Terms of Service CYPRESS BAY MARINA AND RESORT, INC. (CBRM) CUSTOMER SITESERVICE AGREEMENT (AGREEMENT)Cypress Bay Marina and Resort, Inc. is located at 110Cypress Resort Loop, Buchanan, TN. This Agreement is between CBRM and the Customer using CBRM facilities and incorporates the Rules and Regulations, Indemnification and Waiver of Liability, Cancelation and Refund Policies below.
RULES AND REGULATIONS These rules and regulations were established at the resort of Cypress Bay Marina and Resort, Inc, (CBRM) to maintain high standards of cleanliness, safety, and maintenance, and to ensure a positive experience for all guests. Your compliance is very much appreciated and will ensure a pleasant stay for all guests. Check-in time is 4:00 PM. Check-out time is 10:00 AM. Refunds/Prorating - No prorating or refunds for early departures. No refunds due to uncontrollable acts of nature. Children - Children under age 12 must be accompanied by an adult while in the common areas of CBRM. Children - Children under age 12 must wear a coast guard approved life jacket while on the dock. Visitors - All visitors must check-in at the office (Lighthouse(Memorial Day – Labor Day) and comply with CBRM rules/policies. Please be respectful of registered paying guests by limiting your visitors to no more than 4 at a time. All guests must leave the resort by 10 PM. No overnight guests allowed. Common courtesy shall prevail between all persons at CBRM. Respect the privacy of guests. Profane, abusive, harassing, threatening language or actions directed at CBRM personnel or other guests is unacceptable and could result in eviction.·
NO SMOKING in any of our cottages, bathhouse, or lighthouse. You must be 10 feet away from any entrances when smoking. Thank you! There is a $250 fine for smoking in our cottages. Fines will be billed on the credit card on record.
Noise control - No fireworks, or loud music. Quiet time10:00 PM – 7:00 AM.
Emergency and safety - No illegal drugs. All weapons shall be kept in compliance with state/federal laws. No discharge or use of firearms on CBRM premises. No smoking in or around CBRM buildings. Speed limit 5 mph. If you observe any activity you believe to be of concern, please contact the office. Vehicles and site occupancy - Two passenger vehicles per site. Utility/car/boat trailers must be parked in areas dedicated for trailer parking. No parking on grass, or adjacent/vacant sites. No vehicle repairs or maintenance may be done unless approved by management. Do not drive vehicles on grass or any areas other than gravel roads and parking spaces. Sites - Cleanliness of CBRM is important to everyone. All trash should be bagged and taken to the trash container. Do not leave trash outside of containers at any time. Outdoor items should be neat and orderly. No outdoor appliances (i.e., freezer, refrigerators) of any kind. No storage of tires on site. Hazardous materials shall not be disposed of in CBRM trash containers and should be discarded properly offsite. Please treat CBRM facilities respectfully and leave them in the same condition as you found them. If they need attention, notify the office .Portable grills – Please use the charcoal grills that are provided. Outdoor structures - No sheds, porches, decks, tents, tarps or utility buildings allowed. Laundry - No clotheslines or hanging laundry outdoors. Solicitation/peddling/business enterprise - No peddling, soliciting or business enterprise is allowed at CBRM. Signs for the sale of products or services are not allowed. Damages and personal liability - Any guest or visitor that willfully and/or negligently damages or destroys CBRM property, landscaping or equipment will be held liable for the value to repair or replace the damaged items and/or property. The responsible party(s) may be evicted for willful and /or negligent damage. Guest property - Guests use CBRM facilities at their own risk. Secure your valuables. Management assumes no liability for loss or damage to guest property and/or injury to person, pet, or party arising due to use of resort facilities or caused by others on the premises. CBRM is not responsible for loss or damage due to fire, accident, theft, weather, or catastrophic events.
Right to refuse/evict/deny access – CBRM is a privately-owned resort. Management reserves the right to refuse services, evictor deny access to anyone, under any circumstances it deems necessary, in accordance with applicable local, state, and federal laws. There will be no refunds. Policy changes - Since every contingency cannot be covered in a set of rules, from time to time, modification may be necessary. Management reserves the right to make changes deemed necessary to these rules and regulations at any time, without prior notice.
Pet Policy Dogs only. No other pets allowed. There is a $25 flat fee for one pet and a $45 flat fee for two pets. No more than two pets per reservation. Dogs are only allowed in our pet friendly rentals, no exceptions. Dogs must always be on a leash. It must be no longer than 6 feet long. Dogs can never be left alone inside your rental, not even in a crate. Please pick up your dogs’ waste. Good behavior is required. Dogs of any breed that are hostile or aggressive will be asked to leave the resort, along with their owners. Remember manners. Constant barking bothers other guests. If your pet is too vocal, you will need to find other accommodations.
NOTE: RATES ARE SUBJECT TO CHANGE WITHOUT NOTICE. CBRM MANAGEMENT ASSUMES NO RESPONSIBILITY FOR ACCIDENTS, INJURIES OR LOSS FROM ANYCAUSE. CBRM MAINTAINS A NO REFUND POLICY. Cypress Bay Marina and Resort, Inc. will not tolerate any onerous, harmful, or offensive activity of any sort that could interrupt and /or adversely affect the enjoyment of other parties utilizing our facilities. In the event of such onerous, harmful, or offensive activity, in the judgement of management, the parties responsible for such activities will be required to leave Cypress Bay Marina and Resort, Inc. immediately, without a refund.
RELEASE, INDEMNIFICATIONA ND HOLD HARMLESS AGREEMENT In consideration of participating in resort activities, and for other good and valuable consideration, I hereby agree to release and discharge from liability arising from negligence of CBRM and its owners, directors, officers employees, agents, volunteers, participants, and all other persons or entities acting for them (hereinafter collectively referred to as "Releasees"), on behalf of myself and my children, parents, heirs, assigns, personal representative, and estate, and also agree as follows:
1. I acknowledge that participating in CBRM activities involves known and unanticipated risks which could result in physical or emotional injury, paralysis or permanent disability, death, and property damage. Risks include, but are not limited to, broken bones, torn ligaments, or other injuries because of falls; burns from campfires; drowning in the lake or other bodies of water; falls from play equipment or caused by uneven surfaces; medical conditions resulting from physical activity; and damaged clothing or other property. I understand such risks simply cannot be eliminated, despite the use of safety equipment, without jeopardizing the essential qualities of the activity.
2. I expressly accept and assume all the risks inherent in this activity or that might have been caused by the negligence of the Releasees. My participation in this activity is purely voluntary and I elect to participate despite the risks. In addition, if at anytime event conditions are unsafe or that I am unable to participate due to physical or medical conditions, then I will immediately discontinue participation.
3. I hereby voluntarily release, forever discharge, and agree to indemnify and hold harmless releasees from all claims, demands, or causes of action which are in any way connected with my participation in this activity, or my use of their equipment or facilities, arising from negligence. This release does not apply to claims arising from intentional conduct. Should Releasees or anyone acting on their behalf be required to incur attorney's fees and costs to enforce this agreement, I agree to indemnify and hold them harmless for all such fees and costs.
4. I represent that I have adequate insurance to cover any injury or damage I may suffer or cause while participating in this activity, or else I agree to bear the costs of such injury or damage myself. I further represent that I have no medical or physical condition which could interfere with my safety in this activity, or else I am willing to assume —and bear the costs of — all risks that may be created, directly or indirectly, by any such condition.
5. In the event that I file a lawsuit, I agree to do so solely in the state where Releasees' facility is located, and I further agree that the substantive law of that state shall apply.
6. I agree that if any portion of this agreement is found to be void or unenforceable, the remaining portions shall remain in full force and effect.
7. Customer shall indemnify and hold CBRM, its’ owners, business associates and/or employees harmless from and against any and all claims, demands, costs and expenses, including reasonable attorney’s fees, arising from any and all damages or injuries caused by fire, water, wind, civil strife, or acts of God, owner and/or Customer actions or inactions (or those of their employees, agents, or invitees), or any other issue related to Customer’s use of facilities, regardless of whether such loss was caused by the negligence of any of CBRM, its’ owners’, business associates and/or employees.
CANCELLATION POLICY CBRM values every guest and reservation. If something changes with your travel plans and you must cancel your reservation(s), you must give us a call. Emails or voice messages will not suffice for a cancellation. We do not give credit or refunds for bad weather.
REFUND POLICY For a full refund you must cancel 30 days prior to your arrival date, minus a $25.00 administration fee. Canceling after 30 days of your arrival date your full reservation amount will be forfeited. No prorating or refunds for early departures
AFFIRMATIONAS A CUSTOMER OF CYPRESS BAY MARINA and RESORT, INC., IFULLY UNDERSTAND AND ACCEPT THESE RULES AND REGULATIONS, IDEMNIFICATION ANDWAIVER OF LIABILITY, CANCELLATION AND REFUND POLICIES AND ANY OTHER ATTACHEDGLAMPGROUND RULES.I also agree to vacate the premises at the request of management if in violation, without a refund. This agreement does not constitute a landlord / tenant agreement. Payment for sites is entirely for services rendered UNDER A HOST /GUEST ARRANGEMENT. By signing this Agreement, you are agreeing to abide by all rules and regulations of CBRM.
