SPIRIT OF SOFIA TERMS AND CONDITIONS
Please read these terms and conditions ("terms and conditions", "terms") carefully before using Spiritofsofia.com and any subdomains or booking engines affiliated with the Spirit of Sofia (“website”, "service") operated by [name] ("us", 'we", "our"). Customer may be referred to as "You", "Your", "Guest", "Their", or "User".
Conditions of Use By using this website, you certify that you have read this Agreement and that you agree to comply with its terms. If you do not want to be bound by the terms of this Agreement, you are advised to leave the website accordingly. Spirit of Sofia only grants use and access of this website, its products, and its services to those who have accepted its terms.
Age Restriction You must be at least 25 (twenty-five) years of age to secure a reservation with us. Spirit of Sofia assumes no responsibility for liabilities related to age misrepresentation.
Pool and Jacuzzi The pool and jacuzzi are cleaned and drained via regular maintenance. We are not responsible for any personal injuries or damaged items resulting from use of any water features on the premises of the Spirit of Sofia.
Applicable Law By visiting this website, you agree to abide by the laws of the county of Riverside, the state of California, and the US federal government without regard to principles of conflict law, and understand these laws will govern these terms and conditions, or any dispute of any sort that might come between Spirit of Sofia and you, or its business partners and associates.
Bikes Our local partner may have bikes available for rent, with a refundable $100 security deposit. Please notify us at least 24 hours if you wish to rent out our awesome bikes!
Booking Fee we charge a 12% Booking Fee upon reservation.
Cancellation Policy Cancel for a full refund (less 3% payment processing fee) within 48 hours of booking if your check-in is at least 90 days in advance. All other bookings are non-refundable.
Refunds: In the event there is an identified deficiency with the accommodation or guest experience, a discount or refund may be agreed upon in writing by Guest and Spirit of Sofia. IN THE EVENT A DISCOUNT OR REFUND IS AGREED UPON, GUEST WAIVES ALL RIGHTS TO SUBMIT A CHARGEBACK CASE WITH THE ISSUER OF THE PAYMENT METHOD USED TO BOOK THEIR STAY. AGREEMENT TO A DISCOUNT OR REFUND IS EVIDENCE THAT GUEST DEEMS THE ISSUE RESOLVED AND THAT GUEST HAS BEEN SUFFICIENTLY COMPENSATED.
In the event guest wishes to cancel any experiences or add ons that may have been booked through Spirit of Sofia and its host partners, guest shall communicate with and retrieve any possible refund from the host partner. Spirit of Sofia is not responsible for refunding Experience payments.
Transferability: Reservations are transferable. We highly encourage you to reach out to our support team at least 48 hours prior to arrival at concierge@spiritofsofia.com to send the new contact's name, number and email.
Check-Out Process Unless otherwise agreed to, check-out is no later than 11:00 am PST. An optional late checkout is offered for an additional fee for certain units if you contact us at least two days prior to departure.
Cleaning Fees We charge a flat cleaning fee that is automatically added to each reservation. Daily maid services are not provided.
Confirmation Pending This is your reservation request status by default, as soon as our team confirms your reservation the status will be changed to "Confirmed Reservation" at which time you will be charged the total reservation cost, plus fees and taxes.
Dispute Resolution All actions or proceedings arising in connection with this Agreement, the breach thereof and/or the scope of the provisions of this Section 7(j) shall be submitted to the Judicial Arbitration and Mediation Service (the “JAMS”) for final and binding arbitration under its Rules of Arbitration, to be held in San Diego, California, before a single arbitrator who shall be a retired judge. The arbitration shall be a confidential proceeding, closed to the general public. Neither Party shall be entitled or permitted to commence or maintain any action in a court of law with respect to any matter in dispute until such matter shall have been submitted to arbitration as herein provided and then only for the enforcement of the arbitrator’s award. Notwithstanding anything to the contrary herein, each Party hereby irrevocably waives any right or remedy to seek and/or obtain injunctive or other equitable relief.
Events and Parties We only allow pre-approved gatherings, parties and events.
Full 23 Bedroom Hotel Buy-Out We accept full buy-out requests for the entire hotel, feel free to give us a call at 512-777-1455 or send us a message at concierge@spiritofsofia.com .
Indemnification You agree to indemnify Spirit of Sofia and its affiliates and hold Spirit of Sofia harmless against legal claims and demands that may arise from your use or misuse of our services or property. We reserve the right to select our own legal counsel.
General Area The property is two separate, private, large areas each with its own amenities including a pool and hot tub. Two separate groups can each book an area and not interfere with the other.
Limitation on Liability The Spirit of Sofia is not liable for any damages that may occur to you as a result of your misuse of our website / services. The Spirit of Sofia reserves the right to edit, modify, and change this Agreement at any time. This Agreement is an understanding between the Spirit of Sofia and the user, and this supersedes and replaces all prior agreements regarding the use of this website.
Damage to Hotel. The Guest will take every precaution not to damage property of the Spirit of Sofia. The Guest will be responsible for any such damage caused to the property during the booking by the Guests, Guests' visitors, agents or any other persons under the Guest's control. The Guest will assure that nothing is affixed to the floors, walls, or ceilings (by nails, screws, tape, drawing pins or other means, unless previously agreed in writing by Spirit of Sofia). Damage caused to Spirit of Sofia property in such an instance will be charged in full. The Guest may be required to provide additional forms of security by means of a deposit.
Email Marketing
You agree that Spirit of Sofia may, from time to time, send you updates about your reservation, new product and feature announcements, marketing materials, and promotional offers via SMS and/or email. You may opt-out of such communication by following the "unsubscribe" link present in every marketing email, by replying to an SMS with "unsubscribe", and/or by contacting guest services at concierge@spiritofsofia.com..
Lost or Stolen Items The Spirit of Sofia will not be responsible for accidents or injuries of any kind. This also includes any guests the renters may bring or the loss of money, jewelry, or valuables of any kind. Items that are found will be returned via mail. Items may be returned at the owner’s expense.
Maintenance Report all maintenance problems to our support team anytime during your stay. Non-emergency maintenance will typically be handled the next day, if possible.
Noise Ordinance Palm Springs has a noise ordinance to minimize volume after 9pm. We ask our guests to abide by the ordinance because we are trying to be good neighbors and respectful of our community. Failure to comply after 3 reminders may result in eviction and/or additional charges. You are more than welcome to still use the pool / outdoor areas after dark, we just ask that you keep noise levels low.
Payments All payments are processed through Spirit of Sofia’s website. All reservations require a valid credit card number on file. The full Amount of the reservation is due at booking.
Smoking Guests are prohibited from smoking in rooms or any other areas where smoking is prohibited by law. A cleaning fee of $500 will be charged to guests who violate this policy.
Staff access Our staff members and service providers may need to enter the property from time to time to execute recurring or one-time maintenance and/or assist guests with requests. These individuals may enter the hotel at any time and are under no obligation to alert guests before making entry. Staff and service providers shall knock and use reasonable judgment before entering a guest room.
Taxes All rooms are subject to a 11.5% local Palm Springs California tax.
