Terms and Conditions
This contract is made between PT Bali Short Stay, trading as Villa Samuan, hereinafter referred to as the “Villa Manager”, and the holidaymaker, hereinafter referred to as “The Hirer”. The contract does not come into effect until all relevant payments have been received and confirmation has been sent to the hirer. SEASONS: The year is categorised into three (3) seasons: High, Peak, and Low season. RATES & PAYMENTS: Rates vary between the seasons, and information on rates can be found on our website. Changes to bookings may incur an additional charge if the amended dates fall within a higher-priced season than the original dates. To confirm a booking, a deposit of 50% of the rental amount must be received within two (2) working days after the relevant invoice and payment instructions have been provided. If the deposit is not received within this time, the booking will be cancelled. Final payment is required 45 days prior to arrival (60 days for Christmas/New Year bookings) or immediately if booking is made less than 45 days prior to arrival (or 60 days in the case of Christmas/New Year bookings). If the balance is not received by the due date, the Villa Manager reserves the right to cancel the booking and retain the hirer’s deposit. For bookings made less than 45 days before arrival, full payment is required within two (2) working days, or upon arrival if less than two (2) working days, whichever comes first. All payments can be made by bank transfer or credit card, subject to conditions that will be provided at the time of booking. Payments by traveller’s cheques, other currencies, or personal cheques are not accepted. All clients are required to sign a Waiver of Liability and a credit card authorisation form, allowing the Villa Manager to charge any expenses incurred by the hirer during their stay. CHANGES TO BOOKINGS: A US$100.00 administration fee applies to each booking change after confirmation. Changes cannot necessarily be accommodated in all cases. PROVISIONS AND STAFF: All villas include at least two household staff from 7:00am to 11:00pm and one security guard from 11:00pm to 7:00am. Villas are fully equipped with bed linen, towels, cooking utensils, etc. A private chef is available at no extra cost, although provisions and other consumables are charged at cost plus 20%. All charges incurred must be paid prior to departure. GUEST TRANSFERS: For bookings over US$1,000.00, complimentary airport transfers are provided. For bookings less than US$1,000.00, an airport transfer fee of US$65.00 per car, each way, will be charged. EVENTS AND PARTIES: Normal bookings are for vacation purposes, and special permission is required for events where attendance exceeds 150% of the villa’s capacity. As the villa is located in a residential neighbourhood, not all functions or events can be accommodated, and there is a music curfew of 11:00pm. If planning a large event, such as a wedding or party, this must be communicated to the Villa Manager at the time of booking or as soon as possible thereafter. The Villa Manager will not accept bookings for formal events without prior confirmation that a function coordinator has been appointed. A surcharge equivalent to one night’s rental and a local Banjar fee will be charged for events held at the villa. DAMAGE OR LOSS: The hirer is responsible for leaving the property in good order and clean condition, and must pay for any damages or losses incurred during the stay. The Villa Manager reserves the right to evict the hirer if excessive damage occurs or if any laws are breached, in which case no refund will be issued. NUMBERS IN PARTY: The number of occupants must not exceed the number stated in the booking confirmation. NO LIABILITY: The Villa Manager accepts no liability for injury, sickness, loss, damage, additional expense, or inconvenience directly or indirectly caused by the Villa Manager, property, utilities, or adverse weather conditions. No responsibility is accepted for the personal belongings of the hirer or their party. COMPLAINT RESOLUTION: If the hirer has a complaint during their stay, the issue must be reported to the Villa Manager immediately. If the Villa Manager considers the complaint valid, a partial refund may be granted. No liability shall extend beyond the refund of monies paid. Complaints made after departure will not be entertained. BOOKING OF THIRD-PARTY SERVICES: PT Bali Short Stay, trading as Villa Samuan, may assist guests in arranging third-party services, which are provided by independent contractors. The Villa Manager is not responsible for any issues arising from these services. Refunds for third-party services will follow the terms of the service provider, and any refund received by the Villa Manager will be passed to the guest after applicable charges. INDEMNIFICATION: Guests hereby agree to indemnify and hold harmless PT Bali Short Stay, trading as Villa Samuan, including its owners, managers, and staff, from any claims, losses, or liabilities arising from the use of third-party services. By accepting these terms, guests acknowledge their understanding and agreement to these conditions.
