Terms and Conditions

Reservation Policy 
Your reservation is guaranteed until the day of arrival. After that time, it will no longer be guaranteed and the room may be reassigned. A deposit of 100% of the base price, taxes and fees must be received at the time of booking in order to hold your reservation. The deposit is non-refundable if canceled within 30 days of the reservation. All bookings are subject to a confirmation review and may be canceled if booking is different than discussed cabin or dates. Cancellations or early departure for any reason (including weather) do not warrant any refund or return of deposit. All guests must be 21 years or older to confirm cabin accommodations. Reservations made for teenagers or young groups will not be honored. 

Check in/Check out 
Check-in begins at 4pm and check-out is 10am. To allow for these check-in/check-out times and swift turnover between guests, please place all used linens in the trash bags provided under the kitchen sink and leave outside the front door to alert you have left the cabin. All items you brought including groceries must be removed. All trash must be placed in the communal garbage upon departure, located in the parking area off of Cedar Street. 

Please note that a more detailed inspection of the room/apartment is usually made after the check-out time and we reserve the right to make charges on the credit card provided at the time of booking for any damages or breakages above normal wear and tear.  Please note, immediate notification after check-out of any damages to, breakages in or issues with the apartment is expected. HBC can then take any necessary action to resolve any issues and make sure all the equipment and facilities are working and provided as expected.

Parking
Each cabin is allotted one parking space due to minimal space on the property. Guests may use the circle drive near the shoreline to drop off supplies, people, etc, then park in the chipped parking area off of Cedar Street with your headlights facing the tan house (west). Use the marked spaces on the east side of the chipped area to allow passage behind vehicles. Trailer parking is limited and directly in front of the tan house off of Cedar Street. 

Outages and Maintenance
No compensation will be given for temporary outages of electricity, gas, water or internet (if available) or maintenance issues. Outages and issues must be reported immediately and every effort will be made to have them restores as quickly as possible 

No Smoking
All cabins, docks and resort property are non-smoking. A $500 cleaning fine will be charged if any evidence of smoking is found. If you smoke on the resort property you will be asked to vacate the premises and you will forfeit any monies paid for your reservation and or paid stay.

Cooking and Grilling
Please practice safe cooking habits and do not leave burners on unattended. Please do not cook with strong smelling ingredients. Cleaning of fish must be done outside of the cabin and remains must be discarded properly and not allowed in the cabin. Lingering smells that require room closure and deep cleans will be charged a cleaning fee. Grills are provided for guest use. All guests are responsible for safe grilling practices including constant monitoring of the grill during cooking and proper clean up after. 

Pet Policy
HBC is currently not pet friendly for guests due to damages incurred from our trial period. No pets are allowed at or on HBC property with the exception of the owner’s dog who will be there from time to time (on goose patrol!). Failure to comply will result in immediate eviction and any damages will result in additional charges at market value to your credit card on file. 

Quiet Time and Bonfires
Out of respect for the neighbors and other guests (and city ordinance), quiet time begins at 10pm. Authorities may be contacted for violation and violators will be subject to immediate eviction. Campfires are permitted when weather permits and in the fire pit only. Fires must be accompanied by an adult. If you start the fire it is your responsibility to tend to it and be sure that it is out before you leave it. No fires past 11pm. 

Docks and Swimming
No jumping, running, fishing or diving from the docks. Children must wear life jackets, always when on the docks and near the water. No lifeguard on duty so please be safe and swim at your own risk. 

Personal Property
HBC is not responsible for lost or forgotten personal things on the premises. Safety cameras are used throughout the premises, and anyone on our property may be recorded.

Guests
No one other than paying guests will be allowed on resort property or docks without prior approval of HBC. Any violators will be evicted.


Release, Waiver, and Indemnification
All guests in the party agree to release, waive, and indemnify Davis Northern Ventures, LLC, DBA Hessel Bay Cabins for the following: 

Guests understand that staying on the premises and within the improvements in the form of a home, cabins, and dock(s), all of which are situated adjacent to or along the shoreline of Lake Huron (hereafter the “Premises and Improvements”), has inherent risks that may result in physical or emotional injury, death, and damage to self or personal properties.

Guests expressly agree to assume all of the possible risks existing with the activity of staying on and using the Premises and Improvements of Davis Northern Ventures, LLC, whether or not caused or alleged to have been caused by Davis Northern Ventures, LLC. Guests hereby releases, forever discharges, and agrees to hold harmless Davis Northern Ventures, LLC, and all of its members, employees, agents, affiliates, successors, permitted assigns, and landlords and tenants, from any and all claims of liability and demands of liability, including, but not limited to, personal injury, sickness, death, damage to personal property, expenses incurred, and any other nature whatsoever that may incur as a result of use of the Premises and its Improvements and offering of hospitality services. Any of Guest’s employees, members, affiliates, or representatives’ consumption of alcohol, as well as injuries or damages resulting from said consumption, while upon or in the Premises and Improvements shall be subject to this release and waiver of liability. Participation in the use of the Premises and Improvements is entirely voluntary. 

Guests understand that there are inherent risks presented by use of the Premises and Improvements, including, but not limited to, dock use; fire pit use; voluntary consumption of alcoholic beverages if Guest is of legal age; etc. Guests take full personal responsibility to follow any and all safety rules and procedures established by Davis Northern Ventures, LLC, and that are normally associated with such dangers present and general use of the Premises and Improvements. 

Guests will be solely responsible for any and all medical and related bills that  may incur because of any injury, as well as any costs related to loss or damage to my property, that may sustain as a result of use of the Premises and Improvements, including those sustained during said use or during transportation to or from the Premises and Improvements. 
This Agreement shall be binding on estate, heirs, executors, administrators, successors, and assigns, as well as any other party asserting a Claim on (or estate’s) behalf. 

Guest(s) (the Indemnifying Party) shall indemnify, hold harmless, and defend Davis Northern Ventures, LLC, and its members, employees, agents, affiliates, successors, permitted assigns, and landlords and tenants (collectively the “Indemnified Party”) against any and all losses, damages, liabilities, deficiencies, claims, actions, judgments, settlements, interest, awards, penalties, fines, costs, or expenses of whatever kind, including reasonable attorney fees (collectively the “Losses”), relating to, arising out of, or resulting from any third-party claim alleging (1) any negligent (or more culpable) act or omission of the Indemnifying Party (including any recklessness or willful misconduct) in connection with the performance of its obligations under this Agreement; or (2) any bodily injury, death of any person, or damage to real or tangible personal property caused by the negligent acts or omissions of the Indemnifying Party. Any consumption of alcohol by Indemnifying Party or its employees, members, affiliates, or representatives, as well as injuries or damages resulting from said consumption, while upon or in the Premises and Improvements shall be subject to this indemnification.
