Terms and Conditions
These Terms and Conditions (Conditions) set out the basis on which AMAMA BAITA (as defined below) will provide accommodation and other products and services at its hostels to Customers (as defined below) and Guests (as defined below). By making a Booking (as defined below) the Customer agrees to comply with these Conditions.
Prior to any reservation of a Service on the Site, the Client declares (i) that he/she is acting for personal purposes that are not part of his/her commercial, industrial, artisanal, liberal or agricultural activity and (ii) that he/she has the full legal capacity to commit himself/herself under the present General Conditions.
The Client is invited to read carefully the present General Conditions whose previous acceptance is mandatory for the reservation of any Service offered by AMAMA BAITA. It is advisable for every client to save and print the present General Conditions using the standard functionalities of his browser and computer.
AMAMA BAITA reserves the right to modify or complete, at any time, all or part of the present General Conditions. In this case, the new version of the General Conditions will be available on the Site with its effective date. Customers are advised to consult the General Conditions regularly to take note of any possible modifications. In any case, the Customer will only be bound by the version of the General Terms and Conditions in force at the time the Customer makes the reservation for the Service.
“Arrival Date” means the date on which the Customer’s stay at the hostel is due to commence, as per the Booking Details
“Booking” means the reservation by the Customer of accommodation and any other products and services detailed in the Booking which is accepted by AMAMA BAITA
“Booking Details” means the details of the Booking including the number of Guests, the number of rooms required, the duration of the Guests’ stay at the Hostel and any other products and/or services to be included in the Booking
“Charges” means the charges payable by the Customer in connection with the Booking
“Contract” means the contract between the Customer and AMAMA BAITA in relation to the Booking
“Customer” means person who makes the Booking
“AMAMA BAITA” means AB SAS or such other company in the same group of companies as AMAMA BAITA that operates the Hostel
“Guests” means the Customer and any third parties they invite to the Hostel in connection with the Booking
“Hostel” means the hostel owned or operated by AMAMA BAITA the location of which is specified in the Booking
2.2 When requesting Bookings, Customers will be required to provide identification information including, but not limited to, their name, address, contact telephone number and email address.
2.3 No request for a Booking should be deemed to be accepted unless and until AMAMA BAITA confirms its acceptance and provides a booking reference, at which point the Contract will come into existence.
2.4 Subject to clause 4 AMAMA BAITA will use its reasonable endeavors to accommodate any request from the Customer to change the Booking Details but any request to change the dates or length of stay or add products and/or services will be subject to availability and the Customer paying for such increased length of stay and/or products and/or services at AMAMA BAITA’s standard rates from time to time.
2.5 When booking beds in a shared room, AMAMA BAITA will attempt to put people on the same booking in the same room, however this cannot be guaranteed
3.2 Unless otherwise agreed by AMAMA BAITA, the Charges only cover the provision of accommodation at the Hostel and the Customer may incur additional charges including, without limitation, charges for meals, room service (the “Additional Charges”).
3.3 Customers will be informed of the amount of the Additional Charges before they are incurred.
3.4 Bookings will be subject to the Customer:
making payment of the Charges in full in advance or, at AMAMA BAITA’s option, paying a booking fee and/or deposit; and providing valid Debit or Credit Card details via which payment of the Charges or the balance of the Charges(as the case may be) and any Additional Charges can be taken at check in at the hostel or at the time of booking.
3.5 The amount of the reservation will be automatically debited from the debit or credit card 28 days before the arrival date.
3.6 If not prepaid in full at time of booking the balance of the Charges must be paid by the Customer immediately on checking in at the Hostel. Any Additional Charges must be paid either as they are incurred or, at AMAMA BAITA’s option, upon the Customer checking out at the Hostel.
3.7 The following payment methods are accepted by AMAMA BAITA
3.7.1 Credit and Debit Cards
Visa or MasterCard,
3.7.2 Cash or Credit/Debit Cards, if the Customer is paying in person at the Hostel : Maestro, American Express, Google Pay, Apple Pay, Union Pay.
4. CANCELLATIONS
4.1 Subject to clause 4.2, the Customer may cancel the Booking to AMAMA BAITA upon following conditions:
No Charge - If cancelled more than 14 days before date of arrival
Full Charge - Full Stay - If cancelled within 14 days of arrival
4.2 Where the Customer has been offered a discounted rate on condition that the Booking becomes non-refundable upon cancellation then, provided the Customer has been informed of such Condition, in the event of cancellation of the Booking, all Charges applicable to that Booking remain payable in full.
4.3 AMAMA BAITA may at any time cancel a Booking if the Hostel becomes unavailable due to circumstances outside AMAMA BAITA’s control in which case AMAMA BAITA will pay the Customer a full refund of any Charges and any booking fee paid.
4.4 AMAMA BAITA may at any time cancel the Booking if the payment details provided by the Customer in accordance with clause 3.4 are invalid and the Customer fails to provide alternative valid details.
5. CHECK IN AND CHECK OUT
5.1 Check-in time at the Hostel booked is from 16:00 hrs. Check-in prior to 16:00 hrs. may be available subject to prior arrangement with AMAMA BAITA.
5.2 Check-out time at the Hostel booked is 11:00 hrs. Failure to check-out by 11:00 hrs may result in the Customer being charged for an additional night’s accommodation at the standard applicable rate
6. HOSTEL RULES
6.1 Valid photo identification in the form of a National Identification or Passport is required at check-in.
6.2 Customers are required to conduct themselves and ensure that their Guests conduct themselves in a reasonable and responsible manner at the Hostel and must not act in any way which may disturb other guests. Failure to adhere to this requirement may result in Guests being asked to leave the Hostel in which event all Charges and Additional Charges shall become immediately payable by the Guest.
6.3 Smoking is not permitted inside the Hostel and only in the designated smoking areas. Failure to adhere to this requirement may result in Guests being charged a fee of 250€ and being asked to leave the Hostel without any refund.
6.4 The Customer will be responsible for any loss or damage caused at the Hostel by Guests or visitor of the Guest. The Client will be liable for AMAMA BAITA’s reasonable cost of repairing, cleaning or replacing any property of AMAMA BAITA which is damaged, soiled or lost by a Guest.
6.5 We don’t accept bookings made by those under the age of 18 without the company of adults over 18 or with a written consent signed by their parent or guardian with a copy of their ID which shows their signature. Failure to adhere to this rule will result in automatic Cancellation with no refund given.
6.6 AMAMA BAITA reserves the right to refuse entry to any person at any time if that person displays offensive or potentially offensive behavior, verbally or physically, to management, staff or other clients and guests.
7. FOOD AND DRINK
7.1 The Charges includes continental breakfast unless otherwise agreed by AMAMA BAITA
7.2 Customers and their Guests may only consume food and drink purchased from AMAMA BAITA. Externally purchase food and drink may only be consumed at the summer kitchen and garden dining areas.
8. FORCE MAJEURE
Neither party shall be liable to the other party in the event of non-performance of its obligations resulting from force majeure. It is expressly agreed that force majeure suspends, for the parties, the performance of their mutual obligations and that each party shall bear the costs arising therefrom. The cases usually recognized by the jurisprudence of the Court of Cassation are considered as force majeure. If the case of force majeure lasts more than thirty (30) days from its occurrence, these General Conditions may be terminated by any of the parties without either of them being entitled to claim damages.
9. APPLICABLE LAW AND SETTLEMENT OF DISPUTES
The General Conditions are governed by French law, without prejudice to the imperative protective provisions that may be applicable in the country of residence of clients. The client is informed by AMAMA BAITA of the possibility of resorting, in case of dispute relative to the present General Conditions, to a conventional mediation procedure or to any other alternative mode of settlement of disputes, under the conditions provided in Title I of Book VI of the Consumer Code. After having referred the matter to the Establishment in an attempt to resolve the dispute amicably, and in the event of a negative response or the absence of a response within sixty (60) days from the date of referral, the Customer may refer the matter to the Mediator for Tourism and Travel - BP 80303 - 75823 Paris Cedex 17. The terms and conditions of referral to the Mediation officer and his contact details are available on the website www.mtv.travel. Referral to the Mediator may be made within twelve (12) months of the first complaint.
