Terms of ServiceCYPRESS BAY MARINA AND RESORT, INC. (CBRM) CUSTOMER SITESERVICE AGREEMENT (AGREEMENT)Cypress Bay Marina and Resort, Inc. is located at 110Cypress Resort Loop, Buchanan, TN. This Agreement is between CBRM and theCustomer using CBRM facilities and incorporates the Rules and Regulations,Indemnification and Waiver of Liability, Cancelation and Refund Policies below.

 RULES AND REGULATIONSThese rules and regulations were established at the resortof Cypress Bay Marina and Resort, Inc, (CBRM) to maintain high standards ofcleanliness, safety, and maintenance, and to ensure a positive experience forall guests. Your compliance is very much appreciated and will ensure a pleasantstay for all guests. Check-in time is 4:00 PM. Check-out time is 10:00 AM. Refunds/Prorating - No prorating or refunds for earlydepartures. No refunds due to uncontrollable acts of nature.Children - Children under age 12 must be accompanied by aadult while in the common areas of CBRM.Children - Children under age 12 must wear a coast guardapproved life jacket while on the dock. Visitors - All visitors must check-in at the office (Lighthouse(Memorial Day – Labor Day) and comply with CBRM rules/policies. Please berespectful of registered paying guests by limiting your visitors to no morethan 4 at a time. All guests must leave the resort by 10 PM. No overnight guestsallowed.Common courtesy shall prevail between all persons at CBRM.Respect the privacy of guests. Profane, abusive, harassing, threateninglanguage or actions directed at CBRM personnel or other guests is unacceptableand could result in eviction.·NO SMOKING in any of our cottages, bathhouse, or lighthouse.You must be 10 feet away from any entrances when smoking. Thank you! There is a$250 fine for smoking in our cottages. Fines will be billed on the credit card onrecord.Noise control - No fireworks, or loud music. Quiet time10:00 PM – 7:00 AM.Emergency and safety - No illegal drugs. All weapons shallbe kept in compliance with state/federal laws. No discharge or use of firearmson CBRM premises. No smoking in or around CBRM buildings. Speed limit 5 mph. Ifyou observe any activity you believe to be of concern, please contact theoffice.Vehicles and site occupancy - Two passenger vehicles persite. Utility/car/boat trailers must be parked in areas dedicated for trailerparking. No parking on grass, or adjacent/vacant sites. No vehicle repairs ormaintenance may be done unless approved by management. Do not drive vehicles ongrass or any areas other than gravel roads and parking spaces.Sites - Cleanliness of CBRM is important to everyone. Alltrash should be bagged and taken to the trash container. Do not leave trashoutside of containers at any time. Outdoor items should be neat andorderly. No outdoor appliances (i.e., freezer, refrigerators) of anykind. No storage of tires on site. Hazardous materials shall not be disposed ofin CBRM trash containers and should be discarded properly offsite. Please treatCBRM facilities respectfully and leave them in the same condition as you foundthem. If they need attention, notify the office.Portable grills – Please use the charcoal grills that areprovided.Outdoor structures - No sheds, porches, decks, tents, tarps,or utility buildings allowed. Laundry - No clotheslines or hanging laundry outdoors. Solicitation/peddling/business enterprise - No peddling,soliciting or business enterprise is allowed at CBRM. Signs for the sale of productsor services are not allowed.Damages and personal liability - Any guest or visitor thatwillfully and/or negligently damages or destroys CBRM property, landscaping orequipment will be held liable for the value to repair or replace the damageditems and/or property. The responsible party(s) may be evicted for willfuland/or negligent damage.Guest property - Guests use CBRM facilities at their ownrisk. Secure your valuables. Management assumes no liability for loss or damageto guest property and/or injury to person, pet, or party arising due to use ofresort facilities or caused by others on the premises. CBRM is not responsiblefor loss or damage due to fire, accident, theft, weather, or catastrophicevents.Right to refuse/evict/deny access – CBRM is aprivately-owned resort. Management reserves the right to refuse services, evictor deny access to anyone, under any circumstances it deems necessary, inaccordance with applicable local, state, and federal laws. There will be no refunds.Policy changes - Since every contingency cannot be coveredin a set of rules, from time to time, modification may be necessary. Managementreserves the right to  make changesdeemed necessary to these rules and regulations at any time, without priornotice.Pet PolicyDogs only. No other pets allowed.There is a $25 flat fee for one pet and a $45 flat fee fortwo pets. No more than two pets per reservation.Dogs are only allowed in our pet friendly rentals, noexceptions. Dogs must always be on a leash. It must be no longer than 6feet long.Dogs can never be left alone inside your rental, not evenin a crate.Please pick up your dogs’ waste.Good behavior is required. Dogs of any breed that arehostile or aggressive will be asked to leave the resort, along with theirowners.Remember manners. Constant barking bothers other guests. Ifyour pet is too vocal, you will need to find other accommodations.NOTE: RATES ARE SUBJECT TO CHANGE WITHOUT NOTICE. CBRMMANAGEMENT ASSUMES NO RESPONSIBILITY FOR ACCIDENTS, INJURIES OR LOSS FROM ANYCAUSE. CBRM MAINTAINS A NO REFUND POLICY.Cypress Bay Marina and Resort, Inc. will not tolerate anyonerous, harmful, or offensive activity of any sort that could interrupt and /or adversely affect the enjoyment of other parties utilizing our facilities. Inthe event of such onerous, harmful, or offensive activity, in the judgement ofmanagement, the parties responsible for such activities will be required toleave Cypress Bay Marina and Resort, Inc. immediately, without a refund.

RELEASE, INDEMNIFICATIONA ND HOLD HARMLESS AGREEMENTIn consideration of participating in resort activities, andfor other good and valuable consideration, I hereby agree to release anddischarge from liability arising from negligence of CBRM and its owners,directors, officers employees, agents, volunteers, participants, and all otherpersons or entities acting for them (hereinafter collectively referred to as"Releasees"), on behalf of myself and my children, parents, heirs,assigns, personal representative, and estate, and also agree as follows:1.      I acknowledge thatparticipating in CBRM activities involves known and unanticipated risks whichcould result in physical or emotional injury, paralysis or permanentdisability, death, and property damage. Risks include, but are not limited to,broken bones, torn ligaments, or other injuries because of falls; burns fromcampfires; drowning in the lake or other bodies of water; falls from playequipment or caused by uneven surfaces; medical conditions resulting fromphysical activity; and damaged clothing or other property. I understand suchrisks simply cannot be eliminated, despite the use of safety equipment, withoutjeopardizing the essential qualities of the activity.2.      I expressly accept andassume all the risks inherent in this activity or that might have been causedby the negligence of the Releasees. My participation in this activity is purelyvoluntary and I elect to participate despite the risks. In addition, if at anytime event conditions are unsafe or that I am unable to participate due tophysical or medical conditions, then I will immediately discontinueparticipation.3.      I hereby voluntarilyrelease, forever discharge, and agree to indemnify and hold harmless releaseesfrom all claims, demands, or causes of action which are in any way connectedwith my participation in this activity, or my use of their equipment orfacilities, arising from negligence. This release does not apply to claimsarising from intentional conduct. Should Releasees or anyone acting on theirbehalf be required to incur attorney's fees and costs to enforce thisagreement, I agree to indemnify and hold them harmless for all such fees andcosts.4.      I represent that I haveadequate insurance to cover any injury or damage I may suffer or cause whileparticipating in this activity, or else I agree to bear the costs of suchinjury or damage myself. I further represent that I have no medical or physicalcondition which could interfere with my safety in this activity, or else I amwilling to assume —and bear the costs of — all risks that may be created,directly or indirectly, by any such condition.5.      In the event that I file alawsuit, I agree to do so solely in the state where Releasees' facility islocated, and I further agree that the substantive law of that state shallapply.6.      I agree that if anyportion of this agreement is found to be void or unenforceable, the remainingportions shall remain in full force and effect.7.      Customer shall indemnifyand hold CBRM, its’ owners, business associates and/or employees harmless fromand against any and all claims, demands, costs and expenses, includingreasonable attorney’s fees, arising from any and all damages or injuries causedby fire, water, wind, civil strife, or acts of God, owner and/or Customeractions or inactions (or those of their employees, agents, or invitees), or anyother issue related to Customer’s use of facilities, regardless of whether suchloss was caused by the negligence of any of CBRM, its’ owners’, business associatesand/or employees.

CANCELLATION POLICYCBRM values every guest and reservation. If somethingchanges with your travel plans and you must cancel your reservation(s), youmust give us a call. Emails or voice messages will not suffice for a cancellation. Wedo not give credit or refunds for bad weather.  

REFUND POLICYFor a full refund you must cancel 30 days prior to yourarrival date, minus a $25.00 administration fee. Canceling after 30 days of your arrival date your full reservation amount will be forfeited.No prorating or refunds for early departures

AFFIRMATIONAS A CUSTOMER OF CYPRESS BAY MARINA and RESORT, INC., IFULLY UNDERSTAND AND ACCEPT THESE RULES AND REGULATIONS, IDEMNIFICATION ANDWAIVER OF LIABILITY, CANCELLATION AND REFUND POLICIES AND ANY OTHER ATTACHEDGLAMPGROUND RULES.I also agree to vacate the premises at the request ofmanagement if in violation, without a refund.This agreement does not constitute a landlord / tenantagreement. Payment for sites is entirely for services rendered UNDER A HOST /GUEST ARRANGEMENT. By signing this Agreement, you are agreeing to abide by allrules and regulations of CBRM.
