Cancellation Conditions
For Low and High Seasons, all cancellations made 30 days or more prior to the arrival date, 50% of the full booking is forfeited but credited for 9 months from the date of the cancellation confirmation by the reservations department.
For Peak Season, Christmas/New Year, if the booking is canceled within 30 days or more prior to the arrival date, all payment(s) received will be forfeited or refunded in pro-rate shall another booking be secured for the same period that has been canceled.
Should the client(s)/guest(s) wish to leave the hotel upon arrival or during their period of stay, the full amount paid will be forfeited.

Payment deposit or full payment relates to securing a specific property as advertised and agreed. The property shall bereferred to as the “Rental” with Million Dollars View Co., Ltd. acting as the legal representative and shall be referred to asthe “Agent”. Any deposit paid for The Rental shall be taken as confirmation of acceptance of the following terms andconditions. MDV reserves the right(s) to amend/add at its own discretion, anytime and without prior notification.
1. BOOKINGS
1.1. Provisional Confirmation of Availability and Rates Upon receipt of a request for availability, the applicable rental rates and the amount of deposit required shall beconfirmed. Bookings are on right of "first come, first to be served" basis
1.2. Exclusions & Additional Charges Rates do not include personal items and expenses, and any excessive cleaning required upon departure (such asupholstery or rug shampooing, etc.) or replacement of breakages. Fair wear and tear accepted.
1.3. Rates Rental rates quoted by the Agent for the Rental are on a per-night basis. Check-in is from 3 pm, and check-out by 11 AM.
1.4. Personnel Only those persons stipulated on the booking form may reside at the Rental as guests. Please notify us as soon as possible ofany changes. Rates quoted allow for a maximum occupancy of ‘The Rental’ as agreed in advance.
2. PAYMENTS
2.1. If a percentage deposit is made to secure the booking, the final payment consisting of the outstanding balance must bereceived by the Agent at least 30 days prior to guest(s) arrival (or 100% together with the Reservation Form if booked lessthan 30 days in advance of arrival).
2.2. Failure to make the final payment on a timely basis will default to the reservation(s) being subject to automaticcancellation and any amount paid will be forfeited.
2.3. Expenses and or surcharges for payments will be charged from the guest(s)/agent(s). Rates for accommodation arequoted in Thai Bath only.
3.1. If it becomes necessary to cancel all or any part of the booking, the Agent must be notified in writing (emailacceptable). The cancellation will take effect from the day the written confirmation is received. The following cancellationcharges will be payable depending on when the notification of the cancellation is received in writing:
3.1.1. More than 30 days before arrival: The deposit will be forfeited, and all other payments will not be refundedbut kept as a credit for 1 year from the date of cancellation as confirmed by the Rental. The credit amount can beused by the client or anyone on their behalf for any reservation, during any period and solely for the Rentalreserved.
3.1.2. Less than 30 days before arrival date: all rental payments (100%) are forfeited.
3.2. In case the deposit is paid and the balance will not be paid, all payments are forfeited with Immediate effect and no notification will be issued. 3.3. If the dates of the booking need to be amended, this may be treated as a cancellation of the original booking, andcancellation charges may apply. 3.4. Any changes made to the original reservation is subject to the approval of the Agent.
4. DAMAGES
4.1. Any damage caused by guest(s) staying at the Rental, which is deemed to be over and above acceptable wear andtear, is chargeable to the guest. The agreed charge is based on the replacement value of each item. Guest damagecharges are payable to the Agent before the check-out date.
4.2. Any security deposit held by the representative can be used as full or part payment towards said damage. This may bein the form of cash taken at the beginning of the guest stay and/or being held with the booking agent used to secure thestay (whichever is relevant).
5. INSURANCE
5.1. It is a condition of the booking that the entire party is covered by comprehensive travel insurance (includingcancellation, flight delays, loss, and damage to baggage and other property) and health insurance. The Rental as well asthe Agent is not nor will be responsible for all claims, including any accidents related to the use of the Rental facilities, estategrounds, or locally procured third-party services such as watercraft, water sports, car, jeep, or motorbike rental, etc.
5.2. The Rental and the Agent shall not be responsible for any delay, additional expense or inconvenience caused directlyor indirectly by events outside the Rental’s or the Agent’s control such as civil disturbances, fires, floods, severe weather,acts of God, acts of Government, termination of supply of electricity and water on the Samui Island or the Rental area etc.
6.1. The Rental and the Agent are in no circumstances responsible for any loss, expense, damage, claim, or injury eitherdirectly or indirectly, consequential, or otherwise whatsoever, however, caused or incurred (within or outside the premises of‘The Rental’).
6.2. If any accommodations and/or services are substituted, the Rental and the Agent will act at all times in good faith anduse their best efforts to substitute with accommodations and/or services of a type comparable to or better than thoseoriginally contracted.
6.2.1. The Rental and the Agent are not responsible for any deaths and injuries whatsoever within or outside itsproperty, e.g., falls from the terrace, staircases, balconies, accidents in the swimming pool.
6.2.2. The Rental and the Agent are not responsible or liable for any personal injury or death casualty ofaccompanying children, whatsoever. Parents or legal guardians act at their own risk and are solely responsible forthe safety of their children. This includes using the swimming pool.
6.3. By acceptance of this contract and/or the transfer of the deposit, the guest(s)/client(s) agrees, to the disclaimer ofliability, written above and that this requirement has and will be complied with in full extent.
7. COMPLAINTS
7.1. The Rental and the Agent do not accept responsibility for the breakdown of the supply of water, or electricity, nor ofswimming pool filtration systems, though we will use our best endeavors to arrange for any such problems to be resolvedquickly.
7.2. The Rental and the Agent will do as much as can be reasonably expected to avoid and rectify any problems thatmay occur but cannot be held responsible for any problems. Any complaints must be notified to the Agent within 24 hoursof the occurrence giving rise to the complaint.
7.3. Should a problem remain unsolved please make an immediate complaint in writing (email acceptable) to the Agentbefore completion of the rental period. If the Rental is vacated before the end of the rental period without mutualagreement this may result in the loss of all rights to compensation.
7.4. The Rental and the Agent are not responsible, nor is it liable for any external or environmental noise or other disturbancearising out of its control.
7.5. No complaints will be considered if made after the departure date or if not acknowledged by the Rental’s owner orthe Agent.
8. CONDUCT & BEHAVIOUR
8.1. Should any member of the party not behave in such a manner, the owner or the Rental and the Agent may at their absolute discretion ask the offending guest(s) to vacate the Rental forthwith.
8.2. The Rental is a non-smoking area. It is strictly forbidden to throw away any cigarettes, cigars, lighters, etc., except ondevices like ashtrays after having put out the fire with water. It is specially forbidden to throw anything away outside thehandrails and balustrades of the terraces or in the garden.
8.4. The Rental behavior rules do not allow any kind of discrimination towards the Rental’s staff on sex, race, and class lines.Otherwise, the Rental and the Agent reserves the right to ask guest(s) to leave.
8.5. In severe cases, this will be treated as a cancellation of the original booking and no refund can be claimed from eitherthe Rental’, its owner or the Agent.
9. SOCIAL CORPORATE RESPOSIBILITY
9.1. It is prohibited to act unlawfully in any way whatsoever and to bring in and/or use/consume any illegal substancesinside the Rental and the estate. Any offenders will have to face local authorities in such a case. In addition, in line with itsmoral duty and respect for local employees, as well as for the safety of our valued guests, guests may not bring non-registered persons back to the Rental under any circumstances. The Rental and/or the Agent reserves the right to requestanyone to vacate the property at any time.
10. VALUABLES
10.1. Any valuables left at the property are left at one’s own risk. Neither the Rental nor the owners, the Agent, and the staff are responsible for any loss or damages. Please make sure that no valuables are lying around.
11. DUE CARE AND SUPERVISION
11.1. As part of this agreement guests are required to take care when residing at the Rental and be especially watchful ofchildren playing in the gardens, near the entrance of the property, in the staircases, close to the tempered glasses, railing,the pool area and in the pool, all staircases in the Rental and at the balconies and terraces as well as in the estate’scommon grounds.
11.2. Furthermore guests are not permitted to enter the building when still wet from the pool because the floor can beslippery. Damage or injuries arising as a result shall not be the responsibility of the Rental, the owner, or the Agent in any waywhatsoever.
12. APPLICABLE LAW
12.1. These Terms and Conditions and any contract to which they apply are governed in all respects under the law ofThailand and any/all the parties fully accept to elect the Court of Koh Samui, Surat Thani, Thailand as exclusive jurisdiction incase of disputes/litigation.
13. AGREEMENT
13.1. The Guests agree to the above terms and conditions and do hereby agree to the application of the above Terms and Conditions at the time of the reservation.
