Please note:
- A refundable security deposit of $350 USD will be collected upon check-in.
- We highly recommend obtaining travel insurance for any unforeseen circumstances
PROPERTY:
The property is located 2 Miles South, San Pedro Town, Ambergris Caye, Belize. The Property is furnished and includes a full kitchen, laundry room, linens, bath towels & beach towels.
MAXIMUM OCCUPANCY:
The maximum number of guests is limited to 4 people in Condo C2, 6 people in Condos C1 & C3, and 8 guests in Condo C4. Guests beyond the maximum number will be required to find additional accommodations.
MINIMUM STAY:
This property requires a 3-night minimum stay. A 6-night minimum stay will be required during holiday periods from December 16th to January 6th.
RENTAL RULES: Guests agree to abide by the Rental Rules attached as Exhibit A at all times while at the property and shall cause all members of the rental party and anyone else the guest permits on the property to abide by the following rules at all times while at the property.
ACCESS:
The guest shall allow Property Management access to the property for the purpose of repair and inspection. Property Management shall exercise this right of access in a reasonable manner.
CHANGES & REFUNDS:
- 30 or more days prior to the date of arrival: Full Refund
- Between 30 and 14 days prior to the date of arrival: 50% deposit refund
- 14 days or less prior to arrival: no deposit refund (excludes peak season)
- Peak season: No refunds 30 days or less prior to arrival
- Refunds will be conducted using the credit card used upon booking only. No exceptions of any kind.
INSURANCE:
We encourage all renters to purchase traveller insurance.
RENTAL RATES & FEES:
- A 50% deposit is required to fully confirm your reservation.
- All fees listed are in USD dollars.
- Final payment is due 7 days prior to arrival.
- A damage/loss security deposit of $350 (USD) will be charged at check-in.
- An inventory of condo contents will be provided to the guest at check-in.
- The security deposit will be refunded within 14 days of check out pending post-occupancy inspection.
- A credit card fee may be applied to cancellations.
- All charges are in Belize Dollars, and payments are subject to foreign exchange and international transaction fees by your credit card company.
If the premises appear dirty or damaged upon Check-in, the Guest shall inform Management immediately.
Rental Rules
- Smoking inside the residences is prohibited. Please use the designated smoking area outdoors, beach dock and pool deck only. Guests will be fined $500 USD for violation of this policy.
- The use, purchase or sale of drugs (including marijuana) on our properties is prohibited. Guests will be fined $500 USD for violation of this policy, and the local authorities will be involved.
- People other than those in the Guest party set forth above may not stay overnight at the property. Any other person at the property is the sole responsibility of the Guest.
- All of the units are privately owned; the owners are not responsible for any accidents, injuries or illness that occur while on the premises or its facilities. The Homeowners and Property Managers are not responsible for the loss of personal belongings or valuables of the guest. By accepting this reservation. It is agreed that all guests are expressly assuming the risk of any harm arising from their use of the premises or by their invitees.
- Being located on an island, please conserve utilities (electricity & water) whenever possible. Please be mindful of excessive electricity use. Turn off air conditioning and lights when not in the unit. Do not keep doors or windows open if air conditioning is in use.
- Keep the property and all furnishings in good order
- Only use appliances for their intended uses.
- Guests are not allowed to bring pets
- Pool: No running on the Pool Decks. No Diving at any time. There is no lifeguard on duty. No glass allowed.
- Water and Septic: The property is on a septic system. The septic system is very effective; however, it will clog up if improper material is flushed. DO NOT FLUSH anything other than toilet paper. No feminine products should be flushed at any time.
- Storms: If there is a tropical storm or hurricane, no refunds will be given unless:
- The state of Belize or local authorities order mandatory evacuations in a “Tropical Storm/Hurricane Warning area” and/or
- A “mandatory evacuation order has been given for the Tropical Storm/Hurricane Warning.” Area, we will refund:
- Any unused portion of rent from a guest currently registered;
- Any unused portion of rent from a guest that is scheduled to arrive, and wants to shorten the stay, to come in after the Hurricane Warning is lifted.
- Any advance rent collected or deposited for a reservation that is scheduled to arrive during the “Hurricane Warning” period.
- Quiet time is from 10:00 pm to 7:00 am. Please refrain from causing noise outside and be mindful of neighboring guests when inside.
Release & Waiver of Liability and Indemnity Agreement
In consideration for receiving permission to rent and being permitted to enter the premises and the property for vacation rental or any other purpose, I hereby RELEASE, WAIVE, DISCHARGE and COVENANT NOT TO SUE the Property Management Company (Suya’s Belize Management), their officers, agents, servants or employees; the owner of the property unit premises, and the Tara Del Sol HOA (Homeowners Association), (hereinafter referred to as RELEASEES) from any and all liability, claims, demands, actions and causes of action whatsoever arising out of or related to any loss, damage or injury including death, that may be sustained by me or of the property belonging to me, whether caused by the negligence of the releases or otherwise, while in, on or upon the premises where the use is being conducted.
I further hereby AGREE TO INDEMNIFY AND HOLD HARMLESS the RELEASEES from any loss, liability, damage, or costs, including courts costs and attorney fees, that they may incur due to my participation in renting, whether caused by the negligence of releases or otherwise.
It is my express intent that this Waiver of Liability and Hold Harmless Agreement shall bind the members of my family, spouse, children and my guests. I hereby further agree that this Waiver of Liability and Hold Harmless Agreement shall be construed in accordance with the laws of Belize.
I hereby accept full responsibility for each child who arrives on the property. All children under the age of 16 must be supervised at all times.
I hereby certify that guests have adequate insurance to cover any injury, illness or damages that may be caused or suffered while in or upon the premises, units, common grounds, ocean or any area, and agrees to bear the costs of such damage or injury. I further certify that they have no medical conditions which would interfere with the use of sea kayaks, swimming, snorkelling, scuba diving, climbing stairs, etc., or else assume and bear the costs of all risks that may be created, directly or indirectly, by such condition and expressly acknowledges such physical activities are dangerous and involve the risk of serious injury and/or property damage and/or death.
I agree and acknowledge I will inspect the unit and grounds immediately upon check-in and accept such areas are safe and suited for the guests and entire party use. I further acknowledge and accept that I and the entire party will leave the premises in the same condition as was found prior to my rental. I agree to notify appropriate personnel in the event of any unsafe situation or occurrence.
IN ACCEPTING THE TERMS AND CONDITIONS, I ACKNOWLEDGE AND REPRESENT THAT I have read the foregoing Waiver of Liability and Hold Harmless Agreement, understand it, shall bind the members of my family, spouse, children and my guests, and sign it voluntarily as my own free act and deed; no oral representations, statement or inducements, apart from the foregoing written agreement, have been made; I am at least eighteen(18) years of age and fully competent; and I execute this Release for full, adequate and complete consideration fully intending to be bound by same.
