VACATION RENTAL CONTRACT
This vacation rental contract is a legal agreement between Harrison 15th Street LLC (also referred to as the “Miramar Condominiums” and “Landlord” and “Property Manger” and “Courtyard by Marriott Ocean City”) and you, the Renters (also referred to as “Tenants” and “Guests”). This contract is entered into agreement as of the date when the Renters place their reservation online and the reservation is screened and accepted by Miramar Condominiums. The Miramar Condominiums will notify the Renters by email or written mail when their reservation is accepted. Miramar Condominiums provides the initial set up of linens, bathroom and kitchen paper products; the Renter is responsible for any additional product needed. No additional linen or paper products will be provided.
Payment Policy:
A deposit will be automatically taken 30 days prior to check-in. The credit card on file at time of booking will be used to complete the payment unless other arrangements are made in advance.
Cleaning Policy:
The Vacation Rental must be left clean, as found, to receive no additional fees. If The Vacation Rental is left clean, with no damage then there will not be a charge, if the Vacation Rental is damaged or left in a substandard condition then you will be charged $250.
Tax Policy:
All condominiums are subject to a 11.0% tax.
Reservation Policy:
We, the Renters (also referred to as “Tenants” and “Guests”) agree to the following:
1) We will leave the vacation rental clean when vacating, or a cleaning fee will be debited on our credit card.
2) We will be completely responsible for any and all damage to the condo or property caused by our negligence.
3) We will notify the owners of any damage upon arrival.
4) We will hold the owners and Courtyard by Marriott Ocean City harmless from any and all bodily injury and/or property damage incurred on the property arising out of our negligent acts or omissions. See disclaimer below.
5) We will forfeit any portion of the security/damage/cleaning deposit that is reasonably attributable to broken, damaged, or missing items.
6) We will forfeit any deposits made if cancellation is made 30 days or less prior to arrival.
7) We will forfeit the advancement deposit and rental monies if reservation is cancelled 30 days or less prior to arrival.
8) There are no refunds for early departure.
9) There are no refunds for snow or weather conditions.
10) All rental monies are due 30 days prior to arrival.
11) We will not hold the owners responsible for any items left after our check out.
13) We strive to maintain a relaxed and comfortable environment for all of our guests. For this reason, we strictly enforce a No Disturbance / No Party Policy. We permit a maximum of 6 persons in our 2 room condos, 10 in our 3-bedroom condos. If these limits are exceeded, or complaints are received and confirmed regarding noise, all occupants in the room may be asked to leave and all security/damage/cleaning deposit and rental monies will be forfeited.
14) The “propping” of condo room doors is prohibited; this can be a fire hazard and is for guest safety.
15) This is a NON-SMOKING vacation rental.
16) NO PETS allowed.
17) Check-in is at [04:00 PM] and check-out is [11:00 AM]. A late check-out is subject to extra rental charges.
18) The Renter must be 21 years of age to book this Vacation Rental.
19) Loitering in hallways and corridors is not permitted. This can be a disturbance to our other guests and can also be a fire hazard. Please try to keep gathering groups to the public lobby areas, restaurant, or meeting space.
20) The use of the Courtyard by Marriott Ocean City facilities are available for use to Miramar Condominium Renters but Courtyard by Marriott hotel policies must be followed.
21) The Courtyard by Marriott Ocean City Business center computer is to be used by persons over 16 or the person(s) must be under the supervision of an adult. Any inappropriate material, or material with adult content is prohibited. The viewing, downloading, or creating of such material is not tolerated and may result in the denial of any further use of the business center or the expulsion of the guest(s) from the property.
22) The Courtyard by Marriott Ocean City pool is open daily from 10:00am until 10:00pm. THERE IS NO LIFE GUARD ON DUTY. Appropriate clothing is required including full cover bathing suits. Persons under the age of 18 must be accompanied by a parent, guardian, or adult related to the group. The use of life saving equipment is strictly for that purpose and misuse is prohibited and may result in expulsion from the pool area. The hotel and Miramar Condominiums reserves the right to close the pool at any time in the event of cleaning or inappropriate behavior.
23) We reserve the right to refuse service to anyone. We will not be responsible for accidents or injury to guests or for loss of their money, jewelry or valuables of any kind.
Disclaimer:
Renters understand that the Homeowners are not responsible for any personal injury caused by slipping on snow or ice, and that tenants are responsible for the removal of snow and ice around the doorways and paths to car, to include the parking area.
And further that the homeowners are not responsible for any personal injury or loss or damage to tenants’ property caused directly or indirectly from foul, inclement weather conditions, Acts of God or nature, failure of heat, accidents related to fire, heaters, stoves, tenants’ failure to remove snow around access areas, or any unforeseeable circumstances.
Under no circumstances will tenants or their guests hold Harrison 15th Street LLC responsible for any damages or claims of any kind resulting from their stay, except for intentional acts of harm.
This agreement and disclaimer applies to Renters and all guests in the Renters’ party.
I, the Renter, have read, understand, agree to, and will abide by this rental agreement and all conditions stated herein.
