STAY ONERA TERMS AND CONDITIONS
Please read these terms and conditions ("terms and conditions", "terms") carefully before using the Stay Onera website (“website”, "service") operated by Stay Onera LLC ("us", 'we", "our"). The Customer may also be referred to as "Guest", "User", or "You" in the below terms and conditions.
Conditions of Use
By using this website, you certify that you have read and reviewed this Agreement and that you agree to comply with its terms. If you do not want to be bound by the terms of this Agreement, you are advised to leave the website accordingly. Stay Onera only grants use and access of this website, its products, and its services to those who have accepted its terms.
Age Restriction
You must be at least 21 (twenty-one) years of age before you can secure a reservation with us. Stay Onera assumes no responsibility for liabilities related to age misrepresentation.
Applicable Law
By visiting this website, you agree that the laws of Gillespie County, the State of Texas, and the US Federal Government, without regard to conflict of law principles, will govern these terms and conditions, or any dispute of any sort that might come between Stay Onera and you, or its business partners and associates.
Cancellation Policy
Cancel for a full refund (less 3% payment processing fee) within 48 hours of booking if your check-in is at least 60 days in advance. All other bookings are non-refundable.
Refunds
In the event there is an identified deficiency with the accommodation or guest experience, a discount or refund may be agreed upon in writing by Guest and Stay Onera. IN THE EVENT A DISCOUNT OR REFUND IS AGREED UPON, GUEST WAIVES ALL RIGHTS TO SUBMIT A CHARGEBACK CASE WITH THE ISSUER OF THE PAYMENT METHOD USED TO BOOK THEIR STAY. AGREEMENT TO A DISCOUNT OR REFUND IS EVIDENCE THAT GUEST DEEMS THE ISSUE RESOLVED AND THAT GUEST HAS BEEN SUFFICIENTLY COMPENSATED.
In the event guest wishes to cancel any experiences or add ons that may have been booked through Stay Onera and its host partners, guest shall communicate with and retrieve any possible refund from the host partner. Stay Onera is not responsible for refunding Experience payments.
Transferability
Reservations are transferable. We highly encourage you to reach out to our support team at least 48 hours prior to arrival at concierge@stayonera.com to send the new contact's name, number and email.
Check-In Process
Your check-in instructions are sent via email the day prior to your arrival. Unless otherwise agreed upon, check-in is no earlier than 3:00 pm CST. If you come across any concerns, please contact us at concierge@stayonera.com. This will help us to correct any issues that may need to be corrected in a timely manner so as not to interfere with your stay. There will be no refunds for problems or concerns that may occur that are not reported. We will not refund any money if there is a problem and you do not allow us the opportunity to rectify the problem.
An optional early check-in is offered for an additional fee for certain units, if you contact us at least two days prior to arrival.
Check-Out Process
Check-out is at 11:00 am CST unless otherwise agreed upon. An optional late checkout is offered for an additional fee for certain units if you contact us at least two days prior to departure.
Common Pool and Sauna
The communal pool area shuts down at 10:00 pm CST.
Dispute Resolution
All actions or proceedings arising in connection with this Agreement, the breach thereof and/or the scope of the provisions of this Section 7(j) shall be submitted to the Judicial Arbitration and Mediation Service (the “JAMS”) for final and binding arbitration under its Rules of Arbitration, to be held in Austin, Texas, before a single arbitrator who shall be a retired judge. The arbitration shall be a confidential proceeding, closed to the general public. Neither Party shall be entitled or permitted to commence or maintain any action in a court of law with respect to any matter in dispute until such matter shall have been submitted to arbitration as herein provided and then only for the enforcement of the arbitrator’s award. Notwithstanding anything to the contrary herein, each Party hereby irrevocably waives any right or remedy to seek and/or obtain injunctive or other equitable relief.
We only allow pre-approved gatherings, parties and events.
Fees and Taxes
All reservations are subject to: 6% Booking Fee, 7% City Tax, 6% State Tax and we charge a one time flat rate Cleaning Fee of $95.
Indemnification
You agree to indemnify Stay Onera and its affiliates and hold Stay Onera harmless against legal claims and demands that may arise from your use or misuse of our services. We reserve the right to select our own legal counsel.
Stay Onera is not liable for any damages that may occur to you as a result of your misuse of our website or services. Stay Onera reserves the right to edit, modify, and change this Agreement at any time. We shall let our users know of these changes through electronic mail. This Agreement is an understanding between Stay Onera and the user, and this supersedes and replaces all prior agreements regarding the use of this website.
SMS / Email Marketing
You agree that Onera may, from time to time, send you updates about your reservation, new product and feature announcements, marketing materials, and promotional offers via SMS and/or email. You may opt-out of such communication by following the "unsubscribe" link present in every marketing email, by replying to an SMS with "unsubscribe", and/or by contacting guest services at concierge@stayonera.com.
Stay Onera will not be responsible for accidents or injuries of any kind. This also includes any guest the renters may bring or the loss of money, jewelry, or valuables of any kind. Items that are found will be returned via mail. Items may be returned at the owner’s expense.
Maintenance
Please be advised that our cleaning and on-site management team may be seen in the area for cleaning and maintenance visits. Also, it is impossible to guarantee that all appliances will be in working order 100% of the time. We do guarantee to make every effort to correct all deficiencies as soon as possible during normal business hours. Report all maintenance problems to our support team anytime during your stay. Non-emergency maintenance will be handled the next day.
Noise Ordinance
Fredericksburg, Texas has a noise ordinance to minimize volume after 9:00 pm CST. We ask our guests to abide by the ordinance because we are trying to be good neighbors and respectful of our community. Failure to comply after 3 reminders may result in eviction and/or additional charges.
Our communal area, pool, and sauna shut off at 10:00 PM CST.
Parking
There is more than enough parking space near your assigned unit. Our parking spaces can fit 2 vehicles. We also have 1 available EV Charger on site. Please notify our support team at concierge@stayonera.com if you need access on it.
Payments
All payments are processed through the Stay Onera website. All reservations require a valid credit card number on file. The full Amount of the reservation is due upon booking.
Pets
We do not allow dogs or other pets at Stay Onera, however, special arrangements will be considered for licensed service animals per federal ADA requirements.
Stay Onera booking rates vary significantly throughout the year based on a variety of factors. The reservation price is determined at the time the reservation is made. No refunds or adjustments will be made for rate changes that take place after the date the reservation is made. These prices are subject to change based on availability, demand and seasonality.
Property Use and Problem Notification
Guests are expected to exercise safe, prudent, appropriate and cautionary use of the rental property. The guest shall notify the host of any element of the property that they feel needs attention and provide the host a reasonable amount of response time to assist the guest with a resolution.
Damage to Hotel. The Guest will take every precaution not to damage property of Stay Onera. The Guest will be responsible for any such damage caused to the property during the booking by the Guests, Guests' visitors, agents or any other persons under The Guest's control. The Guest will assure that nothing is affixed to the floors, walls, or ceilings (by nails, screws, tape, drawing pins or other means, unless previously agreed in writing by Stay Onera). Damage caused to Stay Onera property in such an instance will be charged in full. The Guest may be required to provide additional forms of security by means of a deposit.
Smoking
Guests are prohibited from smoking in rooms or any other areas where smoking is prohibited by law. A cleaning fee of $500 will be charged to guests who violate this policy
Trash Disposal
If you fill up your trash can in the middle of your stay with us, please let our team know in the morning if you would like us to pick up the trash. After letting us know, leave the tied-up trash bag at the bottom of the stairs to the deck by 1 pm the latest. You don't need to take your trash outside on the day of check-out, we will handle it .If you miss the trash pick up schedule - there is a dumpster at the entrance. You may drop off your trash anytime at the dumpster.
Wildlife
Do not feed any wildlife you may encounter while staying at Onera. Deer and other forest animals can become overly aggressive over time if humans feed them frequently. Thank you!
