Mandala Springs Wellness Retreat Center

I ("Guest") agree to these terms and conditions as this agreement pertains to participation in the Event hosted by Earth Aware Hawaii DBA Mandala Springs (“Mandala”) during the Dates and Premises specified above. All copies, facsimiles, and reproductions of this document shall be as valid as the original. Section

Section 1. RELEASE OF LIABILITY Guest hereby releases Mandala, its officers, directors, employees, agents, land owners, or representatives from any and all liability, claims, or demands for personal injury, sickness, or death, as well as property and expenses, of any nature whatsoever which may be incurred by Guest regarding participation in any all activities related to the Event, including transportation. Guest further hereby agrees to hold harmless and indemnify Mandala, its officers, directors, employees, agents, land-owners, or representatives for any liability sustained by said acts, including expenses incurred attendant thereto. 

Section 2. EMERGENCY MEDICAL TREATMENT PERMISSION Guest understands that on rare occasions an emergency requiring medical treatment can develop. Guest hereby consents to receive medical treatment that may be deemed advisable in the event of injury, accident, and/or illness during the Event. Guest further agrees to pay for any medical, dental, surgical, or other hospital care, or diagnosis rendered to Guest friends and family.  It is understood that efforts shall be made to contact Guest designated emergency contact(s) before rendering treatment, but that any of the above treatment will not be withheld if the designated emergency contact(s) cannot be reached.  

Section 3. INCORPORATION OF RETREAT RULES Guest hereby agrees and represents that in consideration of Guest being permitted upon the Premises for any purpose Guest has reviewed and understands and consents to the Mandala Use Policies.  Guest  acknowledges and stipulates that for purposes of any claim or cause of action arising out of matters that are subject of this Agreement.  

Section 4. ASSUMPTION OF RISK Guest understands that participation with Mandala and/or any project, activity, or event sponsored, managed, arranged, or promoted by, or otherwise affiliated or associated with the Mandala brand may include activities that may be hazardous to Guest. Guest further recognizes and understands that such participation may involve certain inherently dangerous activities. Guest hereby expressly and specifically assumes the risk of injury or harm in the activities and release Mandala from all liability for injury, illness, death, and/or property damage that may result, with the exception of any injury or harm resulting from Mandala’s gross negligence. 

Section 5. MISCELLANEOUS Attendee expressly understands and agrees that this Agreement is intended to be as broad and inclusive as permitted by law, and that this Agreement shall be governed by and interpreted in accordance with the laws of the State of California. Guest agrees that in the event that any clause or provision of this Agreement shall be held to be invalid by any court of competent jurisdiction, the invalidity of such clause or provision shall not otherwise affect the remaining provisions of this Agreement. Similarly, if Mandala fails to enforce any provision of this Agreement, such waiver does not extend to any other provisions, which shall remain intact and binding despite any waiver. 

Section 6. HEADERS; TRANSLATIONS Attendee understands and expressly agrees that the headers for each section of this agreement and the accompanying translations following said sections are not binding on the parties. Guest further acknowledges and agrees that said headers and translations are merely included for informational and comprehensive purposes. By booking this reservation guest ACKNOWLEDGES THAT IT HAS READ AND UNDERSTANDS THIS AGREEMENT AND AGREES TO THE PROVISIONS HEREIN.
