personal property. DONOT park on the grass next to your cabins, there is aparking space. We ask if you have an extra vehicle, park in the designatedevent or overflow parking.
16) Best Day Ever Ranch iscompliant with the Americans With Disabilities Act (ADA). We offer accessiblerooms. Please ensure requests reach us by placing it in the comments section ofthe online reservation form, or by calling us directly at 903.546.6424 after thereservation has been made.
17) LOSS OF PERSONAL ITEMS: Cabinguest acknowledges and understands that each guest, or guardian, is solelyresponsible for any loss by any person while in residence including the loss ofmoney, jewelry, or any other personal item. We will do our very best to returnany lost or forgotten items at guest(s) expense.18) Ownerswill not be held responsible for the failing of any other company service dueto said company’s error or service interruption (i.e. electricity, satellite,water, gas, etc..). However, we guarantee that we will do all that is humanlypossible to remedy any issue in the shortest time possible.
19) HOMEFURNISHINGS, EQUIPMENT, ETC. –Moving of any furniture or decor is not allowed. Furniture, bedding, linens,towels, utensils, or any other property belonging to the owner will not beremoved from the premises for ANY reason. Please do not bring any insidefurniture or chairs outside or onto the porch. Loss of these items, as well asdamage to any property or furnishings more than normal wear and tear, will becharged to the guest(s).
20) KEYS: All keys must be returned toManagement upon your final departure. Please be sure that all doors arelocked. Cabin guest(s) are responsible for cost of keying if locksmith isrequired to come out due to lost or non-returned keys. Lost or missing keyswill result in an automatic $10 fee.
21) FIRES: NO ASHPRODUCING FIRES are permitted outside of designated fire pits and campgrills. For Camping, Cabin, and home guests, you may use containerized fuelstoves that can be turned off for cooking. No hammocks allowed in primitivecamping areas. Designated Fire pits are rented (not to be moved) or at theRecreation Hall at the communal Fire Pit.
22) CANCELLATION POLICY: Cancellations made 14 or more days prior to arrival will result in a fullrefund of the rental deposit. Cancellations made less than 14 days’ noticeprior to arrival date will result in the forfeiture of one-half of the rentaldeposit.
