1. Introduction

These are the termsand conditions that apply when you reserve a room at The Dutch Tulip located inMallow, Co. Cork, Ireland.

You will be asked toconfirm your acceptance of these terms and conditions when you make areservation.

We reserve the rightto amend these terms and conditions at any time and you should therefore checkthem each time you make a reservation. The terms and conditions applying toyour reservation will be those in place on the date that you make yourreservation.

2. Reservations

To reserve your roomplease follow the instructions on the website, or give us a call.

You must be at least16 years old to make a reservation.

You will need toprovide your credit or debit card details to secure your reservation. The DutchTulip accepts Visa or MasterCard and PayPal (advance payment only via PayPal)

Please check that thedetails of your reservation are complete and accurate before you confirm yourreservation. We will not be liable for any delay or non-performance if youprovide us with incorrect information.

We will confirm ouracceptance of your reservation by sending you an email to the email addressthat you provide during the reservation process. The contract between us forthe provision of your room and any additional services added to yourreservation will be formed when you receive this email confirmation from us.

If you think thatthere is a mistake in your reservation or if you require any changes to aconfirmed reservation, please contact us to discuss. For more information on cancellation,please see section 10 Cancellation, below.

3. Group reservations

For bookings ofmultiple rooms, please give us a call to make your reservation.

The prices shownonline are for bookings of individual rooms. Room rates may be different forgroup bookings depending on the number of rooms booked.

4. Room prices

The Dutch Tulip mayalter the price of its rooms based on demand. When you make a reservationrequest, we'll give you a total price for the rooms and number of nights you'verequested. The price you pay is the price quoted to you at the time you makeyour reservation.

Room prices are perroom, per night and are inclusive of VAT at the applicable rate at the time ofyour reservation. If the rate of VAT changes between the date of yourreservation and the date of your stay, we may adjust the rate of VAT but theprice you pay will remain the same.

A complimentarybreakfast is offered to all our accommodation guests. All other meals andextras must be paid for separately.

5. Occupancy

The maximum roomoccupancy is two adults. Double Plus rooms (where available) can accommodatetwo adults and 1 child (under the age of 18). You must not exceed the maximumoccupancy for the room allocated to you. We reserve the right to conduct checkson occupancy. Occupancy is not transferable.

Children under 16 arenot permitted to stay at The Dutch Tulip unless a parent or guardian is alsostaying in the hotel. We reserve the right to request valid photographic proofof identity and age, so please bring this with you otherwise where requestedyou will not be permitted to stay.

6. Special requests

Although The DutchTulip will try to accommodate special requests, all rooms are subject toavailability.

7. Meals

A complimentarybreakfast is offered to all our accommodation guests. All other meals andextras must be paid for separately.

A casual dining menu will be available in The Dutch Tulip bar/restaurantbetween 12noon and 10pm. If you would like to reserve a table for your mealplease contact us.

8. Paying for your room

If you have not paidfor your room and any extras added to your booking in full at the time you makeyour reservation, you will need to pay on arrival.

Payment may be made bycash (with proof of identification), credit/debit card (Visa or MasterCard),The expiry date of your debit/credit card must be later than the end of yourstay. We do not accept personal cheques or family discount cards.

Rooms may be paid forby business cheque, however The Dutch Tulip must receive all business chequesat least three weeks before the arrival date.

9. Cancellation

Your right to cancel

Room bookings may becancelled up to 48hrs prior to the ‘check-in from’ time quoted on yourreservation confirmation. If you cancel your reservation at least 48hrs beforeyour ‘check-in from’ time and have paid for the room in advance by debit/creditcard, a full refund will be processed to the same debit/credit card normallybefore 9am the next working day though it may take a few days for the funds toreach your account. A cancellation reference will be given and should beretained as proof of cancellation.

If you cancel areservation within 48hrs of your ‘check-in from’ time (including any "noshow") and have not already paid for the room in advance you will becharged a cancellation charge equivalent to one night's total accommodation perroom booked. A cancellation reference will be given and should be retained asproof of cancellation. Such cancellation charge is to compensate the hotel forthe late cancellation and is not for any service.

If you decide toshorten your stay you must inform reception at the The Dutch Tulip by 11am GMTtime on the day you wish to check out. Otherwise you will be charged acancellation charge equivalent to one night’s total accommodation per roombooked. Such cancellation charge is to compensate the hotel for the late cancellationand is not for any service.

The first night of anybooking made after 12noon GMT time on the day of arrival is non-refundable inthe event of a cancellation (including any "no show").After thecancellation period, the whole reservation becomes fully non-refundableincluding any associated meals and/or additional extras. Such cancellationcharge is to compensate the hotel for the late cancellation and is not for anyservice.

Amendments outside The Dutch Tulip’s cancelation policy arestrictly at the discretion of the manager.

If you’ve made a groupbooking, our cancellation terms are as follows:

●      For 5 rooms or fewer, we’ll need full payment 14days before arrival. This is non-refundable, but you can cancel your bookingfree of charge if you do so before this time.

●      For 6 rooms or more, we’ll need a 50% deposit 28days before arrival and the balance 14 days before arrival. These payments arenon-refundable, but you can cancel your booking free of charge if you do sobefore we take a deposit.

Where you cancel(including any “no show”) a group booking and there is a non-refundable paymentretained by us, this total amount is a cancellation charge to compensate thehotel for the cancellation and is not for any service.

Our right to cancel

Your breach

We may cancel yourreservation at any time with immediate effect by giving you written notice(which includes email) if:

●      you do not pay us when you are required to do so; or

●      you break the contract between us in any way.

If we cancel yourreservation where you are at fault, we reserve our legal rights in respect ofyour breach of contract. Where your stay had/has not yet commenced, the totalpayment made or to be made by you for such room shall be deemed a cancellationcharge and is not for any service.

Events outside ourcontrol

We may also cancelyour reservation if an event outside of our control (including Covid-19government guidelines, industrial action, explosion, outbreak of disease,health and safety issues, fire, flooding, and failure of power and/or watersupplies or emergency evacuation) means that we are unable to make your roomavailable to you. In this case we will contact you to let you know as soon aspossible and:

●      if you have already paid for your room, we willrefund your payment to you; or

●      if you have not yet paid for your room, you will nothave to make any payment to us.

Save as set out above,we will not be liable or responsible for any failure to perform, or delay inperformance of, any of our obligations that is caused by an event outside ofour control. This does not affect your statutory rights.

10. Arrival and departure

Rooms are availablefrom 2pm on the arrival date. Please let us know if you are likely to arriveafter 11pm.

Guests will be askedto provide proof of identity and nationality upon check-in. Overseas guests,excluding Republic of Ireland and Commonwealth citizens, will be asked tocomplete a registration form and provide their identity card / passportdetails. Acceptable forms of identification are: a passport, driving licence,ID card or police warrant card.

Rooms must be vacatedby 11:30am on the day of departure. Failure to leave your room by this time mayresult in a late check-out charge.

11. The Dutch Tulip’s expectations of you (and yourgroup)

You must not:

●      smoke anywhere inside The Dutch Tulip premises. Thisincludes the smoking of e-cigarettes. Permitted smoking areas will beidentified on site. Smoking on The Dutch Tulip premises outside of thedesignated smoking area will result in a €100 fine;

●      cause any health and safety hazard to any of ourteam members or any of our guests;

●      bring any pets onto The Dutch Tulip premises, withthe exception of registered and identified Guide or Assistance dogs;

●      bring any potentially dangerous or hazardousmaterials or equipment onto The Dutch Tulip premises;

●      use any electrical appliances that may set off thefire alarm system, such as toasters, mini cookers or portable grills;

●      tamper with any fire alarms or emergency equipment;

●      utilise The Dutch Tulip rooms to store items(personal or otherwise) which could in the sole opinion of The Dutch Tulipcause damage to the room, or be a risk to the health and safety of staff orproperty;

●      prevent The Dutch Tulip management, housekeeping and/ormaintenance staff from access to your room(s) as and when required by The DutchTulip, with housekeeping permitted full access at least once every two days;

●      remove, damage or destroy any The Dutch Tulipproperty;

●      use any of the technology provided by The DutchTulip to download or access any unlawful or obscene material; orcauseunreasonable disturbance to our other guests or any The Dutch Tulip staff.

COVID-19 (alsoreferred to as Coronavirus): you must immediately notify us to the extent youor anyone staying with you (or on your reservation) is (i) self isolating or(ii) should be self isolating pursuant to Government guidelines. In any event,The Dutch Tulip reserves the right to cancel any reservations (before or duringthe stay) to the extent it is for self isolation.

If you or your groupcause damage or loss of any kind to the hotel, other guests or their property,you (as the person making the booking) will be responsible for that damage orloss and you shall be liable to pay to The Dutch Tulip on demand the amountrequired to make good or remedy such damage or loss.

You and the members ofyour group must not resell or transfer your reservation (or any part of it) noradvertise, market or otherwise offer any The Dutch Tulip room for sale either onits own or as part of a combined offer. The Dutch Tulip will not honour anyreservations made in this way and does not accept any liability for doing so.If you are a Tour Operator and wish to book rooms at a The Dutch Tulip youshould contact us by phone.

If you or your groupcause damage to the hotel, other guests or their property, or otherwise breachany of these terms and conditions, The Dutch Tulip reserves the right to:

●      cancel your reservation with immediate effect and(if appropriate) eject you from The Dutch Tulip premises;

●      cancel key cards;

●      restrict access to the premises;

●      remove your items from the room and hotel, disposingof such items (at no cost and no liability) to a local charity to the extentsuch items are not collected from us within 7 days of removal;

●      retain all sums paid by you and/or charge you thefull amount of your reservation; and/or

●      refuse future reservations from you and/or refuseyou entry to the premises or accommodation at The Dutch Tulip.

The Dutch Tulip willnot be liable for any refund or compensation in such circumstances.

The Dutch Tulipreserves the right to decline or cancel reservations made and stays in progressby those who have previously breached these terms and conditions (as may beupdated from time to time), whether the reservation is in that name or not.

12. General

We reserve the rightto:

●      change your room allocation at any point during yourstay for any reason; or

●      cancel any booking(s) due to health and safetyconcerns or full or partial closure of the hotel. In the event we have tocancel your booking(s) we will attempt to notify you and a full refund will beprocessed to the same debit/credit card, though it may take a few days for thefunds to reach your account.

Your information

We keep your personaldata safe and secure. Full details about how we use your data are set out inour Privacy Policy (available on our website). Similar to othercommercial websites, our website utilises a standard technology called cookiesand web server logs to collect information about how the website is used andhow to improve them. Further details can be found in our Cookie Notice. Byproviding information about you and your booking group (as outlined in thePrivacy Policy) when making a reservation, you consent (on your behalf and onbehalf of each member of your group) to such processing and you warrant thatall information provided by you is accurate.

The contract

This contract formedwhen we confirm your reservation is between you and us. No other person shallhave any rights to enforce any of its terms.

Your rights

If you are anon-business customer you have certain rights under consumer protectionlegislation. Nothing in these terms and conditions is intended to affect thoserights.

Our liability

We accept liabilityfor death and personal injury arising from our negligence or that of ouremployees and agents. We do not seek to exclude our liability for fraudulentmisrepresentation by us or our employees or agents.

We do not acceptliability for failure to meet any of our obligations where such failure is dueto events beyond our reasonable control.

If we breach theseterms and conditions for reasons within our control we shall only be liable forlosses that are direct losses and a reasonably foreseeable consequence of suchbreach.

Save as prohibited byapplicable law, we shall not be liable whether in contract, tort (includingnegligence) or for breach of statutory duty, or in any other way, for anyindirect or consequential losses including:

●      loss of income, sales or revenue;

●      loss of business;

●      business interruption;

●      loss of profits or contracts;

●      loss of anticipated savings;

●      loss of data;

●      loss of reputation and/or goodwill; or

●      wasted management or office time.

Where we are liable toyou (save as prohibited by applicable law) our maximum liability to you whetherin contract, tort (including negligence) or for breach of statutory duty shallin no event exceed the price of your reservation unless the Hotel Proprietor'sAct 1963 applies, in which case our liability will be limited to the maximumprescribed under that Act.

Applicable law

These terms andconditions, their subject matter and formation (and any non-contractualdisputes or claims) are governed by and construed in accordance with Irish law.

If you are a consumeryou and we both agree that the courts of the Republic of Ireland will havenon-exclusive jurisdiction over any claim arising from, or related to, yourreservation and/or stay at The Dutch Tulip. We retain the right to bringproceedings against you for breach of these terms and conditions in yourcountry of residence or any other relevant country.

If you are making abusiness reservation, you and we agree that the courts of the Republic ofIreland will have exclusive jurisdiction over any claim arising from, orrelated to your reservation and/or stay at The Dutch Tulip.


If any part of theseterms and conditions is deemed invalid, illegal or for any reason unenforceablethen that part will be deemed deleted and will not affect the validity andenforceability of the remaining parts. Any failure by us to enforce our rightsor remedies under these terms and conditions or otherwise shall not beconstrued as a waiver by us of those or any other rights or remedies.

All rights notexpressly granted in these terms and conditions are reserved.
