TERMS AND CONDITIONS
Terms & Conditions below are between the party indicated on the reservation booking (the Guest) and The Villa by Contemporary Ceylon (the Villa) representing its holding company Contemporary Ceylon (Pvt) Ltd.
The terms in this document are to form the entire agreement between the Guest and the Villa and shall supersede any prior agreement. Where there is a discrepancy between this document and terms displayed by an Online Travel Agent, Travel Agent or other authorised Third Party, these terms will prevail. Any alteration to any terms must be confirmed in writing by a director of Contemporary Ceylon (Pvt) Ltd.
We are all keen to resume our services after the Covid-19 pandemic. We are doing everything we can with regard to protecting the health and safety of both our guests and staff. This includes enacting strict protocols with reference to Government regulation and following international recommendations. While we are doing our part, we urge our guests to be mindful of this new global situation and follow the guidelines for guest etiquette whilst on the property. Please follow our recommendations as non-compliance could potentially impact our ability to operate and endanger the health of guests and staff. Any non-compliant Guest will be asked to vacate the premises and any respective fees shall be non-refundable. Further information is available on our website or please confer with staff when in doubt.
The following cancellation polices shall take effect and supersede those displayed by Online Travel Agents, Travel Agents or authorised Third Parties. For the avoidance of doubt, the months noted in the travel seasons refer to the intended Check In Dates.
Off Season (April-October inclusive)
Cancellations made within 72 hours of the Check In Date - 100% of the total booking price
High Season (February,March, November)
Cancellations made within 14 days of the Check In Date - 100% of the total booking price
Peak Season (December-January inclusive)
Cancellations made from the Time of Booking to 30 days of the Check In Date - free cancellation
Cancellations made within 30 days to 14 days of the Check In Date - 50% of the total booking price
Cancellations made within 14 days of the Check In Date - 100% of the total booking price
Guests who fail to show up and check in during their stay will be charged all total outstanding amounts due to the Villa.
Checking In and Out
Check In is at 2 pm. Checkout is at 11 am
Any early check out or shortening of the stay within 14 days of the Check In Date shall not reduce any previous amount owed to the Villa by the Guest.
Late checkouts may be available upon request and is dependent upon arrivals and the occupancy of the Villa. Please contact the Villa directly to check availability. Additional fees may be applied. A late check-out fee may apply if the property is not vacated prior to the set check-out time of the property.
Late bookings are those made and confirmed until 12pm of the same day. Such bookings shall be taken at the full discretion of the Villa. If accepted prepayment of the total value of the room is required to confirm the reservation.
Credit Card Reservation Policy
A valid Credit Card is required at time of booking and a valid Credit Card must be presented at time of check in. Payment is not taken at the time of the booking unless the booking is made through an Online Travel Agent or Third Party or Travel Agent which necessitated prepayment or which gives the guest the choice of prepayment. At the time of making the booking, the Credit Card details are retained and the Villa reserves the right to charge the Credit Cardin the event of Cancellation (subject to the Cancellation Policy), No Show,Property Damage, penalties or to collect any outstanding sums due from the Guest. In the case of reservations made through Booking.com, the Villa reserves the right to charge the card at any point after the booking is made.
A valid NIC (Sri Lankans only) or passport is required at check in to verify the identity of the guest. The Villa reserves the right to take photocopies or scanned copies of any relevant identification documents in relation to the booking for its own records and for Government regulated Covid-19 tracing.
Accessibility or Special Needs
Any direct or indirect reference to disabled or special needs facilities with regard to rooms or the property whether found anywhere online or in print are indicative only and do not suggest complete provision of facilities as maybe compulsory under another country's regulations. If special facilities are required we recommend contacting The Villa ahead and learning exactly what is in place and what can be arranged for your stay. It is important to us that your stay is made as comfortable as possible and if there is anything that you feel is required as per any disability or medical condition please contact us so that we may make necessary arrangements if possible.
A Credit Card pre-authorisation of $75 may be required upon check in. The pre-authorised amount is set aside by your bank for a period of up to 10 working days. The pre-authorisation will affect your available funds balance or spending limit. For more information on this practice we suggest contacting your bank for more information. Once a pre-authorisation has been made, we cannot release, remove or lower the authorised amount, until we process the final account on departure. The Villa reserves the right to pre-authorise all credit cards upon check in. Cash is not an acceptable form of bond when staying with The Villa.
If any visitor to the Villa causes any direct or indirect damage to property, living fauna or flora or any animate or inanimate object on the premises at any point in time, they will be liable for such damage and the Villa reserves the right to charge any amount to rectify the damage at The Villa's sole discretion. Should the offending visitor be unavailable or unwilling to pay reparations to the Villa, the Villa shall charge the Guest on the booking record automatically under the Credit Card Reservation Policy.
Smoking is not permitted inside any of the rooms or internal spaces of the Villa. If any visitor is found to be in violation of this clause, the respective Guest will be charged a penalty fee under the Credit Card Reservation Policy at the Villa’s sole discretion.
The Villa is meant to be a wholesome, family friendly hotel. Accordingly any form of illegal drugs,narcotics or similar substances are not permitted on the premises. Any visitor found to be in possession or known to be consuming any of the above substances shall be asked to vacate the premises and the respective total booking fee shall be non-refundable and charged accordingly. If any visitors are found to be in violation of this clause, The Villa also reserves the right to impose a penalty fee on the respective Guest booking under the Credit Card Reservation Policy at the Villa’s sole discretion.
Some rooms allow for an extra bed to be added. Fees for additional guests on half board basis in such accommodation are as follows:
Extra bed for children aged 2 to 12 : 50 USD + Taxes and Service Charge
Extra bed for children above 12 and adults : 70 USD + Taxes and Service Charge
Christmas and New Year’s Eve Reservations
The Villa prepares a special menu for Christmas and New Year’s Eve. These evenings will incur a mandatory supplementary charge on top of any quoted room rate as follows: 24th December & 31st December Adults – 50 USD Children under 12 – 25 USD Only Bed and Breakfast packages will be available on the above mentioned dates unless a Guest has a pre-existing arrangement with the Villa. If a Half Board package is requested for a period which includes 24th or 31st December, those specific dates shall be on a Bed and Breakfast package only.
All credit / debit card payments made to The Villa By Contemporary Ceylon will incur a 1.5% non-refundable, credit card service fee. Bookings made through Third Party sites or Travel Agents may have similar credit card fees or additional commission or booking fees.
All room rates are quoted in US Dollars. Any conversion into foreign currency provided by The Villa are for reference only and not binding. Only the currency confirmed on invoices during your reservation is confirmed. Any invoices quoted in US Dollars which are to be transacted on The Villa premises including unilateral payments made as per the Terms and Conditions are subject to conversion into Sri Lankan Rupees for the transaction in accordance with local taxes and regulations. All payments made to The Villa which requires a currency conversion shall be subject to the foreign currency conversions of the respective bank which facilitates the transaction.
Government Taxes and Charges
In accordance with local taxes and regulations, 10% Service Charge, 15% VAT, 2.3% NBT and 1% Tourist Board Levy are applicable on all accommodation rates and items or services sold on the property. Such taxes and charges may vary at the discretion of local authorities and any discrepancy between the Time of Booking and the Check In Date will be explained to guests at check in and any invoices and outstanding sums will be amended accordingly. Should it be discovered that an Online Travel Agent, Third Party or Travel Agent quoted an incorrect net price to the Guest for accommodation, services or items at the Villa, the Guest will be made aware of the discrepancy and any invoices and outstanding sums will be amended accordingly. Should any discrepancy be discovered in a Guest's booking with regard to local government taxes or charges, the Guest will be made to pay the outstanding amount to the Villa.
The Villa reserve the right to cancel contracts and reservations based upon incorrect information being displayed in relation to price, inclusions or service at any point in time. The Villa controls the prices of its direct bookings and a few Online Travel Agent websites. Any prices or bookings erroneously represented by other Third Parties or Travel Agents shall not be accepted and such bookings will only be confirmed upon review by the Villa. In the case of Online Travel Agents displaying incorrect prices due to their own negligence or system errors – the Villa reserves the right to cancel resulting bookings but will do so employing reasonable discretion. As such it is always best to confirm rates on the Villa’s direct booking site.
Villa Rights to Cancel or Amend Bookings
We reserve the right to cancel or modify reservations where it appears that a customer has engaged in fraudulent or inappropriate activity or under other circumstances where it appears that the reservations contain or resulted from a mistake or error. We reserve the right to cancel or amend bookings if they do not adhere to our Terms and Conditions.
If any feature/facility is essential for the guest in choosing a particular property, we recommend contacting the Villa prior to booking. The Villa cannot be held liable for omissions or errors whether temporary or permanent of a property’s facilities and services. Photos shown on the website are indicative only and may not specifically represent the exact room allocated to you.Destination images featuring The Villa may not represent the views offered from our locations. Accommodation facilities listed may not apply to all room types.
In the event of a situation whereby the Property cannot provide accommodation as previously confirmed for whatever reason, the Property will undertake to relocate guests to a comparable alternate property at its absolute discretion with no additional cost to the guest. Should the guest wish to choose a property of a higher standard other than offered under this condition, the guest will be required to pay any price difference. Should the guest not wish to accept the relocation, a full refund & booking cancellation may be granted.
The Villa shall not be held liable for an inability to provide any accommodation, items or services if its operation has been disrupted or prevented due to an Act of God, adverse weather, natural disaster or any other Force Majeure which is completely outside of its control. This includes situations where Force Majeure prevents or disrupts the Guest from travelling to and from the Villa premises.
As a condition of your use of this Website, you warrant to The Villa that you will not use this Website for any purpose that is unlawful or prohibited by these terms, conditions, and notices. Although The Villa may from time to time monitor or review discussions, chats, postings,transmissions, bulletin boards, and the like on this Website, The Villa is under no obligation to do so and assumes no responsibility or liability arising from the content of any such locations nor for any error, defamation, libel,slander, omission, falsehood, obscenity, pornography, profanity, danger, or inaccuracy contained in any information within such locations on the Website.You are prohibited from posting or transmitting any unlawful, threatening, libelous, defamatory, obscene, scandalous, inflammatory, pornographic, or profane material or any material that could constitute or encourage conduct that would be considered a criminal offence, give rise to civil liability, or otherwise violate any law. The Villa will fully cooperate with any law enforcement authorities or court order requesting or directing The Villa to disclose the identity of anyone posting any such information or materials.
Limitation of Liability
Notwithstanding anything contained in these Terms and Conditions to the contrary, The Villa shall not be responsible for indirect damage, damage arising from consequential damage or special circumstances, including but not limited to loss of revenue, loss of profit, loss of use, loss of opportunity,arisen out of the performance or non performance of obligations under this Terms and Conditions.
If by operation of law it is determined that a particular clause within these Terms and Conditions is invalid, the operation of the remaining clauses shall not be affected in any manner whatsoever.
Governing Law and Jurisdiction
The Terms and Conditions and respective disputes are governed by the laws and regulations of the Democratic Socialist Republic of Sri Lanka.
