These Terms and Conditions (Terms) set out the basis on which Premier Suites Griffith Pty Ltd will provide accommodation and other products and services at its Hostel to Customers and Guests.  By making a Booking the Customer agrees to comply with these Terms.

1.    
Definitions
 Booking means the reservation by the Customer of accommodation and any other products and services detailed in the Booking which is accepted by Premier Suites Griffith Pty Ltd.
Customer means a person who makes a Booking.
Fees means the fees payable by the Customer in connection with the Booking.
Guest means the Customer and any third parties they invite to the Hostel in connection with the Booking.
Hostel means the hostel owned or operated by Premier Suites Griffith Pty Ltd, the location of which is specified in the Booking. 

2.    
Bookings
 

2.1    Customers can request a Booking via Premier Suites Griffith’s website or by contacting Premier Suites Griffith’s staff at the Hostel.
2.2    At the time a Customer requests a Booking, they will be required to provide identification information such as their name, address, contact telephone number and email address.
2.3    A Booking is deemed to have been accepted by Premier Suites Griffith when it provides a booking reference.  It is at this point that a contract between Premier Suites Griffith and the Customer in connection with the Booking will come into existence.
2.4    Premier Suites Griffith Pty Ltd does not accommodate any request from the Customer to change Booking details such as the number of Guests, the number of rooms required or the duration of Guests’ stay at the Hostel.  The Customer must ensure to correctly enter this information at the time of Booking.
2.5    When booking beds in a shared room, Premier Suites Griffith will use its reasonable endeavours to put people on the same booking in the same room, but this cannot be guaranteed to happen.

3.    
Fees and payment

3.1        Fees will be quoted in Australian dollars by Premier Suites Griffith to the Customer at the time the Customer requests a Booking.
3.2        Unless otherwise agreed, Fees cover the provision of accommodation at the Hostel.  Any other products and services (e.g. meals, drinks and wireless internet) used by the Customer may incur additional fees (Additional Fees).  These Additional Fees will be quoted to the Customer prior to the Customer’s use.
3.3        Bookings must be prepaid in full at the time of Booking.  Where there are Additional Charges, these must be paid either as they are incurred or, at the discretion of Premier Suites Griffith, at the time the Customer checks out at the Hostel.
3.4        At check in, Customers must pay a bond, which will be held for the duration of stay, to cover (amongst other things) damages to the Hostel.
3.5        Payment may be made by credit or debit cards. 

4.    
Cancellation
 

4.1        Where the Customer cancels a Booking, or does a no show, the full amount paid for the Booking and any Additional Fees will be forfeited.
4.2        On the rare occasion that Premier Suites Griffith must cancel a Booking due to circumstances outside its control, Premier Suites Griffith will refund to the Customer the full amount paid for the Booking and any Additional Fees. 

5.    
Check in and check out
 

5.1        Check in time for all Bookings at the Hostel is from 2pm to 5pm.  If the Customer expects to arrive after this time, please let us know by contacting our reservations teams at admin@premiersuitesgriffith.com.au otherwise we may treat the Booking as a cancellation and/or no show.
5.2        Check out time for all Bookings at the Hostel is 10am.
5.3        Early check ins and late check outs may be possible by prior arrangement with an additional charge and subject to availability.
5.4        Where there is no prior arrangement, failure to check out at 10am may incur an additional charge.

6.    
Age & identification
 

6.1        Guests must be aged 18 years and over to stay at the Hostel.  Guests will be required to show photo identification at check in.  Acceptable forms of photo identification include passport, driver licence and proof of age card.  We may refuse your check in if you do not meet our age requirements or you do not provide adequate photo identification.

7.    
Warranties

7.1        To the fullest extent permitted by law, any condition or warranty which would otherwise be implied into these Terms is excluded.
 
7.2        We do not warrant that this website, its servers or emails sent from us are free of viruses or other harmful components. 
7.3        We will not be liable for any damage of any kind arising from the use of this website including but not limited to direct, indirect, special, incidental or consequential damages. 

8.    
Limitation of liability

8.1        Nothing in these Terms purports to limit or exclude Premier Suites Griffith’s liability for:
 
(a)         death or personal injury caused by the negligence of Premier Suites Griffith, its employees, subcontractors or agents;
(b)        fraud or fraudulent misrepresentation; or 
(c)         any other matter for which it would be illegal for Premier Suites Griffith to limit or exclude its liability.
8.2        To the fullest extent permitted by law, Premier Suites Griffith’s liability for any loss and/or damage suffered by the Customer is limited to that which arises by the negligence of Premier Suites Griffith’s employees, subcontractors or agents. 
8.3        Premier Suites Griffith has no liability whatsoever to the Customer for any loss, theft, damage or destruction of personal property including vehicles.

9.    
Personal information protection

9.1        Premier Suites Griffith will not share the Customer’s personal information such as name, address, contact telephone number and email address with any third parties for any reason without the prior consent of the Customer.
9.2        Premier Suites Griffith will collect, process and hold the Customer’s personal information in accordance with its rights and responsibilities arising under the Privacy Act 1988 (Cth).
9.3        As a Customer, you agree to receive marketing information from us via mail, email, telephone or text message.

The website may provide links to other websites.  This is done for your convenience only.  We take no responsibility for the accuracy or currency of the information on those sites.  We do not endorse any information, goods or services referred to within those sites, and our provision of these links should not be taken as an endorsement.

Intellectual property rights
 

11.1    
We own all intellectual property rights in and to this website and the products and information displayed in it and other material underlying and forming part of this website.  Use of our trademarks or any intellectual property, information or other material from this website is not permitted without our prior written consent.  Any other trademarks we use are used with the permission of their respective owners.

12.  
Termination or suspension
 

12.1     We may at any time and without notice to you:
 
(a)         change the format and content of this website; 
(b)         stop providing, suspend or restrict your access to this website if you do not comply with any obligations you may have whether under these Terms or otherwise; or
(c)         stop providing or suspend the operation of this website (either in whole or in part). 
12.2     No such action on our part will affect any of our rights or your responsibilities under these Terms. 

13.  
General

13.1     We may assign our rights and responsibilities under these Terms to another entity.  If this happens, we will inform the Customer and this will not affect the Customer’s rights.
13.2     We will not be liable for any failure to perform or delay in performing our responsibilities under these Terms where such failure or delay is caused by conditions beyond our control.
13.3     We may, from time to time, change these Terms.  When we do, we will update the date of last update at the top of these Terms.  The version of these Terms in force at the time of Booking will continue to apply to that Booking.  Customers should check these Terms for the latest version before making a Booking.
13.4     Our failure to enforce any provision of these Terms shall not in any way be constructed as a waiver of such provision, or prevent us from enforcing each and every other provision of these Terms.
13.5     The invalidity, illegality or unenforceability of these Terms either in whole or in part shall in no way affect the validity, legality or enforceability of any other provision contained in these Terms.
13.6     These Terms are governed by the laws of New South Wales and the parties submit to the non-exclusive jurisdiction of the courts of that state. 

14.  
Hostel rules
 

14.1     In addition to the other matters set out in these Terms, please take note of the following Hostel rules.
 
(a)         Noise is to be kept to a minimum after 10pm. 
(b)         No pets allowed. 
(c)         Smoking is not permitted in the Hostel, and only in the designated smoking areas, otherwise a $500 fine is payable.
(d)         The Customer is responsible for any loss and/or damage caused at the Hostel by Guests or visitors of Guests including the cost of repairs, cleaning or replacement of property that is damaged, lost or stolen by a Guest.
(e)         For the security and safety of other guests, no visitors of Customers and Guests are allowed in the units or rooms.
(f)          No excessive consumption of alcohol. 
(g)         Strictly no drugs. 
(h)         Guests must use bedding provided.  Sleeping bags are strictly prohibited. 
(i)          Guests must act in a reasonable and responsible manner whilst at the Hostel and not act in any way that would likely disturb other guests. 
14.2         Failure to comply with these rules will result in Guests being asked to immediately leave the Hostel and, where necessary, the relevant authorities being notified.  If this happens, you will forfeit all Fees paid, and any Additional Charges will become immediately payable.  The manager on duty has sole discretion, and is not required to provide reasons, for any decision to evict you from the Hostel.
