3. Cancellations:  If notice of cancellation is received at least 90 days prior to reservation date, the deposit is refundable, less a $300 processing fee.  Unfortunately, no refunds are available less than 60 days prior to the reservation date.  No refunds are available for multiple week bookings on all rental properties.

4. Pets: Sorry No Pets allowed. We warmly welcome children over 10 years of age.

5. Guest Obligations: a) Reasonable and orderly conduct by all tenants in the leased residence with respect given to the terms of this lease, the property, the law and the neighbors; b) Guest is responsible for damages as outlined under Cleaning and Damage Deposit; c) Guest agrees to indemnify and save Resort Rentals ands employees, and Agent, free and harmless from any liabilities for any loss or damage whatsoever arising from, related to, or in connection with the rental of the premises, including, but not limited to any claim or liability for personal injury or damage or loss of property which is made, incurred or sustained by Guest (Leaseholder) or guests of Guest, except only such personal injury caused by the negligent or intentional acts of the Owner or his Agent  Should any of the terms of this agreement be breached by tenant, resulting in legal action on the part of the Agent against Guest(s) and Agent prevails in court or a settlement is reached, Agent shall be entitled to collect from Tenant all costs of said legal action including, but not limited to, attorney’s fees.

6. Keys & Lockouts: One set of keys is issued at Check-In.  Replacement cost for lost keys is $10, payable upon checkout. Unreturned keys will be charged against the damage and cleaning deposit.  Lockouts after business hours incur a $30 fee and delivered keys to the home, $40, either payable to the deliverer when service is rendered. When Pointes North Lobby is closed, there is a lockbox located at the side door. The combination is 2-3-1. Unit combination will be forthcoming.

7. Lost & Found: Check thoroughly for your belongings upon departure. RR is not responsible for your personal items.  We hold recovered items for 10 days only and return upon request, plus a $15 fee, C.O.D.  Firearms/weapons cannot be returned by mail; they will be released to local law enforcement and should not be in any rental home.

8. Non-Availability: Should the home confirmed by Guest(s) become unavailable for any reason whatsoever, Agent will inform Guest(s) when non-availability is absolutely certain, and prior to check-in whenever possible.  Every attempt to relocate Guest(s) to a comparable home will be made, unless Guest requests a full refund, in which case all moneys will be immediately refunded.  Guest is responsible to pay and rental amount on a substitute rental home that exceeds the original reservation amount.

9. Occupancy: The lease period begins at 3:00 pm or 4:00 pm on arrival date and ends at 10:00 am on departure date.  Restricted solely to the specific number of occupants as described for each home (only babies in cribs not included in occupancy count). ALL RENTALS ARE TO FAMILY GROUPS AND RESPONSIBLE ADULTS ONLY. Leaseholder must be in occupancy of said unit during the entire lease period.  Occasions such as weddings, receptions or “parties” which increase the stated occupancy (even a few hours) must be requested in writing and approved by the Agent and Owner prior to the execution of t a lease. Rental rate and cleaning and damage deposit are subject to increase at owner and agent discretion.  Agent reserves the right to deny occupancy, evict and refuse refund to anyone, at any time who appears to be detrimental to the property.

10. Repairs/Right of Entry/Refunds:  Report all inoperative and/or missing equipment to RR immediately.  Service must be scheduled and may require parts to order.  Problems will be corrected as soon as humanly possible.  Priority is given to heat, refrigerators, plumbing/septic, water or electrical problems.  Agent or authorized employee or repairman or owner will have right of entry at any time.  No refunds issued for delay in check-in or early check-out (for any reason), damage to Guest’s belongings due to malfunctioning equipment/appliances, mechanical failures/electronics, interruption or loss of utilities (including cable) or inclement weather or other acts of God.

11. Cleaning & Damage Deposit: A refundable cleaning and damage deposit is required so that its owner can reasonably recover costs of damages incurred accidentally or willfully by Guest.  Respect the property as you would your own and vacate it in as good or same condition as found, reasonable wear and tear expected.  Unreported problems found on inspection will be charged to the cleaning and damage deposit.  Service calls made necessary by actions of Guests or visitors shall be solely at Guest’s expense.  Meeting the satisfactory standards at check-out will help ensure the full refund of your deposit: a) Report immediately any breakage/damages you find or incur.  b) Remove sheets and pillowcases from the beds. c) Remove and  neatly bag all food/ and trash/recyclables to the outside receptacles per instruction and place for scheduled pickup. d) Wash and put away all dishes and cookware.  e) Leave premises tidy with all furniture in same position.    f) Lock all doors and windows.  g) Set all thermostats at 60 degrees or off during summer season.  h) Vacate the home by 11:00 am and immediately return all keys as instructed by RR.  Late check-outs are unauthorized and will result in an additional night’s charge.  Damage costs exceeding the deposit are the Guest’s responsibility and must be paid by the Guest to Agent with 30 days of final billing notice.  The cleaning and damage deposit is automatically refunded within 10 days of your departure when all procedures are followed.

Management Policies:  In accordance with the National Association of Realtors Standards of Practice and Code of Ethics, it should be disclosed that Resort Rentals has a contractual relationship with the landlords represented.  We act as a referring agent only.  This contractual relationship employs us to act as their referring agent and treat all parties (tenants and landlords) fairly and in good faith.  More information is available at RR at your request.

14. Fair Housing Law:  Owner understands that in leasing property, both owner and manager must fully comply with all laws and regulations which prohibit discrimination on the basis of race, color, creed, national origin, sex, familial status, children or the handicapped.
