Electricity - The Owner asks that the Renter bemindful with energy consumption as electricity in The Bahamas is approximately4 times the cost of in The USA or Canada. When leaving the house for the day,please turn off air-conditioning units, or leave them at 78-80 degrees Fahrenheit. The unitsare quite effective and will cool the house rapidly upon your return. The Property is fully furnished, including a complete supplyof bed linens and towels. Beach towels are available. Bath towels are not to betaken to the beach or pool. Patio furniture (including cushions or coverings)is not to be taken to the beach. Locked closets and pantries are not includedin this rental and you may not and you will cause all your family members,visitors and guests to not open any such locked closets and pantries. You asthe Renter, agree to use your best efforts to ensure that all your familymembers, visitors and other guests in your party follow the rules andregulations outlined in this document.
No Liability - Renter acknowledges and agrees onRenter’s behalf an on the behalf of all of Renters family members, visitors,guest and other third parties occupying or using all or any part of theProperty that Owner is in no way responsible for any personal injury or bodilyharm that may occur for any reason whatsoever on the Property to any Renter,any family member of Renter, any visitor or guests or other third parties, norfor any damage or loss for any reason whatsoever of Renter’s, any family membersof Renter, any visitor’s or guests’ or other third parties’ personalbelongings. Renter hereby agrees todefend, indemnify and hold harmless Owner, and its employees and agents (collectively,the “Indemnified Parties”), from and against all claims, causes of action,lawsuits, damages, liabilities, and expenses (including reasonable attorneys’fees) as may be incurred by Indemnified Parties because of renter’s failure tocomply and/or cause the compliance of renter’s family members, visitors, guestsand other third parties with the terms and conditions of this agreement.
Use of Golf Cart - The golf cart is made available for use by the Renter andmembers of the Renter’s family/group who are of 25 years of age, or older. Thegolf cart is not licensed for road use and is strictly provided for travelbetween Governors Estate and French Leave Beach only. Any use of the golf cartin violation of this agreement will result in a $200 penalty for eachprohibited use and could result in eviction. By using the golf cart, Renterassumes any and all risk associated with the operation of the golf cart and allliability for damages incurred to any third parties through operation of thegolf cart.
Capacity of House – The total number of persons allowedin the houses at any one time is restricted to the number of persons scheduledand paid for in the reservation. Presence of additional guests will subject Renter to immediate evictionand forfeiture rent. Parties and eventsare not permitted without the written permission of Owner.
Drugs and HazardousMaterials – TheRenter, Renter’s family members, visitors, guests and other members of suchRenter’s group are strictly prohibited from using or bringing onto the Propertyany illegal substances, flammable fluids, explosives or other items deemedhazardous to life, limb or Property, as determined by Owner, any partydesignated by Owner or Owner’s representatives.
Complaints andMaintenance - The Owner will make every effort to keep the premises and inventories in good working order. In the event, there is a maintenance problem; they will strive to repair the problem as soon as possible after being notified. No refund or rate adjustment will be made for unforeseen mechanical failures such as the supply of electricity, water, pool heater/filtration systems, air conditioning, telephone, television/cable service, appliances, etc. It is the Renter’s responsibility to report any problems or damage immediately to the local property manager.
No Smoking – Smoking is not permitted inhouse. Evidence of smoking will causeimmediate eviction, and forfeiture of Renter’s entire Rental Fee and SecurityDeposit.
No Pets – No pets of any kind are allowed in, on or around the Property at anytime without the prior written consent of the Owner being granted beforearrival for each pet that you propose to bring in, on or around the Property.
Transfer of Ownership of the House - Owner and Renter will be bound by this agreement evenin the event that ownership of the house is transferred by sale, bequest, orother means. Owner and Renter agree that this agreement shall survive any suchtransfer.
