Property and Cancelation Policies :
CANCELLATION POLICY:  Guest shall inform Agent in writing of Guest’s intention to cancel any part of the reservation. For reservations made through third parties, additional cancellation policies may apply. Our cancellation policy is as follows: 1)      If Cancellation notice is received 7+ days prior to check-in date, Guest will be charged a cancellation fee equal to 30% of the Reservation Total.  The balance will be refunded within 7 days from receipt of written cancellation. 2)      If Cancellation notice is received less than 7 days (0-6) prior to check-in date, the full booking amount of rent and taxes will be forfeited. 3)      Owner/Agent Cancellation Policy: In the unlikely event that the Property becomes unavailable for any part of the tenancy for reasons beyond the control of the Agent, Owner and/or Agent may cancel this Agreement and refund in full to the Guest all payments made. Agent will assist the Guest in procuring similar accommodation should this situation arise. Guest agrees that any claims against Owner/Agent for any reason arising under this agreement shall be limited to a full refund of all consideration previously tendered by Guest.   CHANGE POLICY: Any request to change dates will be based on availability and timeliness of the request. Requests to change dates made more than 7 days prior to arrival will be made without penalty. Change requests made 0-7 days prior to arrival will require Agent approval, a $25 Reservation Change Fee and if there is any reduction in the number of nights booked, guest will not be eligible for a refund on these nights as the standard Cancellation Policy would apply, as shown above. 1)      EXTENSION: The length of your stay may be extended subject to availability; however, there will be additional rental charges, taxes, and cleaning fees collected prior to the extension start date in order to confirm extension. 2)      REDUCTION: All reductions in your length of stay must be submitted in writing more than 7 days prior to arrival. Adjustments in nightly rental rate may apply when reducing the total number of nights rented. Reductions in your length of stay made 0-6 days prior to arrival will not result in a refund or reduction of rent and taxes.  Any reductions requested for weekend stays must meet the 2 night minimum requirement or the second night will still be charged. 
Terms and Conditions

Terms and Conditions All online bookings are subject to Agent approval, and will be confirmed or declined within 24hours. Rates and fees are subject to change.  TERMS: The following definitions will apply: “Agent” refers to River Row Flats, Inc dba River Row Flats Boutique Vacation Rentals. “Owner” refers to the legal owner of the property; “Guest” refers to the person or persons occupying the Property; and “Property” refers to the real property, its contents and related amenities rented to the Guest.  
RENTAL REQUIREMENTS: For legal and accounting purposes, the person placing the reservation must be the same as the credit/debit card holder. This person is considered to be the Guest. All other persons involved with the rental are considered to be the Guest’s invitees, and all discussion regarding reservation, cancelation, and damage policies will be discussed with the Guest, not the Guest’s invitees. The Guest is solely responsible for all costs, expenses and fees related to the rental, including all damages and other costs incurred by Guest's invitees.  The Guest understands that River Row Flats rents to responsible adults over the age of 21 ONLY.  Guest authorizes a charge to their credit card of $20.00 for each invitee in excess of the number identified at booking.  
CREDIT CARD POLICY: A credit card is required and is used for payment for all incidentals and other charges in connection with your stay. Please see Guest Acknowledgement and Credit Card Authorization.  
BOOKING DEPOSIT PAYMENT: A 30% Booking Deposit of the total charges is required to confirm the reservation. The Final Balance is due 3 days prior to arrival. Any reservations made within 3 days of arrival must be paid in full prior to arrival to confirm your reservation.  
FINAL BALANCEPAYMENT, IF APPLICABLE: The final balance for your reservation is due 3days prior to check-in. If you do not make other payment arrangements, your credit card on file will automatically be charged the final balance on the due date. If you plan on using a different payment method to pay the final balance, please contact the Property Manager.  
DAMAGE POLICY: As a condition to the rental of the Property, Guest agrees that their credit card may be charged for any and all losses and damages sustained to the Property throughout the duration of Guest's occupancy caused by Guest or their invitees. These charges may include, but are not limited to, extraordinary cleaning fees, costs of eviction, service calls or charges, fines or assessments, repairs or replacements, plus all applicable taxes. Agent may require a refundable Incidental Deposit for damage to the Property.  The entire deposit will be refunded if:
1)No damage is done to the Property other than reasonable wear and tear,
2)No items are missing,
3)All doors and windows are closed and secured upon departure from the Property,
4)All check-out procedures are followed,
5)All Rental Agreement policies are followed,
6)No miscellaneous charges are incurred, e.g., unpaid rental fees, pets in unauthorized rooms, additional cleaning fees, or other charges. If the Guest or their invitee causes damages that exceed the Incidental Deposit (if any), Guest authorizes River Row Flats to charge the Guest’s credit card for the difference. Upon request, an itemized statement outlining all associated costs will be sent via regular or electronic mail to the address submitted by the Guest at such time as the reservation was booked.  
UPON ARRIVAL: Take a look around the Property. If you have any concerns about or issues with the Property, please contact the Agent immediately (leave a message if there is no answer). Contact information can be found on the Information Page in your unit. No refunds or considerations are given unless we are notified of problems during your stay. Upon request, we will provide a form for you to document any pre-existing damage so you won’t be held responsible.  
EMERGENCIES/MAINTENANCE: In the event of a problem getting in the Property or if there are problems with condition or functionality of the Property, please immediately contact the Agent (leave a voice message and send a text if there is no answer). Agent’s contact information is listed in the Arrival Instructions you sent prior to check-in. 
ARRIVAL TIME: Arrival times vary. Please refer to your Arrival Instructions. Unless you have specifically arranged for an early arrival time, please do not arrive at the property before your scheduled check-in time, as the Property may not be available before your arrival time.  
DEPARTURE TIME: Departure times vary. Please refer to your Arrival Instructions. Your prompt departure is appreciated so we can prepare the Property for any incoming guests. If you have not arranged for a late check-out, you may be charged $35 for each hour you stay beyond your check-out time, in blocks of one hour. If you have not vacated the Property by 2 pm, you will be charged the rental rate for an additional day.  
NO SMOKING:  Smoking/Vaping  is strictly prohibited anywhere at the Property or River Row Flats other than the designated smoking area. Guest is responsible for any damage caused by cigarettes and/or cigarette smoke, marijuana and/or marijuana smoke. No vaping is allowed in the units. A fee up to $250.00 will be assessed.  
POWER/WEATHER RELATEDCANCELLATION: River Row Flats does NOT issue refunds due to acts of nature such as: weather, road conditions, hurricanes, power outages, etc. If the property is deemed uninhabitable due to such circumstances, reservations can be rescheduled for future dates within one year of the reservation date. If the new dates are booked at a higher rental rate, you are responsible for paying the difference in the rental rates. If the new dates are booked at a lower rental rate, adjustments will be made.  NOISE: Quiet hours are from 9 pm to 7 am.  Please respect your neighbors by refraining from excessive or loud noise that may be heard outside the Property.  If neighbors in River Row Flats are making excessive noise, please contact the Agent.  River Row Flats is not responsible for any noise off-property.  
PRIVATE PROPERTY: Guest acknowledges that the accommodation is a privately-owned property as opposed to a hotel. As such, hotel amenities such as daily cleaning and bell service are not provided. Additional services can be requested with advance notice at an additional cost.  
REPAIR AND SERVICECALLS: Agent and Owner do not guarantee against mechanical or electrical failure or air conditioning, fans, lights, televisions, or other equipment. Guest agrees to report any inoperative items to Agent promptly, and Agent agrees to make every effort to have maintenance done quickly and efficiently. No refund of rent reduction will be made due to the failure of such equipment.  
LEFT ITEMS: Please check carefully for belongings before you leave. Upon request, left items can be mailed to you at your expense. River Row Flats is not responsible for lost or stolen items.  
RIGHT TO ENTER: If necessary, Owner or Agent or their designated vendors may enter the Property to inspect it, make repairs or perform required maintenance. Owner or Agent will give Guest at least 24 hours notice before entering the Property except in emergency.  Where possible, all repairs will be performed during business hours. Scheduled cleaning services may enter during normal business hours.  
OCCUPANCY: The Property is for the sole use as a personal vacation residence for families and responsible adults. Guest acknowledges that they will personally occupy the Property for the entire length of stay and will not sublet. Guest shall not use the Property for any illegal or unlawful purpose, nor shall the Property be used in a fashion that disturbs or offends the neighbors. Occupancy is restricted to the number set forth at booking, not to exceed 4 guests per Property. A list of the first and last names of ALL persons occupying the property is required at the time of booking. Guest will be charged an additional fee for unidentified guests. 
MAIL AND DELIVERIES: River Row Flats is not responsible for mail or deliveries sent to the property before, during, or after Guest stays. Guest(s) hereby acknowledge that mail ma ynot be deliverable to certain units, and in no circumstance will River Row Flats be held responsible for mail that is lost, damaged, delayed or returned to sender.  
SPECIAL REQUESTS ANDSERVICES: Any special services requested by the Guest(s) which the Agent is able to perform, may be performed at an additional cost, plus applicable taxes, with prior agreement between Guest(s) and Agent.  
CLEANING FEE: A departure cleaning fee will be added and agreed to upon booking. This will be included in the total cost of the reservation. Should the guest request any cleaning services throughout the dates of the reservation prior to departure, an additional cleaning fee in the amount of $25.00 will be issued. For long term guests (staying 30 days or greater) a departure cleaning fee of $125.00 will be added to the cost of the reservation. Should the tenant request additional cleaning during the duration of the reservation, a cleaning fee of $25.00 will be at an additional cost to the departure cleaning fee. Should the tenant request clean sheets and towels, those will be provided for the guest to change out themselves free of charge.  
PETS:  Guests may have up to two pets under 60lbs at the Property upon approval by Agent with a $75.00 non-refundable pet fee.  Pets are permitted in ground floor units only.  Guest is responsible for cleaning up after their pet. Pets are not allowed use of the bed but pet beds are provided. Guest is responsible for any damage caused to the Property by a pet. Guest authorizes Agent to charge Guest's credit card for the cost to repair any damage caused by the pet, including a cleaning fee for an unauthorized pet in the amount of $75.00. This policy does not apply to service animals accompanying a disabled guest, as defined by the Americans With Disabilities Act.  
INDEMNIFICATION ANDHOLD HARMLESS:  Neither Agent nor Owner is responsible for any accidents, injuries, or illness incurred at the Property.  Guest agrees that they shall indemnify, release and hold River Row Flats, its agents, employees and owners, harmless from any claims, damages, or loss to Guest, their invitees, heirs or assigns related to the Property.  Guest agrees that in the event of any dispute arising under these Terms and Conditions or Guest's agreement to rent the Property, the substantially prevailing party shall be responsible for all costs and reasonable attorney's fees incurred in any civil action.  Guest further agrees this agreement will be governed by the laws of the State of North Carolina.  Any claims or disputes under this agreement will be heard in the North Carolina Courts of Justice in Asheville, Buncombe County, North Carolina.   VIOLATIONS OF TERMS AND CONDITIONS MAY RESULT INCANCELLATION OF THE REMAINDER OF YOUR STAY WITHOUT COMPENSATION, IN ADDITION TOTHE CHARGES TO YOUR CREDIT CARD STATED ABOVE. 
GUEST ACKNOWLEDGEMENTAND CREDIT CARD AUTHORIZATION By confirming a reservation with River Row Flats, Inc dba River Row Flats, I agree and acknowledge that I have read, understand and accept all of the terms set forth above including, without limitation, the Cancellation Policy. I acknowledge that the property has specific Unit Rules that will be provided to me at time of confirmation of the reservation, if not previously provided. I agree to abide by the restrictions stated in the Unit Rules for the property, as well as terms of this agreement. I understand that River Row Flats is an agent for the owner. I further understand and represent that I will explain the Terms and Conditions to all individuals in my group prior to their arrival. I am solely responsible for all costs, losses and damages caused by the failure of any invitee to abide by the Terms and Conditions. I authorize River Row Flats to charge the card I’ve provided for payment of my reservation and/or any additional requested rental expenses incurred, and to pay for those incidentals, damages or excessive cleaning expenses incurred. I also hereby confirm that the number of guests will NOT be more than stated in this agreement at any time and that violation of this policy will result in my credit card being charged maximum occupancy or double the guest fees, whichever is greater.
