Sundance Club and Resort Overnight Stay Terms and Policies

General, Cancellation & Check-in & Check-out.  We are excited that you are staying at Sundance Club and Resort!  We welcome you and hope your stay is fun and relaxing.  Please read through our Terms and Policies as they govern our agreement with you to stay at the Club. We will charge your credit card for all your fees and expenses while you are here at the Club.  Thank you for being our guest! Sundance Club and Resort has the right to cancel your reservation if we do not receive the Pre-Payment Deposit. We will send you a cancellation confirmation via email if we cancel your booking. Here are some of our general rules:

  • You must be 21 years old and present to book a room
  • A valid photo ID is required upon check-in
  • All requests to reserve a room must include the first and last name of all adults occupying the room and a valid credit card for a guarantee of arrival
  • Our room rates are subject to change
  • All rooms are subject to a 18.25% hotel, sales, and occupancy tax collected by the State of Texas and Palo Pinto County
  • When booking, keep maximum occupancy rules in mind: two people max for rooms with a single bed (Queen or King) and four people max for rooms with multiple beds. Cribs available upon request, subject to availability.
  • Check-in time: 3:00 p.m. We’ll be ready for you.
  • Check-out time: 11:00 a.m. Seize the day, friend! At check-out time please drop keys into the “Used Key” box located at our front desk in the main hotel lobby. 
  • Later check-out times, for a fee, may be requested although we may not always be able to accommodate. It will depend on availability and on how busy we are.
  • An inspection of the room/accommodation may be made after check-out and we reserve the right to charge for any damages or breakages found before the room/accommodation is occupied again.
  • Please be aware that bed linen and towels should be placed where they were originally found. The bed linen and towels are NOT gifts and should remain in the room. 
  • Pets are not allowed in the rooms or on property. A $250 fine will be claimed if pets are found to have been in the room/accommodation.
  • Reservations are charged a Deposit Fee of 50% of the cost of the stay, at the time of the booking, and the Deposit in NON-REFUNDABLE.  The Remaining Balance for the full stay is charged 8 (EIGHT) days prior to arrival and at this time total amount paid is NON-REFUNDABLE 8 (EIGHT) days prior to check-in.
  • In case of a no show, the total price of the reservation is non-refundable and non-transferrable.
  • The only way we acknowledge cancellation of your reservation is you must email a cancellation request eight (8) days prior to the date of arrival for your stay, stating the reservation number to the following address: frontdesk@sundance-club.com
  • All cancellations are confirmed via email after the reservation has been canceled.
  • Cancellations received after 3pm EIGHT (8) days prior to check-in will not be refunded or credited and will be charged in full. 
Non-smoking Policy & Damages 

Non-smoking Policy
: Breathe easy. Sundance Club
 and Resort facilities are a non-smoking property. This applies to both traditional smoking methods and all electronic delivery systems, including vapes, vaporizers, vape pens, hookah pens, electronic cigarettes (e-cigarettes or e-cigs), e-pipes, and any variations of the foregoing regardless of the product’s name. By booking a reservation and staying with us, you agree to a $500 fine if any evidence of smoking is found in the room/accommodation or in any of the building areas such as window ledges, stairs or the entrance area near to the reception. Please note that we comply with the local health and safety guidelines and recommendations provided by the EEC on smoking in public places. Any smoking in the rooms or strong lingering smoking scents in rooms will result in a disappointed look and a $500 room cleaning fee.

Damages
: Pre-existing damages or room issues must be reported to the front desk (frontdesk@sundance-club.com) immediately after registration to avoid responsibility and potential charges. During your stay, the rooms/accommodations and all equipment and furniture should be treated with care and kept in order. Prompt notification to Sundance Club 
and Resort staff will be expected of any damages or breakages in the room/accommodation. You are financially responsible for any damage to the room/accommodation. This includes losses caused by you or your guests’ negligent actions and behavior. A summary check will be made of the room/accommodation at check-out time. However, a more detailed review of the condition of the room/accommodation and all equipment and facilities will be made soon after check-out and before another guest occupies the room/accommodation. Sundance Club and Resort will prepare and send a statement of damage along with an invoice for the repair or replacement cost – which may be charged to your credit card on file. Sundance Club and Resort may take any necessary action to resolve any issues and make sure all the equipment and facilities are working and provided as expected. You are personally liable for ALL damages caused by you, your family, or your guests. 

Additional Items for Our Guests to Please Note:


Immediate termination of your stay with us is possible if
  • More guests stay in the property than agreed.
  • Excessive noise is made in the evening hours or at night.
  • Sub-letting the room/accommodation you have rented (or giving it to other people). The number of people residing in the room/accommodation should be the same as confirmed in the booking. Accommodation for additional guests may be requested, however a $25 charge for each additional guest per night will be charged. We reserve the right to cancel any reservation, without refund, if an unconfirmed number of people stay overnight in the room/accommodation.
  • Sundance Club and Resort does not allow any pets in the rooms or on property. A $250 fine will be claimed if pets are found to have been in the room/accommodation.
  • Rooms and accommodations are near each other. All our guests are asked to respect the property and privacy of the neighbors and to not make any excessive noise between the hours of 10:00 p.m. and 8:00 a.m.
  • Sundance Club and Resort is not responsible for lost or forgotten personal things on the premises.
Extending Your Stay Policy: After you have booked your stay with us, you can extend your stay (depending on availability) by simply letting us know before you arrive. If you are already staying with us and you would like to stay longer, please let us know at least 24 hours before your check-out date. We will do our best to accommodate your new plans and this can include relocating you to a similar room/ accommodation should this be necessary.

Kitchen in Room Policy
: Please practice safe cooking habits - do not leave burners on unattended. Please do not cook with strong smelling ingredients. Lingering smells that require room closure and deep cleans will be charged a cleaning fee of up to $500.
 

Parking Policy
: Vacations at Sundance Club
 and Resort should be stress-free and for that reason, you get to park near your room. By parking a vehicle at our facility, you (and your guests) are doing so on your own accord. Sundance Club and Resort does not take responsibility or accept liability for damage, accident or loss to your vehicle or personal property.

Minimum Age Policy
: All guests must be 21 years or older to confirm guestroom accommodations at Sundance Club
 and Resort. A valid photo ID must be presented at the time of check-in for age verification. 

Alcohol Policy
: The good news? We have a bar! This means, by law, we can’t allow any alcohol to be brought onto the property. So absolutely NO OUTSIDE ALCOHOLIC BEVERAGES may be brought to ANY Sundance Club
 and Resort facility or property per TABC rules.  To uphold this law, we require all beverages on the property, including by the pool, to be purchased through Sundance Club and Resort, with the exception of transparent, see-through water bottles. Guests must purchase beer and wine in the bar area – then, if you like, you can head back to your room (or the pool) to enjoy. Cheers! 

No Outside Food and Beverage: Guests are not permitted to bring any outside food or beverages into the Sundance Club and Resort facilities (eg. bar, pool and restaurant).

Tiny Home Village Policies: Any member or guest that is not staying in a Tiny Home does not have access to use any outdoor facility related to the Tiny Homes (grills, fireplace, patio furniture, TVs, etc.). If a member or a guest is caught improperly using the Tiny Home outdoor facilities, the member is subject to expulsion, without refund, and an additional fee of $500, 

Room Cleaning
: Room refreshes will not be offered during stays. Should you need fresh towels or linen, please call the front desk or email frontdesk@sundance-club.com.
 

Firearm Policy
: Any guest or visitor who is in possession of a firearm on hotel premises is personally responsible for abiding by all applicable federal, state and local laws with respect to firearms. Subject to the following restrictions, guests of Sundance Club
 and Resort who are lawfully permitted to possess a firearm may bring such firearm onto the premises, provided that the presence of the firearm on hotel premises: is for storage purposes only; the firearm is and remains at all times unloaded; the firearm is and remains secured in a locked, hard-sided firearm container, provided by the guest, while transported to or from the guest room and while stored therein; and the firearm remains securely safeguarded at all times in a locked guest room or locked personal vehicle, except when transporting the firearm to or from a guest room.Guests who fail to abide by this policy may be asked to leave the premises, without refund. The hotel premises are private property, and our firearms policy applies to: (i) all firearms, regardless of whether the firearm is a handgun or a long-barreled gun; and (ii) all guests and visitors, even those possessing a valid license or permit to carry a firearm.The only exception to the restrictions described in this firearms policy statement is for law enforcement officers and designated military personnel, who are on-duty and required to carry firearms in the performance of their duties.

Guest Safety
: As part of our commitment to guest safety, employees will not disclose the identity, room number or presence of a guest to anyone other than appropriate law enforcement. This includes the taking of or delivery of messages or indirect forwarding of phone calls. It is the responsibility of guests to communicate their presence and room number to any person they wish to receive calls or visits from.
Safety cameras are used throughout the premises, and anyone on our property may be recorded. The hotel assumes no responsibility for any personal bodily injury incurred while using the facilities, where available. If you use the facilities, you do so at your own risk. 

In consideration of Your use of the Sundance Club and Resort property and facilities or Your participation in any of the Sundance Club and Resort Services, You and Your Family and Guests agree to and affirm the Sundance Club and Resort Use Agreement and Waiver (the “Use Agreement and Waiver” – a copy of which is available on request).  

Indemnification: You agree to fully release, indemnify, and hold harmless Sundance Club and Resort (“Club”) and all of its owners, managers, affiliates, employees, contractors, officers, directors, shareholders, agents, representatives, successors, assigns, and to the fullest extent permitted by law any Municipality (including its elected and appointed officials, officers, employees, agents, contractors, and volunteers) with which the operators have contracted with to provide Club Services, and every sponsor of any of the Club Services and all of the sponsor's owners, managers, affiliates, employees, contractors, officers, directors, shareholders, agents, representatives, successors, and assigns (collectively, the "Released Persons") from liability for all "Claims" arising out of or in any way related to Your use of the Club property, the Club Services, Vehicles, or related equipment, including, but not limited to, those Claims based on Released Persons' alleged negligence, breach of contract, and/or breach of express or implied warranty, except for Claims based on Released Persons' gross negligence or willful misconduct. Such releases are intended to be general and complete releases of all Claims. "Claims" means, collectively, any and all claims, injuries, demands, liabilities, disputes, causes of action (including statutory, contract, negligence, or other tort theories), proceedings, obligations, debts, liens, fines, charges, penalties, contracts, promises, costs, expenses (including attorney's fees, whether incurred at trial, on appeal, or otherwise), damages (including but not limited to, for personal injury, wrongful death, property damage, and injury to rider or to third parties, consequential, compensatory, or punitive damages), or losses (whether known, unknown, asserted, unasserted, fixed, conditional, or contingent) that arise from or relate to any activity on Club property.
You, for yourself and on behalf of Your heirs, assigns, personal representatives and next of kin, HEREBY RELEASE, INDEMNIFY, AND HOLD HARMLESS THE CLUB, its officers, directors, officials, agents and/or employees, other participants, sponsors, advertisers, permit grantors, independent contractors, sub-contractors and, if applicable, managers, owners and lessors of premises used to conduct the CLUB SERVICES (RELEASEES), from any and all claims, demands, losses, and liability arising out of or related to any INJURY, DISABILITY OR DEATH You may suffer, or loss or damage to person or property, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, to the fullest extent permitted by law. 

Mandatory ArbitrationYou and Your Family and Guests (“You”) agree that it is the AGREEMENT OF THE PARTIES (You, the Sundance Club and Resort (“Club”) and the Club’s Affiliates, Successors and Assigns, collectively the “Parties”) THAT ANY AND ALL CLAIMS SHALL BE RESOLVED THROUGH MANDATORY BINDING ARBITRATION (“MBA”), WITHOUT RESORT TO THE JUDICIAL PROCESS FOR ANY REASON. The parties represent to each other that all Claims between the parties shall be heard and resolved solely by an arbitrator chosen by the Club acting as an arbitrator in strict accordance with the terms of this Agreement and not by a judge or jury in a court of law. Should any arbitrator fail to serve, then the parties agree that the Club may select the arbitrator of its choice, in its sole discretion.  Further, the parties waive any conflict of interest arising from the fact that any arbitrator has acted as an attorney or mediator for one or more of the parties. The arbitrator appointed hereunder shall have exclusive authority to resolve all Claims between the parties. The arbitrator’s exclusive authority shall extend to all threshold, gateway, procedural, and substantive issues and defenses relating to any claim, including, but not limited to, (a) all issues regarding the formation, existence, legality, enforceability, scope, unconscionability, validity, negotiation, performance, ambiguity, breach, interpretation, waiver, reasonableness, revocability, reformation, rescission, reformation, fraud, fraudulent inducement and misrepresentations, substantive and procedural “arbitrability” and conscionability, applicability and adequacy of any of the agreements of the parties, (b) the ripeness or waiver of any Claim, (c) all defenses to a Claim, including affirmative defenses, (d) all challenges to the applicability of the FAA (hereinafter defined) and the rules and procedures set forth herein, and (e) all issues of discovery. The MBA shall be governed exclusively by the Federal Arbitration Act (hereinafter, "FAA") and the rules and procedures of the National Arbitration Forum (http://www.adrforum.com/) in effect as of the date of these Rules and Regulations (hereinafter, "NAF"). In the event of any conflict between the FAA, the NAF, and this Agreement, the provisions of this Agreement shall control. All parties agree that the relationship between the parties and this Agreement involve interstate commerce, the FAA exclusively governs all agreements between the parties, and all Claims between the parties, and no party shall pursue Claims or Remedies under the Texas General Arbitration Act. Texas law will apply when applicable. 

The arbitration shall consist of one arbitrator. The arbitration of any Claim shall be heard by the arbitrator within 365 days of the date on which the party requested arbitration. Discovery during arbitration shall be governed by the FAA and limited to production of written reports of experts and/or written estimates of Damages. No depositions, subpoenas, or other forms of written or oral discovery shall be requested or ordered. No arbitrator is authorized to award to either Party any amount of Damages or Remedies, or both, in excess of the Damage Limitation set out herein.  The Damage Limitation relating to any Claims against the Club is limited to $1000.  The Damage Limitation relating to any Claims against You  is the amount determined to be owed to the Club, and any fees or costs associated with the Claims. Each party shall assume responsibility for the fees for the arbitrator. All other costs and expenses of the arbitration shall be shared equally between the parties. Venue for all arbitrations shall be in Dallas, Dallas County, Texas. There will be no extraordinary, equitable, summary, prejudgment, or interim remedy or order, judicial or arbitral, nor any writ, sanction, subpoena, contempt, summons or other decree or order shall issue or be sought by either party before or during the pendency of the arbitration process or appeals therefrom. A party shall make a written request for arbitration of a Claim within the time limit set forth in the statute of limitation applicable to that Claim. Either Party may appeal any award within 180 days of the date on which the award was rendered by giving written notice to the other Party following the procedures set forth above. In the absence of such appeal, the award shall be final. Appeals shall be heard by the Arbitrator convened as provided above and any Claim heard anew (de novo) within 365 days of the notice of appeal. No legal, equitable, or administrative action shall be initiated by either Party during the arbitration appellate process. Notice of appeal within such 180-day period automatically vacates a prior award.
 

The MBA provisions shall survive indefinitely.
